We recently we had a change in our in our sergeants here in Vineyard. 00:01:39
Most of you remember Sergeant Greg Sherwood. He served with us here in Vineyard for. 00:01:42
Three years and I just wanted to take a minute just to thank him for his service. 00:01:46
The vineyard and talk a little bit about things he was able to accomplish while he was here. 00:01:50
When we when he first came on, it was right after we had. 00:01:54
My position changed to Lieutenant, so he was the lone Sergeant here in the city. 00:01:57
And that's a unique position because normally a Sergeant is out with his guys are out and off when these guys are off. 00:02:02
But when you got, when he's, when you supervise guys seven days a week, 24. 00:02:08
Hours a day. 00:02:11
That's not always. That's not the case, though. He had a big burden of supervising all the guys. 00:02:13
And work in a kind of a crazy schedule for a while. 00:02:17
And we always get a bunch of our. 00:02:20
There are newer deputies and Greg has done a great job or did a great job. He'll continue to do so of mentoring the new guys. 00:02:22
Helping them learn, you know what, the way we do the business of the county and in Vineyard and just helping them learn how to 00:02:29
investigate cases and do. 00:02:32
Good works for the for the residents here and throughout the county. 00:02:36
He's just such a great asset to the Sheriff's Office. I mean, he's been with us. 00:02:41
1314 years. 00:02:45
Close to 14 years at the county and he served before that with Spanish Fork. 00:02:46
But just a great asset and just a great person. I just wanted to thank him. 00:02:51
For all the work he did in Vineyard, he's now going to be serving as a one of our sergeants on our county patrol teams. So. 00:02:55

Wide range of skills and and. 00:03:29
Experience and knowledge. He's also one of our team leaders on our SWAT team at the county right now. 00:03:33
So he brings that element into the city for us and some of those those tactical mindset for us, which is going to be awesome. And 00:03:38
he has some big shoes to fill, fill in for Greg. 00:03:43
But we're very excited to have him. 00:03:47
And excited to see what he can do with the team and motivate them and help them continue the work that we've been doing here in 00:03:49

I just have a brief presentation for an update on where we're at with the economic development. 00:05:11
Strategic plan. 00:05:15
We're hoping that I'll be back here in just a few weeks seeking approval of the document. 00:05:16
But I just kind of want to let all of you know where we're at in it. I also sent a copy of. 00:05:21
Of the actual. 00:05:25
Document to all of you today. 00:05:28
And I'm totally open. If anybody wants to meet and then go over that, I'm more than happy to. 00:05:30

