| OK. | 00:00:02 | |
| All right, today is August 13th. | 00:00:07 | |
| 2025 and the time is 601. | 00:00:09 | |
| We're going to go ahead and I'll call our City Council meeting to order. | 00:00:12 | |
| We're going to start out with an invocation and the Pledge of Allegiance given by. | 00:00:17 | |
| City Council member. | 00:00:21 | |
| And then we'll proceed with our agenda. | 00:00:22 | |
| My Father in heaven, we're grateful that we can all be here this evening to. | 00:00:34 | |
| Discuss the business of the city. | 00:00:38 | |
| We ask that we can. | 00:00:40 | |
| Accomplish the. | 00:00:42 | |
| The things that that would have us accomplished that we can. | 00:00:43 | |
| Be mindful of each other in this we pray in the name of Jesus Christ, Amen. | 00:00:46 | |
| All right. | 00:00:52 | |
| I pledge allegiance. | 00:00:57 | |
| In the United States of America. | 00:00:59 | |
| And to the Republic for which it stands. | 00:01:02 | |
| One Nation. | 00:01:04 | |
| Under God. | 00:01:05 | |
| Indivisible with liberty and justice for all. | 00:01:07 | |
| All right. We're going to go ahead and start out with some presentations and the first one will be delivered by our Deputy Chief | 00:01:10 | |
| Rockwell. | 00:01:16 | |
| Who is going to present? | 00:01:21 | |
| Our Sergeant. | 00:01:23 | |
| Come on. | 00:01:25 | |
| All right. | 00:01:38 | |
| We recently we had a change in our in our sergeants here in Vineyard. | 00:01:39 | |
| Most of you remember Sergeant Greg Sherwood. He served with us here in Vineyard for. | 00:01:42 | |
| Three years and I just wanted to take a minute just to thank him for his service. | 00:01:46 | |
| The vineyard and talk a little bit about things he was able to accomplish while he was here. | 00:01:50 | |
| When we when he first came on, it was right after we had. | 00:01:54 | |
| My position changed to Lieutenant, so he was the lone Sergeant here in the city. | 00:01:57 | |
| And that's a unique position because normally a Sergeant is out with his guys are out and off when these guys are off. | 00:02:02 | |
| But when you got, when he's, when you supervise guys seven days a week, 24. | 00:02:08 | |
| Hours a day. | 00:02:11 | |
| That's not always. That's not the case, though. He had a big burden of supervising all the guys. | 00:02:13 | |
| And work in a kind of a crazy schedule for a while. | 00:02:17 | |
| And we always get a bunch of our. | 00:02:20 | |
| There are newer deputies and Greg has done a great job or did a great job. He'll continue to do so of mentoring the new guys. | 00:02:22 | |
| Helping them learn, you know what, the way we do the business of the county and in Vineyard and just helping them learn how to | 00:02:29 | |
| investigate cases and do. | 00:02:32 | |
| Good works for the for the residents here and throughout the county. | 00:02:36 | |
| He's just such a great asset to the Sheriff's Office. I mean, he's been with us. | 00:02:41 | |
| 1314 years. | 00:02:45 | |
| Close to 14 years at the county and he served before that with Spanish Fork. | 00:02:46 | |
| But just a great asset and just a great person. I just wanted to thank him. | 00:02:51 | |
| For all the work he did in Vineyard, he's now going to be serving as a one of our sergeants on our county patrol teams. So. | 00:02:55 | |
| Thank you, Greg. | 00:03:01 | |
| So. | 00:03:06 | |
| Thank you. | 00:03:12 | |
| To fill those big shoes. | 00:03:14 | |
| Is Sergeant Austin Edwards. | 00:03:16 | |
| He's been at the county now for six years. | 00:03:18 | |
| Been a Sergeant for three of those. | 00:03:21 | |
| Before that, he worked for Pleasant Grove City. | 00:03:23 | |
| Police Department for 13 years, so he has a wide range of. | 00:03:25 | |
| Wide range of skills and and. | 00:03:29 | |
| Experience and knowledge. He's also one of our team leaders on our SWAT team at the county right now. | 00:03:33 | |
| So he brings that element into the city for us and some of those those tactical mindset for us, which is going to be awesome. And | 00:03:38 | |
| he has some big shoes to fill, fill in for Greg. | 00:03:43 | |
| But we're very excited to have him. | 00:03:47 | |
| And excited to see what he can do with the team and motivate them and help them continue the work that we've been doing here in | 00:03:49 | |
| Vineyard. And we just like to introduce him and. | 00:03:53 | |
| And thank him for coming on. | 00:03:57 | |
| So thank you so much, we're going to stand up and chat for you too. | 00:03:58 | |
| Anyway, we're just grateful for both of them. They're both awesome. Yeah. Thank you so much. Thank you for serving and being with | 00:04:02 | |
| us, and thank you for joining our team. Yes, please give a speech. | 00:04:10 | |
| It was fun to come back. | 00:04:19 | |
| To a smaller city. I worked with cities before. | 00:04:21 | |
| And Vineyard is a small, tight knit community. And it was. | 00:04:25 | |
| Nice to get to know a lot of the staff here and the council and the mayor and. | 00:04:28 | |
| It was good to have that. | 00:04:33 | |
| You know, technic, community and. | 00:04:34 | |
| Be a part of that again, and you're close to the calls. You're right on top of things. | 00:04:36 | |
| It was fun to serve and to be here with you, so thanks for that opportunity. | 00:04:41 | |
| Yeah. Thank you so much for being here and. | 00:04:45 | |
| We're gonna miss you so. | 00:04:49 | |
| But we're glad to stand here serving in the county. | 00:04:50 | |
| Appreciate it. | 00:04:53 | |
| That brings us. | 00:04:58 | |
| Right through our economic. | 00:04:59 | |
| Development strategic plan update. | 00:05:00 | |
| And Cash Fancy is here to give that presentation. | 00:05:03 | |
| Thank you, Mayor Council. | 00:05:08 | |
| I just have a brief presentation for an update on where we're at with the economic development. | 00:05:11 | |
| Strategic plan. | 00:05:15 | |
| We're hoping that I'll be back here in just a few weeks seeking approval of the document. | 00:05:16 | |
| But I just kind of want to let all of you know where we're at in it. I also sent a copy of. | 00:05:21 | |
| Of the actual. | 00:05:25 | |
| Document to all of you today. | 00:05:28 | |
| And I'm totally open. If anybody wants to meet and then go over that, I'm more than happy to. | 00:05:30 | |
| To do that. | 00:05:34 | |
| So there we go. | 00:05:36 | |
| If my presentation will work. | 00:05:43 | |
| There we go. So one of the aspects of the plan that I really like at the beginning is they include this quote that says to | 00:05:45 | |
| effectively implement a strategy, it's important to say no to certain opportunities and is. | 00:05:50 | |
| As it is to say yes to others. So I have some images here of something of what what placemaking economic development can bring to | 00:05:56 | |
| a community. | 00:06:00 | |
| And then, you know, I have some examples here in Utah also what economic development can bring to a community. And so, you know, | 00:06:04 | |
| I, I just want to use these types of images as we consider. | 00:06:09 | |
| What? What does the economic development of our city look like in the future? | 00:06:13 | |
| So the document itself, it's roughly over 60 pages, most of that is going to be data collection that Leland consultants. | 00:06:18 | |
| Firm did for us and I just included some here that I thought was interesting talking about. | 00:06:25 | |
| Our existing kind of jobs that we have in the city as well as the unmet demand, umm. | 00:06:30 | |
| In Vineyard, so you can see you there, right, the very top, we have a really big demand for a grocery store. | 00:06:35 | |
| We know that from the residents, but also the the data's telling us that too. And hopefully in a few months here we'll be able to | 00:06:40 | |
| meet a lot of that that demand. | 00:06:44 | |
| And so this data provides some framework about what we can do in the community development department to. | 00:06:48 | |
| Help bring in these retailers or these. | 00:06:54 | |
| Commercial businesses to the city. | 00:06:57 | |
| To help us out. | 00:06:59 | |
| OK, so the the meat of the the. | 00:07:02 | |
| Economic Development Strategic Plan, or EDSP for short. | 00:07:06 | |
| Is really the implementation plan, and what that is is it includes a road map, a tool kit. | 00:07:09 | |
| And in the end, it's a general plan appendix, it's a, it's a document that we can go back to and rely on. | 00:07:15 | |
| To help guide decisions. | 00:07:19 | |
| In the future. | 00:07:22 | |
| And as part of that, there's five overall strategies that I'll briefly review, 16 objectives and then 35 actions. This is meant to | 00:07:23 | |
| be a 10 year plan. So it gives us these actions that that we can do on our team as well as the council and another staff members | 00:07:28 | |
| can do over these 10 years. | 00:07:33 | |
| And then it's meant to be revisited and then kind of realign where where we need to be. | 00:07:38 | |
| Well, the document isn't, it isn't land use regulation, so it doesn't, you know, pass any new laws or ordinances or anything like | 00:07:42 | |
| that. | 00:07:45 | |
| And it's just kind of that, like I said. | 00:07:48 | |
| Road map or toolkit to help us? | 00:07:50 | |
| So briefly, I'll go over these strategies that there are five of them. The first one is to create a vineyard healthcare and | 00:07:53 | |
| innovation district through placemaking, infrastructure, branding and partnerships. | 00:07:58 | |
| This is really brought on when Huntsman Cancer Institute announced that they were. | 00:08:02 | |
| Don't relocating here in Vineyard. | 00:08:06 | |
| Our consultants thought that that would be the a really good partnership. | 00:08:07 | |
| To bring them on and create some sort of brand for that whole area of how we can try and attract other retailers through this | 00:08:11 | |
| specific placemaking. | 00:08:15 | |
| The second one is improved multimodal access, mobility and connectivity to downtown Vineyard to accommodate the demands of a | 00:08:19 | |
| growing and vibrant city. | 00:08:23 | |
| The action steps in here include things like. | 00:08:26 | |
| Getting rid of the rail spur line. Working with UTA to improve transit. | 00:08:28 | |
| Working with you not to to improve vehicular access. | 00:08:32 | |
| Umm #3. | 00:08:35 | |
| Support residents. | 00:08:38 | |
| Vineyard residents and future workforce by ensuring a diversity of housing to meet their. | 00:08:39 | |
| Growing in diverse needs. | 00:08:43 | |
| This doesn't at all call for increased density or anything like that. A lot of it has to do with how we brand that, that we are a | 00:08:45 | |
| city that that you can be born into, that you can have your first apartment, your first condo, townhome. | 00:08:50 | |
| House, you know, whatever it may be. | 00:08:55 | |
| And really brand that as our community. | 00:08:57 | |
| #4 is enhancing capitalize on lake access and vineyards location to provide a unique regional attraction to local residents in | 00:09:00 | |
| many. | 00:09:04 | |
| And residents and visitors and this one, those action steps are going to be things like implement steps of the lakefront master | 00:09:08 | |
| plan that we've completed. | 00:09:12 | |
| As well as work with the council in the community on finding. | 00:09:17 | |
| Businesses that we think would do really well on the lakefront and really reserve that kind of lakefront access for these | 00:09:20 | |
| businesses that would really. | 00:09:23 | |
| Do well on the lake and. | 00:09:27 | |
| Enhance the beauty of the lake in return. | 00:09:28 | |
| And then the last one is established. Vineyard is a premier retail destination that sports local entrepreneurs as well as regional | 00:09:31 | |
| national brands. Right here I just have a list of of some of these big anchors that that we have brought to the community. | 00:09:37 | |
| And the action steps here help us work with our land owners that have commercial property to. | 00:09:42 | |
| Find what these anchors are for a community and bring them here. | 00:09:48 | |
| So with that, that's all I have. So I look forward to working with each of you, each one of you and if you have comments on the. | 00:09:51 | |
| Actual. | 00:09:58 | |
| Plan. I'd be happy to take over those with you. | 00:09:59 | |
| Yeah, that's wonderful. We'll see that's coming up in a future council meeting, so. | 00:10:01 | |
| If you have. | 00:10:05 | |
| Time to make an appointment with Cash and sit down and really thoroughly go through the plan that will really help us. | 00:10:08 | |
| As we prepare it and bring it to the public. | 00:10:15 | |
| Tremendous job. They've taken this through the process. So I think he's been working on us for about a year and a half now. | 00:10:21 | |
| It's been a while, but. | 00:10:29 | |
| As part of this is it'll be going to Planning Commission and it'll there'll be a work session in the public hearing there. | 00:10:30 | |
| Process from here is going to be fairly quick, so we would. | 00:10:37 | |
| I think cash is. | 00:10:41 | |
| Provided invitations to meet and he's met with some of you if you do have the time. | 00:10:42 | |
| Please meet with them, this is a very important future of the city. | 00:10:46 | |
| And then we'll be back before you, probably. | 00:10:50 | |
| October time frame. | 00:10:53 | |
| Thank you. Thank you so much. Thanks. | 00:10:55 | |
| Your work on that as well. | 00:10:57 | |
| All right, the AI governance policy has been posted. | 00:10:59 | |
| There's some stuff that still has to be worked on so that moves us right into public comments. | 00:11:02 | |
| If you have. | 00:11:07 | |
| If you're wanting to make a public comment. | 00:11:09 | |
| Please come up to the podium, state your name and where you're from. | 00:11:11 | |
| And also if you could raise your hand to let me know if you're going to make a public comment. | 00:11:14 | |
| So I've got. | 00:11:21 | |
| So far. | 00:11:22 | |
| All right, come on up and. | 00:11:24 | |
| We welcome your comments. | 00:11:27 | |
| Good evening. | 00:11:33 | |
| Daria Evans Villas resident. | 00:11:35 | |
| First off, thank you for letting me. | 00:11:38 | |
| Have this opportunity to. | 00:11:40 | |
| Share a few comments and. | 00:11:42 | |
| Questions. First off, I'd like to thank Brett. | 00:11:44 | |
| Clausen for giving me the 2 letters from you regarding the removal of political signage. | 00:11:47 | |
| At the overpass, I really appreciate him following through with me. | 00:11:52 | |
| On that. | 00:11:55 | |
| Also Karen Spencer for helping me get access to the meeting media. | 00:11:57 | |
| For the July 23rd City Council meeting, I had trouble accessing it and she helped me work through it. | 00:12:01 | |
| And I would also like to thank Jordan Christensen and his Utah. | 00:12:07 | |
| Trombone Collective. | 00:12:11 | |
| For their concert, they performed on August 10th in the Greenbelt at the Utah City Development. | 00:12:13 | |
| And. | 00:12:20 | |
| It was great. | 00:12:21 | |
| Some people that were here. | 00:12:22 | |
| It was it was a great opportunity. | 00:12:26 | |
| Also, I'd like to like to. | 00:12:28 | |
| Thank the Parks and Recreation. | 00:12:31 | |
| For the. | 00:12:34 | |
| Extension of the Linden Heritage Trail. | 00:12:36 | |
| I've ridden on it and it's great. | 00:12:38 | |
| I do would like to present some concerns that I have of the July 9th and the 23rd City Council meetings. | 00:12:41 | |
| Regarding the community fishery of the Penny Springs Park. | 00:12:48 | |
| Beginning at minute mark 36. | 00:12:54 | |
| .14 Mr. Ellis. | 00:12:56 | |
| Our director here. | 00:12:59 | |
| Said that we have partnered with the Division of the Wildlife, the DWR, to bring in sport fishing. | 00:13:01 | |
| So our local anglers can take advantage of that. | 00:13:08 | |
| And I was surprised that there was no discussion about it other than Sarah Cameron asking if there would be someone who could get | 00:13:11 | |
| the fish for them. | 00:13:15 | |
| My questions are these. | 00:13:21 | |
| What is the cost associated with this amenity? | 00:13:23 | |
| Who will clean the fist? | 00:13:27 | |
| Training station every day. | 00:13:29 | |
| Snakes are attracted to fish, ducks and heads. | 00:13:31 | |
| So that is a problem. | 00:13:35 | |
| Who will operate the fish feeder and make sure that the pond is aerated? | 00:13:37 | |
| What will be the limit on fish caught? | 00:13:43 | |
| Who will check for fishing licenses? | 00:13:47 | |
| Will this be a year round operation? | 00:13:50 | |
| Who will clean up the grounds around the pond, taking up lures, worm containers, other trash? | 00:13:53 | |
| Who will make sure that children or others do not fall into the pond? | 00:14:00 | |
| What kind of insurance will the city need to protect against? | 00:14:04 | |
| Accidental injury or negligence. | 00:14:08 | |
| As it was also a consent item on 7.1 of the July 23rd. | 00:14:12 | |
| City Council meeting. | 00:14:17 | |
| It was an approval for the July 20. | 00:14:18 | |
| For the July 9th minutes. | 00:14:20 | |
| No questions were asked about it then either. | 00:14:22 | |
| I believe this fishery. | 00:14:25 | |
| It's not a good use of our resources and should have an up or down vote before we move forward with it. | 00:14:27 | |
| I think these questions need to be answered also before we move. | 00:14:33 | |
| Move forward with it. | 00:14:36 | |
| Each dollar. | 00:14:38 | |
| That Vineyard spends needs to be spent appropriately. | 00:14:39 | |
| Also in the July 23rd City Council meeting. | 00:14:43 | |
| That's a minute, mark. | 00:14:47 | |
| One hour, 34 minutes. | 00:14:49 | |
| Said to pull the RFP from the agenda. | 00:14:52 | |
| About the auditor. | 00:14:55 | |
| And review it. | 00:14:57 | |
| What in a way that the Council will be able to review the RFP? | 00:14:58 | |
| And look at it. | 00:15:02 | |
| And award the bid. | 00:15:04 | |
| At minute mark one. | 00:15:06 | |
| .34 point 4/7. | 00:15:08 | |
| Decided to strike it from the agenda and this was done and the meeting was adjourned. | 00:15:11 | |
| My questions are this. | 00:15:16 | |
| Has the Council really had enough time to review this RFP? | 00:15:17 | |
| Tonight's agenda packet is 96 pages long. | 00:15:21 | |
| And 56 pages of it are dedicated to the auditor RSP. | 00:15:25 | |
| And now I have some questions about tonight's agenda that I think. | 00:15:30 | |
| Hit the answer before you consent to these items. | 00:15:34 | |
| It's about the Linden emergency water. | 00:15:39 | |
| Does this benefit the entire city? | 00:15:44 | |
| Based on the. | 00:15:48 | |
| Recently approved water master plan refers to a north and. | 00:15:51 | |
| South service area. | 00:15:55 | |
| Will this? | 00:15:58 | |
| Take care of the whole city because there's no east to West service. | 00:16:00 | |
| Agreement. | 00:16:04 | |
| How will Vineyard get water in an emergency if we're using linen water and they need to restrict the flow? | 00:16:05 | |
| How will the water qualify? | 00:16:14 | |
| Water quality be verified prior. | 00:16:16 | |
| To using Linden's water and throughout the usage period. | 00:16:19 | |