There we go. So one of the aspects of the plan that I really like at the beginning is they include this quote that says to 00:05:45
effectively implement a strategy, it's important to say no to certain opportunities and is. 00:05:50
As it is to say yes to others. So I have some images here of something of what what placemaking economic development can bring to 00:05:56
a community. 00:06:00
And then, you know, I have some examples here in Utah also what economic development can bring to a community. And so, you know, 00:06:04
I, I just want to use these types of images as we consider. 00:06:09
What? What does the economic development of our city look like in the future? 00:06:13
So the document itself, it's roughly over 60 pages, most of that is going to be data collection that Leland consultants. 00:06:18
Firm did for us and I just included some here that I thought was interesting talking about. 00:06:25
Our existing kind of jobs that we have in the city as well as the unmet demand, umm. 00:06:30
In Vineyard, so you can see you there, right, the very top, we have a really big demand for a grocery store. 00:06:35
We know that from the residents, but also the the data's telling us that too. And hopefully in a few months here we'll be able to 00:06:40
meet a lot of that that demand. 00:06:44
And so this data provides some framework about what we can do in the community development department to. 00:06:48
Help bring in these retailers or these. 00:06:54
Commercial businesses to the city. 00:06:57
To help us out. 00:06:59
OK, so the the meat of the the. 00:07:02
Economic Development Strategic Plan, or EDSP for short. 00:07:06
Is really the implementation plan, and what that is is it includes a road map, a tool kit. 00:07:09
And in the end, it's a general plan appendix, it's a, it's a document that we can go back to and rely on. 00:07:15
To help guide decisions. 00:07:19
In the future. 00:07:22
And as part of that, there's five overall strategies that I'll briefly review, 16 objectives and then 35 actions. This is meant to 00:07:23
be a 10 year plan. So it gives us these actions that that we can do on our team as well as the council and another staff members 00:07:28
can do over these 10 years. 00:07:33
And then it's meant to be revisited and then kind of realign where where we need to be. 00:07:38
Well, the document isn't, it isn't land use regulation, so it doesn't, you know, pass any new laws or ordinances or anything like 00:07:42
that. 00:07:45
And it's just kind of that, like I said. 00:07:48
Road map or toolkit to help us? 00:07:50
So briefly, I'll go over these strategies that there are five of them. The first one is to create a vineyard healthcare and 00:07:53
innovation district through placemaking, infrastructure, branding and partnerships. 00:07:58
This is really brought on when Huntsman Cancer Institute announced that they were. 00:08:02
Don't relocating here in Vineyard. 00:08:06
Our consultants thought that that would be the a really good partnership. 00:08:07
To bring them on and create some sort of brand for that whole area of how we can try and attract other retailers through this 00:08:11
specific placemaking. 00:08:15
The second one is improved multimodal access, mobility and connectivity to downtown Vineyard to accommodate the demands of a 00:08:19
growing and vibrant city. 00:08:23
The action steps in here include things like. 00:08:26
Getting rid of the rail spur line. Working with UTA to improve transit. 00:08:28
Working with you not to to improve vehicular access. 00:08:32
Umm #3. 00:08:35
Support residents. 00:08:38
Vineyard residents and future workforce by ensuring a diversity of housing to meet their. 00:08:39
Growing in diverse needs. 00:08:43
This doesn't at all call for increased density or anything like that. A lot of it has to do with how we brand that, that we are a 00:08:45
city that that you can be born into, that you can have your first apartment, your first condo, townhome. 00:08:50
House, you know, whatever it may be. 00:08:55
And really brand that as our community. 00:08:57
#4 is enhancing capitalize on lake access and vineyards location to provide a unique regional attraction to local residents in 00:09:00
many. 00:09:04
And residents and visitors and this one, those action steps are going to be things like implement steps of the lakefront master 00:09:08
plan that we've completed. 00:09:12
As well as work with the council in the community on finding. 00:09:17
Businesses that we think would do really well on the lakefront and really reserve that kind of lakefront access for these 00:09:20
businesses that would really. 00:09:23
Do well on the lake and. 00:09:27
Enhance the beauty of the lake in return. 00:09:28
And then the last one is established. Vineyard is a premier retail destination that sports local entrepreneurs as well as regional 00:09:31
national brands. Right here I just have a list of of some of these big anchors that that we have brought to the community. 00:09:37
And the action steps here help us work with our land owners that have commercial property to. 00:09:42
Find what these anchors are for a community and bring them here. 00:09:48

I do would like to present some concerns that I have of the July 9th and the 23rd City Council meetings. 00:12:41
Regarding the community fishery of the Penny Springs Park. 00:12:48
Beginning at minute mark 36. 00:12:54

Our director here. 00:12:59
Said that we have partnered with the Division of the Wildlife, the DWR, to bring in sport fishing. 00:13:01
So our local anglers can take advantage of that. 00:13:08
And I was surprised that there was no discussion about it other than Sarah Cameron asking if there would be someone who could get 00:13:11
the fish for them. 00:13:15
My questions are these. 00:13:21
What is the cost associated with this amenity? 00:13:23
Who will clean the fist? 00:13:27
Training station every day. 00:13:29
Snakes are attracted to fish, ducks and heads. 00:13:31
So that is a problem. 00:13:35
Who will operate the fish feeder and make sure that the pond is aerated? 00:13:37
What will be the limit on fish caught? 00:13:43
Who will check for fishing licenses? 00:13:47
Will this be a year round operation? 00:13:50
Who will clean up the grounds around the pond, taking up lures, worm containers, other trash? 00:13:53
Who will make sure that children or others do not fall into the pond? 00:14:00
What kind of insurance will the city need to protect against? 00:14:04
Accidental injury or negligence. 00:14:08
As it was also a consent item on 7.1 of the July 23rd. 00:14:12
City Council meeting. 00:14:17
It was an approval for the July 20. 00:14:18

If there is an emergency and Linden is restricting the flow. 00:16:27
How will we get the water? 00:16:32
How will Vineyard determine the flow? 00:16:35
We need from vineyard and not exceed. 00:16:37

Until the last couple of days to find out what my lie was. 00:19:53
But the lie was apparently that we were never going to build a $35 million City Hall. 00:19:58
So my question is if we were never going to build a $35 million City Hall? 00:20:03
Why did we go for bond parameter of $35 million? 00:20:08
If I wanted to build something for $20 million. 00:20:12
I would go. 00:20:15
Or bond parameter of $20 million. 00:20:16
And I probably wouldn't make the people around me so angry. 00:20:19

When we bond for something, you are telling me, the taxpayer. 00:20:58
That and that gentleman from the bonding company left and said. 00:21:02
I'm ready to go sell. 00:21:06
Your $35 million bonds. 00:21:08
So to me that tells me as a taxpayer. 00:21:11
That our city, whether it's my property tax or my sales tax. 00:21:15
Our city is going to be bound to that. 00:21:18
And then to be called a liar. 00:21:21