| How will Vineyard get water? | 00:16:24 | |
| If there is an emergency and Linden is restricting the flow. | 00:16:27 | |
| How will we get the water? | 00:16:32 | |
| How will Vineyard determine the flow? | 00:16:35 | |
| We need from vineyard and not exceed. | 00:16:37 | |
| The requested flow. | 00:16:40 | |
| Those are my questions for that and now. | 00:16:42 | |
| Have questions for item? | 00:16:44 | |
| 7.3. | 00:16:46 | |
| How much water has Vineyard contracted for? | 00:16:49 | |
| With a C UW CD the Central Utah Water Conservation District. | 00:16:53 | |
| How much water does Vineyard use each year? | 00:17:00 | |
| If Vineyard doesn't use all the water. | 00:17:03 | |
| Is there a financial credit? | 00:17:06 | |
| For not using it. | 00:17:07 | |
| It said in the little. | 00:17:14 | |
| Part of it it's. | 00:17:16 | |
| Talking about. | 00:17:17 | |
| Extending the life of the existing infrastructure. | 00:17:19 | |
| How will the restrictions extend that life? | 00:17:22 | |
| I don't see how that can really happen. | 00:17:26 | |
| And how will Vineyard enforce? | 00:17:29 | |
| The monitoring procedures. | 00:17:31 | |
| And is the new water tank and booster station operational? | 00:17:35 | |
| And if not, why not? | 00:17:40 | |
| And also we have had. | 00:17:44 | |
| Not much water pressure in our home. | 00:17:47 | |
| And I'm wondering. | 00:17:50 | |
| If umm. | 00:17:52 | |
| There is a concern because of that lack of water pressure. | 00:17:53 | |
| Will there be enough water pressure for Fire Protection? | 00:17:56 | |
| Or suppression. | 00:17:59 | |
| And umm, we're in an HOA and we have. | 00:18:02 | |
| You know, different. | 00:18:06 | |
| Needs and so how are we going to. | 00:18:08 | |
| Meet those requirements the city might put up. | 00:18:12 | |
| Put on. | 00:18:14 | |
| Of The Ethiopians. | 00:18:16 | |
| And also. | 00:18:17 | |
| Why have we not? | 00:18:19 | |
| Done the flip the strip. | 00:18:22 | |
| Flip the strips, it's been mentioned several years ago. | 00:18:23 | |
| And we have not. | 00:18:26 | |
| Implemented that, there was money budgeted for it. Why have we not? | 00:18:28 | |
| Acted proactively. | 00:18:31 | |
| To conserve water. | 00:18:33 | |
| And I think. | 00:18:35 | |
| Those questions should be answered. | 00:18:37 | |
| Before these items are consented to. Thank you very much, Appreciate your time. | 00:18:40 | |
| All right. Thank you. | 00:18:47 | |
| Karen Cornelia. | 00:19:02 | |
| Cornell, yes, the Villa resident. | 00:19:03 | |
| And thank you, Daria. I'll answer my questions were covered. | 00:19:05 | |
| With her. | 00:19:08 | |
| Her questions and her presentation. | 00:19:10 | |
| But I have something that's really troubling me. | 00:19:12 | |
| Care of and. | 00:19:15 | |
| Right. OK, let's go two sides of it. | 00:19:17 | |
| One is our code of conduct. | 00:19:21 | |
| And I have a question about that and another. | 00:19:24 | |
| Is I know that we. | 00:19:27 | |
| Stopped the umm. | 00:19:29 | |
| City Hall as it was presented with the. | 00:19:32 | |
| $35 million. | 00:19:35 | |
| Bond parameters. | 00:19:36 | |
| Quite some time ago. | 00:19:38 | |
| And yet there is a council member who continually. | 00:19:39 | |
| Accuses me of lying to the public. | 00:19:43 | |
| Regarding a $35 million City Hall. | 00:19:46 | |
| Now I have never been able to. | 00:19:51 | |
| Until the last couple of days to find out what my lie was. | 00:19:53 | |
| But the lie was apparently that we were never going to build a $35 million City Hall. | 00:19:58 | |
| So my question is if we were never going to build a $35 million City Hall? | 00:20:03 | |
| Why did we go for bond parameter of $35 million? | 00:20:08 | |
| If I wanted to build something for $20 million. | 00:20:12 | |
| I would go. | 00:20:15 | |
| Or bond parameter of $20 million. | 00:20:16 | |
| And I probably wouldn't make the people around me so angry. | 00:20:19 | |
| But I do not think. | 00:20:23 | |
| That it. | 00:20:25 | |
| It adheres to the code of conduct in any way, shape or form. | 00:20:27 | |
| For a council member to call a citizen. | 00:20:31 | |
| On social media, a liar. | 00:20:34 | |
| It's not fair. | 00:20:37 | |
| I simply was saying and sharing. | 00:20:39 | |
| What I had learned. | 00:20:42 | |
| In the many meetings that I went to. | 00:20:43 | |
| And the final meeting being. | 00:20:46 | |
| Where the council voted to approve a $35 million bond parameter. | 00:20:48 | |
| No one that night said, oh, but don't worry, we're not going to spend 35 million. | 00:20:53 | |
| When we bond for something, you are telling me, the taxpayer. | 00:20:58 | |
| That and that gentleman from the bonding company left and said. | 00:21:02 | |
| I'm ready to go sell. | 00:21:06 | |
| Your $35 million bonds. | 00:21:08 | |
| So to me that tells me as a taxpayer. | 00:21:11 | |
| That our city, whether it's my property tax or my sales tax. | 00:21:15 | |
| Our city is going to be bound to that. | 00:21:18 | |
| And then to be called a liar. | 00:21:21 | |
| On social media. | 00:21:23 | |
| For the entire city to hear is not. | 00:21:25 | |
| Fair and I thought the code of conduct. | 00:21:27 | |
| Went both ways. | 00:21:31 | |
| I am expected to adhere by a certain. | 00:21:34 | |
| Standards when I come up here to speak and I expect. | 00:21:37 | |
| Those standards to be adhered to by each one of you. | 00:21:40 | |
| And I don't appreciate that. | 00:21:45 | |
| And that is my concern. | 00:21:47 | |
| Another concern I have with respect to the code of conduct is. | 00:21:49 | |
| And I don't have this whole story and I don't know who does. | 00:21:53 | |
| But a lot of information has come out in the last two days about the. | 00:21:57 | |
| So-called. | 00:22:02 | |
| Fake Facebook identities. | 00:22:04 | |
| And I would say that maybe we need to amend our. | 00:22:08 | |
| Card of conduct. | 00:22:11 | |
| To say that that is not permissible either. | 00:22:13 | |
| And I would hope. | 00:22:15 | |
| That this body will get to the bottom of that. | 00:22:16 | |
| Because there is one member of the council that was literally called crazy. | 00:22:19 | |
| For assuming that that was happening. | 00:22:23 | |
| When it was happening. | 00:22:25 | |
| So that's my concern tonight. Thanks. | 00:22:27 | |
| Coming forward quick. | 00:22:49 | |
| David, Larry. | 00:22:50 | |
| I wanted to. | 00:22:51 | |
| Thank Dorothy Evans. | 00:22:54 | |
| For a list of questions, thank you very much, Daria. I appreciate the work and effort goes into keeping track of things for us, | 00:22:55 | |
| for all of us. | 00:22:58 | |
| I want to add one thing to the list that is that. | 00:23:02 | |
| It is my understanding that when the. | 00:23:04 | |
| Park Pond was first created. | 00:23:07 | |
| He was meant to be a holding pond. | 00:23:09 | |
| So that uh, uh. | 00:23:12 | |
| This water coming into the city overnight was collected there. | 00:23:13 | |
| Collected there so overnight it could be used to water. | 00:23:18 | |
| Through the secondary water system. | 00:23:21 | |
| And during the process. | 00:23:22 | |
| It would deplete the water. | 00:23:24 | |
| Quite a bit in the pond. | 00:23:26 | |
| And then throughout the day, it would rise again. | 00:23:27 | |
| If we're planning to use it as a. | 00:23:29 | |
| A fishery or whatever you want to call it, nice to fish that you're going to have. | 00:23:32 | |
| You know that may not. | 00:23:36 | |
| Close the world with a fish there. | 00:23:38 | |
| You're going to use up their water. | 00:23:39 | |
| So we probably should decide what it really is. | 00:23:41 | |
| First before we decided to put fish in it. | 00:23:44 | |
| If we could clarify that, that would be great. Thank you. | 00:23:48 | |
| Thanks. Any other comments? | 00:23:51 | |
| OK. I'm going to go ahead and close the public comments then. | 00:23:55 | |
| I think we could address a few of these tonight. | 00:23:58 | |
| Let's see. | 00:24:01 | |
| Why don't we start? | 00:24:02 | |
| With David's question. | 00:24:05 | |
| Some of these comments we won't be able to address tonight, but there are staff members that you can meet with and I think sit | 00:24:08 | |
| down and really get to the heart of these questions. | 00:24:12 | |
| If it's something that you would like to be brought back to the public at that point. | 00:24:15 | |
| We can bring that back for everybody at the next meeting so that you can see what we talked about during that time. | 00:24:20 | |
| Because there's so many questions, but I think. | 00:24:26 | |
| It would be helpful for the residents to understand. | 00:24:29 | |
| Penny Springs Pond. | 00:24:33 | |
| I would just. | 00:24:37 | |
| Start by inviting Devin up but. | 00:24:40 | |
| I wanted to mention that. | 00:24:43 | |
| When we sat down with. | 00:24:45 | |
| Division of Wildlife Resources. | 00:24:46 | |
| They just, they, they kind of walked us through. | 00:24:49 | |
| Some thresholds that would. | 00:24:52 | |
| Allow the fish to be healthy. | 00:24:54 | |
| And what I'm going to have Devin talk about is. | 00:24:57 | |
| That springs. | 00:25:01 | |
| Has a depth of. | 00:25:02 | |
| 10 feet. | 00:25:04 | |
| Or more. | 00:25:05 | |
| Division of Wildlife Resources was not concerned if it was. | 00:25:08 | |
| Getting any? | 00:25:11 | |
| Anywhere you know. | 00:25:12 | |
| Between 10 feet deep and. | 00:25:14 | |
| And three feet deep. | 00:25:16 | |
| As long as there was water there for the fish. | 00:25:18 | |
| They would, They would. | 00:25:21 | |