For the entire city to hear is not. 00:21:25
Fair and I thought the code of conduct. 00:21:27
Went both ways. 00:21:31
I am expected to adhere by a certain. 00:21:34
Standards when I come up here to speak and I expect. 00:21:37

And I don't have this whole story and I don't know who does. 00:21:53
But a lot of information has come out in the last two days about the. 00:21:57

And I would say that maybe we need to amend our. 00:22:08

I'm going to go through the timeline of the request, the response of what was requested, what was provided, how did the city 01:22:28

The status of the responsive records presently and then. 01:22:35
There is an appeal process within the statute within grandma. 01:22:39
And uh. 01:22:43
I just want to highlight the. 01:22:44
That appeals process what it is and. 01:22:46
And what we have to do to respect that process and those rights. 01:22:49
So in terms of roles and responsibilities, these are the primary actors when we. 01:22:53
Talk about a grammar request and who reviews it. 01:22:58
There is a requester. In this case it's a Mr. Jensen. 01:23:02
There's the records officer. In our city, we have two records officers. It's the city recorder and the deputy city recorder. 01:23:06
That ends up being Pam Spencer and Tony Lara. 01:23:12
The individual who has the. 01:23:15
Response The records that are responsive to the request. 01:23:18
This can vary request by request, but on this particular request it's council member Holdaway. 01:23:21
The chief administrative officer in the city is Eric Ellis. 01:23:27
That's the person that. 01:23:30
Here's an administrative appeal of a grandma denial. 01:23:32
And then there's the state records on both women. 01:23:36
Her name is Monica Minaya. 01:23:40
To go through quickly kind of the. 01:23:43
The requester makes grandma requests. 01:23:45
The requester defines the format in which they would like the rooster. 01:23:48
The requested records to be provided. 01:23:52
And in this case, they've requested the records in the original format. 01:23:56
The Records officer has the role of. 01:24:00
Responding to grammar requests. 01:24:03
So they. 01:24:06
Organize the gathering of the responsive records. 01:24:07
And then they have the statutory duty to review the records once they're gathered. 01:24:11
Classify the records and then in those circumstances where you have to redact. 01:24:16
The portions of records that are classified as private protected. 01:24:21

That they would make those types of redactions. 01:24:28
And they make the initial determination on. 01:24:31
What records are responsive and then what records? 01:24:34

The individual city officer or employee who has the records is responsible for. 01:24:38
Helping to gather those records and then provide them to the records officer. 01:24:46
And the records officer always asked for those records in the format of the request. 01:24:50
In this case, the request was to get the records in the original format. 01:24:55
And then again, if there's an appeal, it would be to the chief. 01:25:00

There is a State Records office and within the State Records office the State Records Ombudsman. 01:25:04
Her rules by statute are threefold. 01:25:11
A sheep can be a resource to requestors and a request. 01:25:14
Resource to those who are responding to a request. 01:25:18
When there's an appeal of. 01:25:22
A final administrative decision, meaning. 01:25:24
There's been an appeal to the chief administrative officer within the city. 01:25:26
To It used to be the state records committee. It just recently changed to a state. 01:25:31
Records Hearing Officer. 01:25:35
So if there is an appeal to the hearing officer there. 01:25:38
Between before that appeal is heard, there's a mediation process that's offered in the ombudsman. 01:25:41
Overseas that mediation process. 01:25:47
There is. 01:25:50
A language in the statute that prohibits the. 01:25:51
State records ombudsman from going on record or testifying. 01:25:54
For or against somebody that she either provides advice to or. 01:25:59
A mediation that she conducts. So her role is limited a little bit again. 01:26:04
That she provides that guidance and that advice. 01:26:09
She provides that mediation services, but she's not someone who. 01:26:12
Take sides or call shots, so to speak. 01:26:17

What is its process for gathering and reviewing records so? 01:26:25
When the city recorder received a record request. 01:26:29
What she does is works with the requester to clarify the request and to clarify the search parameters that she'll follow. 01:26:32
Sometimes she will get requests that are either really broad, really detailed. 01:26:39
And might follow up with the requester to say if we search these databases or these e-mail addresses. 01:26:44
Using these search terms will that satisfy your request. 01:26:51
And work with the requester to identify what those are and then to conduct the search in that way. 01:26:55
C then will work to pull the records if she has direct access to the records. 01:27:01
If she doesn't have direct access to the records, then she'll ask. 01:27:06
4 copies of the records from whoever it is. 01:27:11
That has those records. 01:27:14
So an example. 01:27:16
Some city employees may have cell phones. 01:27:17
Or use personal phones to conduct city business. 01:27:20
Text messages are not stored on a. 01:27:24
Central database and so if you had a records request that was for a text message. 01:27:26
Pam would have to go to the individual that has that device. 01:27:31
Work to search their messages and then to take screenshots and gather the records from that source. 01:27:35
Sometimes a similar thing will happen with emails or e-mail records. 01:27:41
Or with other records that might be located on an individual device, not a central location or file. 01:27:44
To which she can access it directly. 01:27:51
When the records officer gets request. 01:27:54
That relate to controversial or notable topics. 01:27:57
The city's practice for at least the entire time that I've been the city attorney and I think before that. 01:28:01
Even is for searches to be witnessed or observed. 01:28:06
What this means is. 01:28:10
The records officer will ask the person gathering the records to have somebody sit with. 01:28:12
And to conduct those searches. So we have in the past, for example. 01:28:18