| The you know, plenty healthy. | 00:25:22 | |
| Their intention is to. | 00:25:26 | |
| Plant some colder water fish. | 00:25:28 | |
| Early in the spring each year. | 00:25:30 | |
| And then? | 00:25:32 | |
| For the rest of the summer, knowing that it would be a warmer. | 00:25:33 | |
| Water body just because it's. | 00:25:36 | |
| You know, not not an overly large one. | 00:25:37 | |
| They'll plan to put some warmer water fishing. | 00:25:40 | |
| In that. | 00:25:43 | |
| Location. | 00:25:45 | |
| To add. | 00:25:47 | |
| A couple of Darius questions. | 00:25:48 | |
| The fish being caught. | 00:25:51 | |
| This is this is managed by the Division of Wildlife. | 00:25:53 | |
| And so they. | 00:25:56 | |
| We use their proclamation, their fish proclamation. | 00:25:58 | |
| And the division of wildlife is the entity that manages. | 00:26:01 | |
| All wildlife in the state. | 00:26:05 | |
| In community fisheries, just as they do in. | 00:26:07 | |
| In wild settings. | 00:26:09 | |
| And so. | 00:26:11 | |
| Any of the fish. | 00:26:12 | |
| Counts for a daily. | 00:26:14 | |
| Daily Catch. | 00:26:17 | |
| Just applied to that proclamation. | 00:26:19 | |
| As far as? | 00:26:21 | |
| Who cleans up? | 00:26:22 | |
| The general area. | 00:26:24 | |
| This is This is going to be a. | 00:26:26 | |
| A feature within parks. | 00:26:28 | |
| And the park's maintenance staff. | 00:26:30 | |
| Is sure to. | 00:26:32 | |
| Pass through all of our parks and make sure that they stay tidy. | 00:26:34 | |
| They maintain the restrooms. | 00:26:37 | |
| As part of that. | 00:26:39 | |
| Regular duty they would check on the fish cleaning station that will be attached to the restroom. | 00:26:40 | |
| And be sure that that's tidy, but maybe tell us a little bit about the. | 00:26:45 | |
| Elevation of the Pi Pond from. | 00:26:49 | |
| On a day-to-day basis over the summer. | 00:26:51 | |
| Umm, so. | 00:26:53 | |
| Yeah, the. | 00:26:55 | |
| The elevation of the water in the pond. | 00:26:57 | |
| We can kind of control that. | 00:26:59 | |
| When we. | 00:27:05 | |
| Run those pumps, it draws it down. | 00:27:06 | |
| You know, 3 or 4 feet, but there's a screen that we tried to keep it above. | 00:27:09 | |
| So, umm. | 00:27:14 | |
| We really only. | 00:27:15 | |
| We still have about 3-3 and a half feet in the bottom of it. | 00:27:16 | |
| When? | 00:27:20 | |
| That the umm. | 00:27:20 | |
| Division of sorry. | 00:27:22 | |
| Yeah, the wildlife resources, they met on site with this. | 00:27:24 | |
| They looked at it. We sent them our drawings of the pond. | 00:27:27 | |
| We gave them all this information. They did the study. | 00:27:31 | |
| They feel real comfortable with it. And my understanding, Brian. | 00:27:34 | |
| Brian's been more involved. | 00:27:38 | |
| My understanding is. | 00:27:40 | |
| They're pretty much doing everything. They're planting the fish. | 00:27:41 | |
| There's really not much cost to the city, right? | 00:27:46 | |
| As far as cost of the city, the Pi pond is being enhanced. | 00:27:51 | |
| Through a through a city expenditure to improve that as a. | 00:27:55 | |
| As a Piacon. | 00:27:59 | |
| So all of that work that you're seeing being done right now was budgeted long ago, not for. | 00:28:00 | |
| Creating a community fishery per se, but rather to enhance that as a as a structure. | 00:28:05 | |
| The only element that we're adding. | 00:28:10 | |
| Fish for that community fishery. | 00:28:13 | |
| Is a habitat structure. | 00:28:16 | |
| That will be somewhere in the ballpark of $10,000. | 00:28:17 | |
| And that was we received those dollars through a grant. | 00:28:21 | |
| From. | 00:28:24 | |
| Department of Natural Resources. | 00:28:25 | |
| Watershed restoration initiative. | 00:28:27 | |
| And that's what that is, an. | 00:28:30 | |
| You know, fully a grant that's paying for that habitat structure. | 00:28:31 | |
| Any other questions? | 00:28:37 | |
| I said I. | 00:28:38 | |
| Brian's kind of Dylan. | 00:28:39 | |
| More with the. | 00:28:41 | |
| Actual uh. | 00:28:42 | |
| Fishery part of. | 00:28:43 | |
| I think there was a. | 00:28:46 | |
| Question about how it will be maintained, but then how our parts will be maintained and? | 00:28:48 | |
| It will continue to happen through our Parks and Rec. | 00:28:53 | |
| Program that we maintain it. | 00:28:55 | |
| Just like any other thing that you would find that's falling to the ground there. | 00:28:57 | |
| We have a great team that. | 00:29:01 | |
| Takes care of that. | 00:29:02 | |
| Let's see. Another thing, I think for the address. Let's see. | 00:29:05 | |
| The City Hall. | 00:29:11 | |
| So there was. | 00:29:13 | |
| Several meetings that happened on the City Hall. | 00:29:15 | |
| This particular meeting that you were discussing talked about bond parameters. | 00:29:18 | |
| Eric, I don't know if you want to address why it was for 35 million and how we. | 00:29:23 | |
| Review that and then I can. | 00:29:28 | |
| Give like a timeline or you can give a timeline of how it was voted on. | 00:29:30 | |
| Sure. So the. | 00:29:34 | |
| The general idea behind the bond parameters being set. | 00:29:36 | |
| Higher number than necessarily we intended to use. | 00:29:40 | |
| Was that? | 00:29:44 | |
| As we were entering into those conversations. | 00:29:45 | |
| We had some unknowns. | 00:29:48 | |
| And so anytime you have unknowns. | 00:29:49 | |
| In a bond scenario, you bond for. | 00:29:52 | |
| Essentially the maximum amount that it could possibly be. | 00:29:56 | |
| That was taking into consideration the fact that at the time we did not know. | 00:29:59 | |
| How much mag? | 00:30:04 | |
| To contribute as a partner. | 00:30:07 | |
| In fact, that amount could have been as little as $1,000,000. | 00:30:09 | |
| And ended up being as. | 00:30:12 | |
| Ended up being $9 million. | 00:30:14 | |
| And so we were incorporating in. | 00:30:16 | |
| The portion even that our partner was going to be. | 00:30:19 | |
| Paying the city for long term. | 00:30:22 | |
| And so we based it off of the value of the entire structure, even though it was. | 00:30:25 | |
| Known that that was going to have one or more partners. | 00:30:30 | |
| We just didn't want to have to come back later. | 00:30:33 | |
| If it was bonded for that full amount. | 00:30:36 | |
| To have to redo that. | 00:30:40 | |
| What it ended up being was. | 00:30:42 | |
| The bond was going to be more along the lines of 18 to 18 and a half million. | 00:30:44 | |
| And that was exactly what we were hoping. | 00:30:50 | |
| Would happen. You set the parameters at the maximum amount possible. | 00:30:53 | |
| You know, based on the value of the entire structure. | 00:30:57 | |
| And then you. | 00:31:01 | |
| You work over the coming months as you go through that. | 00:31:02 | |
| Cost evaluation and partnership. | 00:31:05 | |
| Contributions uh. | 00:31:07 | |
| To get that number as low as possible. | 00:31:09 | |
| Even the 18 and a half million was. | 00:31:11 | |
| A combination of the cities. | 00:31:14 | |
| Burden and our partner burden. | 00:31:15 | |
| Combined SO. | 00:31:19 | |
| So the city's burden was going to be closer to 15. | 00:31:21 | |
| One of the things that I think wasn't mentioned. | 00:31:25 | |
| But I'll clarify. | 00:31:27 | |
| Is while the bond was discussed, the lower cost was also discussed at the time. | 00:31:30 | |
| What was changed? | 00:31:36 | |
| When the bond parameters were put in, was a stipulation to say. | 00:31:38 | |
| While we're going to allow for the bond parameters to be. | 00:31:42 | |
| And somewhat approved. | 00:31:46 | |
| So that's a. | 00:31:48 | |
| Work of education can start. | 00:31:48 | |
| So the resolution. | 00:31:51 | |
| The resolution had to be approved that night. | 00:31:53 | |
| There was a stipulation vote. | 00:31:55 | |
| That said. | 00:31:57 | |
| No bonds will be sold. | 00:31:58 | |
| Until it's voted on again. | 00:32:00 | |
| So in May we held another meeting. | 00:32:02 | |
| Which was the next one, so it was stipulated upon for another vote. | 00:32:05 | |
| At that meeting. | 00:32:09 | |
| It was voted against and the reason why it was voted against this financial structure. | 00:32:10 | |
| Was so that more education could go out to the public to learn about the type of building. | 00:32:15 | |
| Because one of the unknowns that we were talking about in the first meeting that you did attend. | 00:32:20 | |
| Was that there were still some unknowns. | 00:32:25 | |
| And we wanted to put. | 00:32:27 | |
| Public to be able to understand that there was a need. | 00:32:28 | |
| But we really needed to hone in on what that design looked like. There were still some questions about where the library would be. | 00:32:31 | |
| There were questions about. | 00:32:37 | |
| Additional aspects of the structure itself. And So what we did in May was we said let's go ahead and hold on that opportunity. | 00:32:39 | |
| And so it was actually voted against during that time. | 00:32:48 | |
| Now, because there was a resolution. | 00:32:52 | |
| There were citizens that put in a referendum. | 00:32:55 | |
| However, the vote was still in. | 00:32:58 | |
| Process and so that is why the referendum ended. | 00:33:00 | |
| In May because it was voted down at that time. | 00:33:04 | |
| So what was not noted down was the building itself. | 00:33:08 | |
| Itself, that is still being observed and discussed for the needs of the community and will continue to be something that goes | 00:33:10 | |
| forward. | 00:33:14 | |
| As our city is growing. | 00:33:18 | |