Records in the mayor's e-mail. 01:28:24
Or the mayor's text messages. And so we would have. 01:28:26
Either an administrative assistant or the city reporter, whoever was available. 01:28:29
Sit with the mayor. 01:28:34
And conduct that search so that. 01:28:36
If we're questioned about it, we have not just the mayor who can answer and say I did a search, but somebody else who can say. 01:28:38
I observed and I witnessed. 01:28:45
That search there the. 01:28:46
Records Officer uses her discretion to determine what our. 01:28:50
Those controversial or notable topics for which. 01:28:54
You want to have somebody else there? 01:28:58

That's proven a good and a useful practice, and when we've had things going uphill to the records committee, we've been able to 01:29:01

And state with certainty with two witnesses that it's been a full. 01:29:09

By law and as such, she has the statutory responsibility for revealing. 01:29:19

So here I put together a little timeline of events. This again, is a summary. It's not intended to be comprehensive, it's just 01:30:22

So May 30th was when the grammar request was received on the same day. 01:30:39
The city Recorder's Office forwarded the request to Councilmember Holloway. 01:30:44
With the request that he gathered the responsive records that are in his possession. 01:30:49
On June 10th. 01:30:54
The city recorder sent a reminder e-mail the council member Holdaway asking him to provide those responsive records. 01:30:56
On June 11th, Council Member Holdaway sent a PDF with some of the responsive records. 01:31:02
And the City of Recorder began her review. 01:31:08
The deadline for the response is 10 business days from the date the request is received. 01:31:11
10 business days from May 30th. 01:31:16
Ended up being June 13th. 01:31:19
On the calendar. 01:31:21
Because that was the deadline. 01:31:23
There's an option to extend if needed, and so the city recorder. 01:31:25
Sent an e-mail to the requester. 01:31:29
Indicating. 01:31:32
That the city would need an extension on that time. 01:31:34
On June 18th. 01:31:37
Pam Spencer requested records. 01:31:39
In the original. 01:31:41
Original format from Councilmember Holloway. 01:31:42
He had provided some records and she had questions about whether. 01:31:45
Those records had been. 01:31:51
Compiled or modified in their format. 01:31:52
And Council member Holdaway clarified that one of the things he. 01:31:55

And that's what he had provided to the report. 01:32:02
Quarter and so it had appeared in that presentation like there was some. 01:32:05

Employees have come forward to let me know. 01:40:41
That they have been told or in meetings. 01:40:44
Where they have confirmed that those fake accounts were from upper letter leadership within Vineyard City. 01:40:48
I do not have any proof of that. 01:40:55
I have stayed quiet over the last three or four days. 01:40:58
When this happened over a year ago. 01:41:02
It was terrifying. 01:41:05
I didn't know who they were. 01:41:07
They were talking about coming in through the entrance of my home with my young daughters. 01:41:09
In the grammar request, you can see that I reach out to the Attorney General about it. 01:41:15
He advises me that it's not illegal to view. 01:41:20
My home from the street. 01:41:24
And that there's nothing illegal about it. 01:41:27

Major of our leadership, I turned over everything to Leah Larson, an independent person, to be able to investigate who these 01:41:41

There's no emails being sent and I was very clear that you didn't turn over any. 01:41:56

I didn't realize this at the time. 01:44:29
So looking for the text message. 01:44:31
And I went through every single one of my Facebook accounts where each one of them. 01:44:34
Within a 48 hour period of those interviews were deleted. 01:44:38
It's a great piece of evidence and I contacted Zoom. 01:44:42
Zoom has an automatic delete feature after 30 days. 01:44:45
So when it's recorded it's saved in the cloud and then it auto deletes. 01:44:49
I have a text message of reaching back out to Leah saying when you, when I sent you that recording, did you ever download it? She 01:44:55
never downloaded it. She just looked at it and sent it to the to the New York Times body. 01:45:01
That's why they knew I was credible. 01:45:06
Is because they were able to see every single thing of how those accounts moved when they targeted my family. 01:45:09