| And it is something that our community needs. | 00:33:20 | |
| How it will be paid for in the future, that will be brought back to a council. | 00:33:22 | |
| At the future date and that will be decided. | 00:33:26 | |
| At that time. | 00:33:29 | |
| I hope that is helpful if. | 00:33:30 | |
| If you'd like more information, I'd be happy to have Eric schedule a meeting for you with him and. | 00:33:32 | |
| You can go over that further. | 00:33:39 | |
| Let's see, I'm going to go ahead at this point. | 00:33:41 | |
| And move on to our. | 00:33:45 | |
| Consent items. | 00:33:47 | |
| And the reason for that is so that we can discuss. | 00:33:49 | |
| Some of the other. | 00:33:52 | |
| Things that the Council would like to many of the things that were discussed. | 00:33:54 | |
| By Saria. | 00:33:59 | |
| Have to do with those things. So if anybody wants to pull anything off the consent agenda, if you if you haven't already | 00:34:02 | |
| understood or if you need more information. | 00:34:06 | |
| And please do that now and if not. | 00:34:11 | |
| If we can always make sure that information gets to Daria and then gets to the public so that you can have additional information. | 00:34:14 | |
| Information so. | 00:34:21 | |
| I was going to propose that we approve 7.1, but we. | 00:34:22 | |
| Take off 7.27 point 3. | 00:34:26 | |
| And then 7.4 needs to be plus pound. | 00:34:28 | |
| OK, so why don't you make you said you made the motion for 7.1 to be approved? | 00:34:31 | |
| I propose it so I make a motion. | 00:34:36 | |
| All right, we have a first by Marty. Can I get a second? | 00:34:39 | |
| Second. Second by Sarah. All in favor. | 00:34:42 | |
| Aye. | 00:34:45 | |
| All right, let's go ahead and just. | 00:34:47 | |
| The interlocal agreement with Linden for emergency water resolution 2025. | 00:34:49 | |
| Didn't we? | 00:34:55 | |
| Oh, that's what you said, I thought. | 00:34:56 | |
| OK. | 00:34:58 | |
| Try to make sure I do that right. | 00:34:59 | |
| All right, go ahead, Eric. | 00:35:01 | |
| So the. | 00:35:03 | |
| Resolution for emergency water with Linden City. | 00:35:05 | |
| Is one of two emergency connections that. | 00:35:09 | |
| Vineyard will have. | 00:35:11 | |
| Rather than. | 00:35:13 | |
| Limit ourselves to just our main source coming from coming from Central UT Water Conservancy District. | 00:35:16 | |
| We are maintaining. | 00:35:21 | |
| And we passed a resolution I think just a couple weeks ago. | 00:35:23 | |
| To approve an emergency water connection. | 00:35:27 | |
| Through Orem City down at the South end of the city. | 00:35:30 | |
| This creates an emergency connection between Linden. | 00:35:33 | |
| When we met recently with Central Utah Water. | 00:35:38 | |
| One of their toes. | 00:35:40 | |
| Was that they would love to see. | 00:35:43 | |
| Northern Utah County cities connected. | 00:35:45 | |
| Through their water systems. | 00:35:48 | |
| For just such circumstances. | 00:35:50 | |
| It just provides options. | 00:35:52 | |
| When something arises. | 00:35:55 | |
| Whether that be some contamination in the central Utah line. | 00:35:57 | |
| Or some any number of circumstances that leads to a concern. | 00:36:01 | |
| This gives us an option. | 00:36:06 | |
| It can pressurize our system and. | 00:36:09 | |
| Provide water in a needed scenario. | 00:36:12 | |
| And this just. | 00:36:15 | |
| Gives us that assurity. | 00:36:17 | |
| We have multiple connections into the city. We've got a connection at 1600 N and 800 N. | 00:36:19 | |
| Down and down on the South end of the city as well. | 00:36:25 | |
| It's just. | 00:36:29 | |
| Prudent for the city to make sure that we have those options for connection. | 00:36:30 | |
| And those. | 00:36:34 | |
| A scene they can go. We could. We could. | 00:36:38 | |
| Open that valve and send water uphill too, right to Linden SO. | 00:36:41 | |
| It's just a. It's a security system for. | 00:36:44 | |
| For all parties involved. | 00:36:47 | |
| All right. | 00:36:51 | |
| Questions there were some discussion on. | 00:36:53 | |
| How much it costs, how much we contracted, how much do we use is their credit, how will there be restrictions? | 00:36:56 | |
| Boost our operations water pressure. | 00:37:02 | |
| Fire suppression. | 00:37:05 | |
| Was a long list of things. Is there any questions about any of that? Does any everybody feel like they have a good grasp on what | 00:37:06 | |
| that is or did you want to discuss it? | 00:37:10 | |
| I might need reminders on a couple of those, but. | 00:37:15 | |
| As far as the the fire pressure. | 00:37:18 | |
| We recently met with. | 00:37:21 | |
| Orem Vineyard, Linden Fire Department. | 00:37:23 | |
| And they pointed out that their fire pressure. | 00:37:26 | |
| And fire. | 00:37:30 | |
| And water capacity for? | 00:37:31 | |
| Fighting fires and vineyard. | 00:37:33 | |
| And Linden and Orem are. | 00:37:35 | |
| Are phenomenal. | 00:37:38 | |
| That they have. | 00:37:39 | |
| There's quite the supply because we're because we're on a gravity system coming from. | 00:37:40 | |
| The hills of Orem. | 00:37:45 | |
| And uphill from that with the water sources. | 00:37:47 | |
| We don't have that. They don't have any expectation that we would. | 00:37:51 | |
| Encounter a scenario where. | 00:37:55 | |
| Water pressure or water availability would be a problem for the fire system. | 00:37:57 | |
| What else do we have? Oh, the credit. | 00:38:03 | |
| As far as the cost? | 00:38:06 | |
| Vineyard is in the system with central Utah Water. That's called take and pay. | 00:38:10 | |
| And that means? | 00:38:15 | |
| That there are increments. | 00:38:17 | |
| At which we tap into. | 00:38:19 | |
| The available water. | 00:38:22 | |
| Rights that the city has. | 00:38:24 | |
| And so every year. | 00:38:26 | |
| While we're growing, there's a chance that we jump into the next. | 00:38:29 | |
| I think it's 100 acre increments. | 00:38:32 | |
| We jump into that next one and once we've tapped into once when we go from. | 00:38:36 | |
| 1800 acre feet in the year to 1900 acre feet in the year. | 00:38:40 | |
| You're now on the hook for that. | 00:38:45 | |
| Going forward. | 00:38:47 | |
| And as a growing city, that's not a huge deal because we just anticipate. | 00:38:48 | |
| You know, filling in that full 100 acre feet of use. | 00:38:52 | |
| But it's something that. | 00:38:57 | |
| Is another reason why. | 00:38:58 | |
| Central Utah is interested in. | 00:39:00 | |
| And having cities connected so that. | 00:39:02 | |
| You know, before you use that full amount or if a city adopts some water conservation practices, there's there's a chance that we | 00:39:04 | |
| could set up an arrangement where. | 00:39:08 | |
| Where we use their extra rather than taking the next 100 acre increment. | 00:39:13 | |
| And so. | 00:39:18 | |
| As we adopt. | 00:39:19 | |
| Water conservation policies. | 00:39:20 | |
| This is a great opportunity to not jump into that next. | 00:39:23 | |
| 100 acre feet. | 00:39:27 | |
| So that we can. | 00:39:29 | |
| Keep our costs as low as possible because once we once we. | 00:39:30 | |
| Breach into that next. | 00:39:33 | |
| Block of water. | 00:39:35 | |
| We're on the hook every year for using that full block of water. | 00:39:37 | |
| Might be something that we could do for the public. | 00:39:41 | |
| And for the Council? | 00:39:43 | |
| To kind of give a historical outline. | 00:39:45 | |
| Umm, aside from what you're talking about, but you mentioned conservation is to show where we have. | 00:39:48 | |
| Flip strips and then to show where it is on our priority list and why we had to. | 00:39:53 | |
| Take that funding and put it elsewhere on certain years and how we continue to move forward with that. | 00:39:58 | |
| Some of it isn't heated by different developer agreements because the easements are not necessarily turned over to us, but it's | 00:40:03 | |
| our goal to replace them. | 00:40:07 | |
| I think that would be helpful. | 00:40:11 | |
| And we also. | 00:40:13 | |
| Use We have a couple different sources of water. | 00:40:14 | |
| We do everything we can to use the Pi pawn so that we can use. | 00:40:16 | |
| Kind of keep our youth down. | 00:40:22 | |
| Throughout the summertime by using that the. | 00:40:24 | |
| Secondary water. | 00:40:26 | |
| For some of our irrigation. | 00:40:28 | |
| Anything that we can do to. | 00:40:30 | |
| Keep our overall water usage below those. | 00:40:32 | |
| Those 100 acre benchmarks is a great way to. | 00:40:35 | |
| To keep our. | 00:40:39 | |
| Reasonable. | 00:40:41 | |
| The other question that came up was our North and South service area and east to West agreements. Did you want to address any of | 00:40:42 | |
| that? | 00:40:46 | |
| You got that? | 00:40:51 | |
| We're going to let Devin. | 00:40:52 | |
| Produce. | 00:40:54 | |
| So with the North and South agreements that would kind of. | 00:40:55 | |
| Was more when we were taking water from Orem. | 00:40:59 | |
| Because we had a divider line that. | 00:41:02 | |
| Form set up to a certain point which was 400 N. | 00:41:03 | |
| And then north of that was. | 00:41:07 | |
| Water we took from central UT. | 00:41:08 | |
| July 1. | 00:41:11 | |
| Those agreements we went over to Central UT. | 00:41:13 | |
| And uh. | 00:41:15 | |
| So now central Utah's feeding. | 00:41:16 | |
| North Pole the way to South. | 00:41:18 | |
| So it's all 11 water source. | 00:41:20 | |
| But having these emergency connections. | 00:41:23 | |
| One on the South and one on the north. | 00:41:26 | |
| Can help. | 00:41:28 | |
| In situations that. | 00:41:29 | |
| Say central like they said central UT, right? | 00:41:31 | |
| Have a project where they got to shut down for a minute. | 00:41:34 | |
| It can help keep our pressures up if we need to use these emergencies. | 00:41:36 | |
| Kind of just tying back to the Linden emergency. | 00:41:42 | |
| This agreement's been in place forever, it just needed some updates. | 00:41:45 | |
| But like you said, it's it's fully intended for us in emergency sakes only I. | 00:41:51 | |
| If if we need the water. | 00:41:57 | |
| So. | 00:41:59 | |
| With other questions. | 00:42:00 | |
| As far as the pressure is concerned. | 00:42:04 | |
| We also got the water team coming up. | 00:42:06 | |
| Online, I'll be in my report. | 00:42:08 | |
| But the water thing should be online. | 00:42:10 | |
| I forget what the date is, just like it went to my report. They're just doing the final testing on. | 00:42:13 | |
| Leak detection. | 00:42:19 | |
| And as soon as they got that, it was a week. | 00:42:21 | |
| Before the Department of. | 00:42:24 | |
| Our division of water. | 00:42:26 | |
| Stripes of water with resources. | 00:42:28 | |
| Council get the final approval and then we're using that tank. | 00:42:30 | |
| And that having our water tank online. | 00:42:35 | |
| Will also help create that. | 00:42:37 | |
| Stable pressure throughout the city. | 00:42:40 | |
| Because we'll have that store there when we lose the station attached to it. | 00:42:43 | |
| And we should experience more, less. | 00:42:46 | |
| And and real quick. As far as pressure goes, the state requires. | 00:42:51 | |
| 20PSI at all time for. | 00:42:56 | |
| For fire emergencies. | 00:42:58 | |
| We're well above that. We do have pressure monitoring stations. | 00:43:00 | |
| Throughout the city, that alarms us A. | 00:43:03 | |
| We do go. I have them set at the. | 00:43:06 | |
| 50PSI to alarm me so. | 00:43:08 | |
| The only time we've hit that is during a couple. | 00:43:11 | |
| New development. They do fire flow tests for their sprinkling systems. | 00:43:15 | |
| But we're still, we're still staying way above that. | 00:43:19 | |
| 20PSI. | 00:43:22 | |
| OK. And then I know there was a question we have. | 00:43:24 | |
| This year we have contracted. | 00:43:28 | |
| 2538 acre feet through central UT. | 00:43:30 | |
| Awesome. Thank you. | 00:43:36 | |
| Council, do you have any more questions? | 00:43:37 | |
| About this in particular. | 00:43:39 | |
| I can make a motion to approve. | 00:43:44 | |
| Item 7.2. | 00:43:47 | |
| Right, I have a first by Marty. Can I get a second? | 00:43:48 | |
| Actually do have one. One other thing. It's not so much a. | 00:43:51 | |
| Question. | 00:43:54 | |
| But based on some of the questions, I think it would be. | 00:43:55 | |
| Beneficial for the public if we had. | 00:43:58 | |
| A presentation put together, it would. | 00:44:01 | |
| Also help visualize some of our usage and how it's changed as we've grown. | 00:44:04 | |
| It's a great idea. | 00:44:08 | |
| I think that would be helpful. | 00:44:09 | |
| Because Eric explains some stuff about. | 00:44:11 | |
| Water usage and how if you say. | 00:44:13 | |
| Within a certain range. | 00:44:15 | |
| It saves the city quite a bit of money, which is why we're doing that. | 00:44:17 | |
| Alternate watering schedule. So I think that would be really helpful for the. | 00:44:20 | |
| Citizens, you know. | 00:44:23 | |
| And understand. | 00:44:24 | |
| Well, and maybe in the same presentation we can talk about our different partners and why we have to make contracts between other | 00:44:26 | |
| cities for emergency purposes, but what our stability is how much we use. | 00:44:31 | |
| It's great idea. | 00:44:36 | |
| Thank you. | 00:44:37 | |
| OK, so I have a first by Marty. | 00:44:38 | |
| So I need a second. | 00:44:43 | |
| Thank you, Sarah. | 00:44:44 | |
| Any other discussion? | 00:44:46 | |
| If not, I need a motion. | 00:44:49 | |
| I mean all in favor. | 00:44:50 | |
| Aye. | 00:44:52 | |
| No. | 00:44:55 | |
| Jake, are you opposed? | 00:44:56 | |
| All right, that goes to the. | 00:45:00 | |
| For Water Use and Conservation practices, Ordinance 2025-14 and that's 7.3. | 00:45:02 | |
| Who is presenting that? | 00:45:13 | |
| OK, the last one. | 00:45:16 | |
| So for 7.0 we need a roll call. Marty did the first third of the second. | 00:45:18 | |
| We'll go ahead and start with Jake. | 00:45:22 | |
| On approving this. | 00:45:25 | |
| No bread. | 00:45:27 | |
| Hi, I'm Marty. | 00:45:29 | |
| Yes, Sarah, hi. | 00:45:31 | |
| All right, 7.3. | 00:45:33 | |
| All righty so. | 00:45:42 | |
| A little background. | 00:45:45 | |
| Kind of why we're. | 00:45:47 | |
| Looking into doing this watering schedule is. | 00:45:48 | |
| Well, you probably know that Utah is the second driest. | 00:45:51 | |
| Nation or state In the nation, average is only about 13. | 00:45:54 | |
| Into the participant. | 00:45:58 | |
| Precipitation. | 00:46:00 | |
| July 4th this year. | 00:46:02 | |
| The state announced that it was the only state. | 00:46:05 | |
| Statewide in a drought situation. | 00:46:09 | |
| Over about 60% of our. | 00:46:12 | |
| Water that we city Jews are. | 00:46:15 | |
| Outdoor usage. | 00:46:18 | |
| I did a little rough estimate and I think vineyards pushed a little closer to 70. | 00:46:21 | |
| From our. | 00:46:26 | |
| From our non landscape. | 00:46:28 | |
| Months to when we do landscape. | 00:46:31 | |
| We're about 70% more usage. | 00:46:34 | |
| Umm, you know, season, droughts, climate, umm, growing population, all this stuff. Kind of. | 00:46:38 | |
| Contributes. | 00:46:44 | |
| The state has gave guidelines. | 00:46:45 | |
| The Utah Division of Water Resources and the Slow the Flow program. | 00:46:48 | |
| So they've come out with this, they they see the. | 00:46:53 | |
| The real urge and need of. | 00:46:56 | |
| Water conservation. | 00:46:59 | |
| So. | 00:47:01 | |
| Water conservation reduces excessive outdoor. | 00:47:06 | |
| Water use helping extend water supply during drought years. | 00:47:09 | |
| It encourages residents to. | 00:47:14 | |
| Water lawns only when needed based on the weather and season. | 00:47:16 | |
| Infrastructure protection lower peak demands. | 00:47:21 | |
| So kind of what was explained is. | 00:47:25 | |
| You know, during. | 00:47:27 | |
| During the night when everybody's watering high demands. | 00:47:28 | |
| That makes pumps kick on. | 00:47:32 | |
| On and off sooner. | 00:47:34 | |
| Which is. | 00:47:35 | |
| Power costs strain on the. | 00:47:36 | |
| And also. | 00:47:40 | |
| With central Utah, we have peak demands so actually cost us more money when they have to service. | 00:47:42 | |
| Certain water. | 00:47:47 | |
| This would kind of put the community as a. | 00:47:51 | |
| Umm, all in together, work as a team. | 00:47:55 | |
| You know, there's environmental benefits. | 00:47:58 | |
| The less runoff means less fertilizers and pesticides getting into our storm drains. | 00:48:02 | |
| Preserves, local streams, rivers, groundwater levels. | 00:48:08 | |
| Umm, actually. | 00:48:13 | |
| Eliminates. | 00:48:15 | |
| Fungus and. | 00:48:17 | |
| Stuff with your grass so it's actually healthier for your grass as well. | 00:48:19 | |
| To reduce them. | 00:48:22 | |
| Your watering schedule, it's about three days a week. | 00:48:23 | |
| Umm, the. | 00:48:26 | |
| There's been several cities that's adopted the state guidelines, West Jordan, Draper, Saint George and. | 00:48:31 | |
| There's some supporting evidence through some of these cities that's adopted at Saint George is saved. | 00:48:38 | |
| An estimate of. | 00:48:43 | |
| 1.3 billion gallons annually. | 00:48:44 | |
| What the three day watering schedule? | 00:48:47 | |
| Herman's peak demand has dropped 20% after they adopted the three day. | 00:48:49 | |
| Ordinance. | 00:48:55 | |
| And West Jordan residents have actually reported. | 00:48:57 | |
| They feel like their turf is. | 00:49:00 | |
| Improved in health? | 00:49:03 | |
| So. | 00:49:05 | |
| So yeah. | 00:49:07 | |
| We just. | 00:49:08 | |
| Feel like it's really important to start following these guidelines, especially the state where they're seeing. | 00:49:09 | |
| You know the need of this and umm. | 00:49:16 | |
| There's a lot of websites out there that. | 00:49:19 | |
| Have information? | 00:49:22 | |
| And. | 00:49:24 | |
| And never anything. | 00:49:28 | |
| Anybody else wants to add? | 00:49:30 | |
| Do you happen to have the schedule in front of you or? | 00:49:32 | |
| Yeah, umm. | 00:49:35 | |
| So, uh. | 00:49:36 | |
| Kind of what we were proposing is. | 00:49:37 | |
| If your house is an even address. | 00:49:40 | |
| That you would water on. | 00:49:42 | |
| Even day of the month. | 00:49:44 | |
| Up to three days a week. | 00:49:46 | |
| That would be in. | 00:49:48 | |
| Our regular we call it phase one. | 00:49:50 | |
| We have 3 phases. | 00:49:55 | |
| Lawn watering. | 00:49:58 | |
| It's mandatory through all three phases. | 00:49:59 | |
| Once we get to. | 00:50:02 | |
| Like phase three, which is severe. | 00:50:05 | |
| We would drop down to probably one to two days, but. | 00:50:08 | |
| We're suggesting three days a week. | 00:50:12 | |
| A lot of questions come out when we. | 00:50:16 | |
| Asked residents to do this. | 00:50:19 | |
| We have met with. | 00:50:21 | |
| City staff and city staff is well on board to make sure that. | 00:50:23 | |
| City facilities will follow this as well. | 00:50:28 | |
| And, umm. | 00:50:30 | |
| Be held as capable as the citizens will open. | 00:50:31 | |
| So thank you. | 00:50:34 | |
| I do have a question about this one. | 00:50:36 | |
| Have you guys reviewed how? | 00:50:39 | |
| You could trigger water usage during. | 00:50:42 | |
| Drought seasons where we are. | 00:50:46 | |
| Implementing it into our current tiered performer. | 00:50:49 | |
| Where if they're. | 00:50:52 | |
| We could lower. | 00:50:53 | |
| Or I guess raise the bar for how much water everybody's using and the tier could shift up. | 00:50:55 | |
| Rather than implementing a schedule that might be difficult to manage. | 00:51:00 | |
| Traffic, uh. | 00:51:04 | |
| Hold people accountable. | 00:51:05 | |
| Definitely something we could look into. | 00:51:08 | |
| We just. | 00:51:11 | |
| We just looked into this case just. | 00:51:13 | |
| It's easier to. | 00:51:16 | |
| What's the word am I looking for? | 00:51:19 | |
| For the system. | 00:51:22 | |
| The system would run more. | 00:51:24 | |
| Evenly submittedly instead of. | 00:51:25 | |
| If we, if we cheer them, I mean, if we. | 00:51:28 | |
| Did an actual schedule. | 00:51:31 | |
| And staggered it. | 00:51:33 | |
| Can I ask something? | 00:51:35 | |
| I've noticed most people when they water their lawns, they don't. | 00:51:37 | |
| The box doesn't typically say. | 00:51:41 | |
| You can go every other day, but I think that will actually cause people to water more. | 00:51:43 | |
| Typically most people water like Monday, Wednesday, Friday. | 00:51:48 | |
| Or Tuesday, Thursday, Saturday. Like you first. | 00:51:51 | |
| Like we first shared on social media. | 00:51:54 | |
| Is there a reason why you guys felt like changing to the even and odd? | 00:51:56 | |
| We did a little bit of research. Several cities did it that way. I think it was just easier for home. | 00:52:03 | |
| Homeowners, too. | 00:52:10 | |
| Match the day, even day. | 00:52:13 | |
| But uh. | 00:52:15 | |
| Yeah, like I said, we. | 00:52:16 | |
| I think. | 00:52:17 | |
| I think we're open to anything to. | 00:52:19 | |
| Try to push this along. | 00:52:21 | |
| But that that is a good comment as far as the sprinkler. | 00:52:23 | |
| So it would be easier on a. | 00:52:27 | |
| By weekday, my question was going to be how many residents have we actually talked to you? I know you were. | 00:52:29 | |
| We'll talk about your research, and I mean I. | 00:52:35 | |
| I'm I'm personally on board with the idea of restrictions because of. | 00:52:37 | |
| Where we're. | 00:52:42 | |
| Where we live. | 00:52:42 | |
| I am really worried about making sure that we don't cause an uproar. | 00:52:46 | |
| And that people are bought in. | 00:52:51 | |
| For the right reasons, not just for. | 00:52:52 | |
| Enforcement. | 00:52:55 | |
| My recommendation to the Council would be that we. | 00:52:57 | |
| Look into the tiered structure where we trigger it. | 00:53:01 | |
| I think that education is already out there. | 00:53:04 | |
| And it could be built into the system that we already have. | 00:53:06 | |
| If not. | 00:53:11 | |
| That maybe we do additional. | 00:53:12 | |
| Maybe we do additional? | 00:53:14 | |
| Research into different types of schedules and what that would look like for people. That was one of your things. I don't know if. | 00:53:16 | |
| Umm, you want to? | 00:53:23 | |
| Put out a survey at this point. | 00:53:25 | |
| Yeah, I would be very interested in what our community actually thinks about this. | 00:53:28 | |
| I'm genuinely curious if people think that this is a problem or not. | 00:53:34 | |
| I would hope that they do, but I. | 00:53:39 | |
| I don't know what they do. | 00:53:41 | |
| Do you have any comments on any of that or? | 00:53:42 | |
| Is that no, yeah, for a question. Maybe we can get that more information out. Like you said, it's it's pretty. | 00:53:45 | |
| Astounding. | 00:53:51 | |
| Like I mentioned. | 00:53:53 | |
| Our our last month July. | 00:53:54 | |
| Umm, we used 404. | 00:53:59 | |
| Acre feet, which I think is a little over. | 00:54:02 | |
| What is it like 136? | 00:54:05 | |
| 1,000,000 gallons. | 00:54:07 | |
| When in months that non use were. | 00:54:09 | |
| About 30 million gallons so. | 00:54:12 | |
| It is. | 00:54:15 | |
| Astounding how much outdoor use were. | 00:54:17 | |
| We're using and the 1.3 billions in savings is. | 00:54:20 | |
| That's amazing. I think if we put that information out there, if we did want to do a survey, I'm OK. If you guys want to do a | 00:54:23 | |
| survey, I think that'd be helpful. | 00:54:27 | |
| But also if. | 00:54:31 | |
| If we research. | 00:54:32 | |
| What does that look like in the tiered program that our residents have been using now for several years? | 00:54:34 | |
| If that was just implemented and it was like oh. | 00:54:39 | |
| It's been announced that we have. | 00:54:42 | |
| A need to conserve water. | 00:54:45 | |
| Tiered structure shift and everybody knows that usage so that. | 00:54:46 | |
| People maybe. Maybe you. | 00:54:51 | |
| People that are doing Monday, Wednesday, Friday. | 00:54:52 | |
| Maybe some people are only doing. | 00:54:55 | |
| Every now and then. | 00:54:57 | |
| They will instantly know when their bill goes up. | 00:54:58 | |
| Hey, you've kind of overused. | 00:55:00 | |
| And not only. | 00:55:03 | |
| The water usage if our water usage keeps going up, talking about trying to keep it down. | 00:55:05 | |
| That means. | 00:55:10 | |
| Our booster station. | 00:55:11 | |
| Tank will probably be upgraded sooner than later. | 00:55:12 | |
| It was built. | 00:55:16 | |
| Ready to upgrade? | 00:55:17 | |
| But the cost of putting those bigger pumps and stuff in. | 00:55:19 | |
| Would probably come a lot sooner than. | 00:55:22 | |
| And needed, so there's a. | 00:55:24 | |
| Pretty hefty cost with that as well. | 00:55:26 | |
| So. | 00:55:28 | |
| Can I? Did you guys have additional comments? | 00:55:30 | |
| Well, our contract is set up so that we either use it or lose it like we buy a certain amount, right? Like 2500? | 00:55:33 | |
| Foot, uh, acre foot, right. | 00:55:41 | |
| And we use like 22 or 2300 acre foot. So we never get to that, but we pay, we pay the higher amount. | 00:55:44 | |
| We've never got to it right. | 00:55:51 | |
| We would only pay up to the. | 00:55:54 | |
| 2400 mark this year. | 00:55:57 | |
| It's the tweak that you've ever reached. | 00:55:59 | |
| So that's the take and pay model is that. | 00:56:02 | |
| If our highest year ever was. | 00:56:06 | |
| 24101. | 00:56:08 | |
| We would be. | 00:56:10 | |
| Flipping into that 2500 acre a year mark. | 00:56:11 | |
| But if we've never breached 2400? | 00:56:14 | |
| We stay in that 2400 and if we're growing. | 00:56:17 | |
| We have the opportunity to stay below that. | 00:56:20 | |
| What, what, what is What was our this year's use? | 00:56:23 | |
| Just last month or? | 00:56:27 | |
| No total that we're up to right now in contract. | 00:56:28 | |
| Umm, so our contracts. | 00:56:32 | |
| July to June so. | 00:56:35 | |
| Right. So our only use last year though as far as our. | 00:56:37 | |
| Numbers. I think we were. | 00:56:41 | |
| I think we paid for a little over. | 00:56:46 | |
| Extra 100 acre feet. | 00:56:48 | |
| But with that being said, they do have a percentage we can roll over, right. So we actually was able to roll over 55 acre feet. | 00:56:50 | |
| Right, 'cause we don't go over. | 00:56:59 | |
| You know, because we're growing rather than just having our. | 00:57:01 | |
| What, are you still like that? | 00:57:04 | |
| We can. We can temper that. | 00:57:06 | |
| That total amount used each year. | 00:57:08 | |
| Through conservation practices. | 00:57:11 | |
| Through, you know. | 00:57:14 | |
| Plans like this where we keep the overall water usage. | 00:57:16 | |
| Lower than it. | 00:57:19 | |
| Would be with existing practices. | 00:57:20 | |
| You know if if we've got. | 00:57:23 | |
| A portion of the city watering every single day. | 00:57:25 | |
| Hoping their grass will get a little bit greener. | 00:57:27 | |
| You know, just some education and letting them know that. | 00:57:30 | |
| You know the healthiest lawn is every other day, Water not. | 00:57:33 | |
| Not everyday watered, we can keep our total use. | 00:57:37 | |
| Down. | 00:57:40 | |
| And overtime. | 00:57:41 | |
| Only have to jump into those next brackets of. | 00:57:44 | |
| Annual use that we have to pay for. | 00:57:48 | |
| You know, slower than we might otherwise do. | 00:57:50 | |
| So there's great value in. | 00:57:53 | |
| In yeah, my my concern is is that I know we've never. | 00:57:54 | |
| Like exceeded it. | 00:57:59 | |
| Or for most years, we don't. | 00:58:00 | |
| And having lived here. | 00:58:02 | |
| I do want to disclose. | 00:58:04 | |
| My lawn is on a well and very unique so this doesn't. | 00:58:06 | |
| This doesn't affect me in my home so. | 00:58:09 | |
| If they want to text down that one. | 00:58:12 | |
| But the home I live? | 00:58:14 | |
| But. | 00:58:17 | |
| For those that. | 00:58:18 | |
| Do my concern is that we have a smart. | 00:58:19 | |
| Metering program. | 00:58:22 | |
| Are we going to use that to identify those that use the law? | 00:58:23 | |
| Of water. | 00:58:26 | |
| So I mean, if people get set up, they're. | 00:58:28 | |
| They're aware of. | 00:58:31 | |
| High usage or a leak? | 00:58:32 | |
| So would we shut them down or charge them more? | 00:58:34 | |
| Like forcefully like hey, you're using more water. So now we're going to charge you more. So in our, in our fee schedule, there is | 00:58:37 | |
| a tiered level. | 00:58:41 | |
| So if they if they do use more water landscaping together, there's gonna be a lot. | 00:58:45 | |
| But on certain days like if they don't follow the fee structure of those days. | 00:58:49 | |
| So hey, this isn't your day, so we're charging you more now. | 00:58:54 | |
| So it would be. | 00:58:57 | |
| What we proposed is. | 00:59:02 | |
| You know there's. | 00:59:03 | |
| There's a warning and a fine and. | 00:59:04 | |
| That we put in here. | 00:59:09 | |
| Follows the free skid. | 00:59:10 | |
| The schedule that's already been. | 00:59:12 | |
| So the first violation would be. | 00:59:14 | |
| You know, it could be up to $100. | 00:59:17 | |
| Most likely be more of a warning. | 00:59:19 | |
| For unsust water on a Tuesday, I have water on a Wednesday. | 00:59:21 | |
| I'm gonna get a warning saying you can't walk, you shouldn't water. | 00:59:25 | |
| Yeah, just adjust your, adjust your days. | 00:59:28 | |
| And if we vote, this is. | 00:59:31 | |
| This would go into effect when. | 00:59:33 | |
| It would go into effect right away that. | 00:59:35 | |
| Just just sort of as a. | 00:59:40 | |
| Just so that you know. | 00:59:43 | |
| This would be based on. | 00:59:45 | |
| Complaints that come in. | 00:59:47 | |
| So if somebody. | 00:59:49 | |
| Sees their, you know, someone watering every single day and all through the day. | 00:59:50 | |
| They might call it in. | 00:59:54 | |
| We'd go out and check it out. | 00:59:56 | |
| Talk with that individual. | 00:59:57 | |
| It is not going to be something that's going to flag to us. | 00:59:59 | |
| Based on their water meter usage or their. | 01:00:02 | |
| Or a spike in their water meter on a particular day. It's. | 01:00:05 | |
| Not at all. | 01:00:08 | |
| Automated system in that regard. | 01:00:09 | |
| It's getting the community to come together. | 01:00:11 | |
| And divide up their water use so that we're keeping. | 01:00:15 | |
| You know, yeah. And this is This is why my commentary, I really felt like. | 01:00:19 | |
| The enforcement and education would be difficult on this because when things are left to complaint. | 01:00:25 | |
| It just becomes an uneven. | 01:00:30 | |
| Opportunity of. | 01:00:33 | |
| This neighbor really cares and they're telling on that neighbor but like. | 01:00:36 | |
| Half a vineyard is still watering and so it becomes really complicated. I think the suggestions that we had to go back. | 01:00:40 | |
| And revisit this would be really good. | 01:00:48 | |
| Right now we have it as a recommendation that I think that's really helpful. But even if the survey. | 01:00:52 | |
| Was more education on why we're doing it and what we could save, to Darius points. | 01:00:57 | |
| On staying underneath. | 01:01:02 | |
| Like Eric said. | 01:01:04 | |
| That amount? | 01:01:06 | |
| So that it doesn't become an additional cost to the people. | 01:01:07 | |
| When you were asking about subsidies versus credit back? | 01:01:10 | |
| I think that's really meaningful to the community, and the community would really care, especially if they understood. | 01:01:15 | |
| That aspect of our water. | 01:01:20 | |
| Consumption. | 01:01:22 | |
| But I do think this. | 01:01:24 | |
| Needs more work. | 01:01:26 | |
| For us to. | 01:01:28 | |
| Review SO. | 01:01:29 | |
| Yeah, I'm sure if you have anything additional. | 01:01:31 | |
| Yeah, I would. Just never. I'm all for water conservation. | 01:01:33 | |
| Umm, you know I checked my well level. | 01:01:37 | |
| A few days ago and I was surprised at how high the water is and also how much. I mean, I think they just opened up the lake a | 01:01:40 | |
| couple of days ago. I don't know if you saw how that. | 01:01:44 | |
| Like, it's just dropping like a rock right now because they're trying to get water into the Great Salt Lake. But. | 01:01:49 | |
| I can understand communities like Saint George where they're more of a desert. | 01:01:55 | |
| You know, not in the basin like we're at, but like I don't think we're at the point where we need to be mandating. | 01:01:58 | |
| Or controlling citizens because. | 01:02:03 | |
| If we've paid and our citizens have paid for the 2500 acre feet and we. | 01:02:05 | |
| Roughly around 2300 acre feet. They've paid for this water. | 01:02:10 | |
| And I don't want to. | 01:02:14 | |
| Have a government obligating them to say what they can and cannot do. | 01:02:14 | |
| Some people believe in everyday water and every other day watering and that's what they purchased and that's the. | 01:02:18 | |
| Service that we're providing them and like I said it's an educational deal because we yeah educate them and like. | 01:02:24 | |
| Get them to be pro conservation and. | 01:02:30 | |
| I mean, I'm a conservationist on my water too, but. | 01:02:32 | |
| I don't want to force them. | 01:02:35 | |
| Alright, so this this block of water we buy, we have to pay for a. | 01:02:36 | |
| Up front so. | 01:02:40 | |
| It would be a lot easier for us to trend and know how much water we do have to take. | 01:02:42 | |
| Because if we get into the. | 01:02:46 | |
| Say the. | 01:02:48 | |
| 2026 We run out of water, we run our water. | 01:02:49 | |
| Because there's no conservation. | 01:02:52 | |
| So it's us as. | 01:02:54 | |
| A city trying to be. | 01:02:57 | |
| Guess right now. | 01:02:59 | |
| On how much water going to be used. | 01:03:01 | |
| If we can conserve. | 01:03:03 | |
| And get more of a steady data. | 01:03:04 | |
| Of how much water? | 01:03:06 | |
| Are going to use that we. | 01:03:08 | |
| Yeah, I think that's really helpful. | 01:03:10 | |
| Sir, did you have any comments? Otherwise, I think we have the ability to make a motion to continue this at this point. | 01:03:12 | |
| Well, yeah, we talked about. | 01:03:18 | |
| How to educate people? | 01:03:20 | |
| In their homes, the fastest way to do it and we talked about. | 01:03:21 | |
| Bringing out all of these. | 01:03:26 | |
| Points in their water bill. | 01:03:27 | |
| You know, even if you even if you give them some really. | 01:03:29 | |
| Give people some really specific education points. | 01:03:32 | |
| I think you'd get a lot of people on board. | 01:03:36 | |
| You know that their water. | 01:03:38 | |
| There that watering glass is healthier or for their. | 01:03:39 | |
| Lawn and it helps the city. I think there's just a lot of really good solid common sense points that you could put in their water | 01:03:43 | |
| bill so they see it right away and. | 01:03:46 | |
| I think you'd be surprised how many people would be on board and cooperating. | 01:03:51 | |
| Right. Is that a motion to continue it? | 01:03:55 | |
| To another a future date. | 01:03:58 | |
| OK, why don't instead of making a motion, why don't we? | 01:04:01 | |
| Umm, talk about. | 01:04:05 | |
| Doing more media about conservation like willingly and putting in. | 01:04:08 | |
| Place and educating about what days we recommend that they water and see how many will. | 01:04:13 | |
| Voluntarily. | 01:04:18 | |
| Do that and adapt the change. | 01:04:19 | |
| Just as a voluntary method. | 01:04:22 | |
| I know I would, and I know many citizens would. | 01:04:25 | |
| Probably do it in a voluntary. | 01:04:28 | |
| Way and we could hit it really hard. | 01:04:30 | |
| Through social media and others. | 01:04:32 | |
| And then after a six month or a year. | 01:04:34 | |
| Because this year we're not gonna have a. | 01:04:36 | |
| A problem with water. The water is pretty close to an end. You know the harvest is done. | 01:04:38 | |
| So we've got. | 01:04:43 | |
| Really good water this year but. | 01:04:45 | |
| And then and then. | 01:04:47 | |
| Looking at it next year, look at what OK, how much an effect that a voluntary system. | 01:04:48 | |
| Or project do. | 01:04:53 | |
| And maybe even put in some sort of. | 01:04:55 | |
| Prize for. | 01:04:57 | |
| You know, those that consumed less water throughout the year. | 01:05:00 | |
| And throwing a party. | 01:05:03 | |
| Of some sort because I. | 01:05:05 | |
| You get a lot more from honey than. | 01:05:06 | |
| Vinegar. | 01:05:08 | |
| So that. | 01:05:09 | |
| Thank you for that comment. That is the approach that they've been taking right now is through social media and outreach. | 01:05:10 | |
| I think what we're suggesting right now is that they go back and they review how education would go out, how surveys would go out, | 01:05:17 | |
| maybe additional types of a way to approach the situation that's different than the one that was presented. | 01:05:23 | |
| And I guess the reason why we're saying continue it and bring it back is for the opportunity to. | 01:05:30 | |
| Present that education. | 01:05:36 | |
| Information that survey. | 01:05:38 | |
| Those different changes back before the Council so that we can discuss it and maybe at that time also we can. | 01:05:40 | |
| Bring back the information that we put out to social media already and how we've been working about the. | 01:05:46 | |
| Those things to for the last several years. | 01:05:52 | |
| And and what that's looked like. | 01:05:54 | |
| So I would still, I still think. | 01:05:57 | |
| If you guys just want to say. | 01:05:59 | |
| Come back at some future date. | 01:06:01 | |
| We can, but I think we're we're on track with what you said. | 01:06:03 | |
| Already I also think that this is an opportunity. | 01:06:07 | |
| Not just for the application, but for that. | 01:06:10 | |
| Usage report that. | 01:06:12 | |
| That I was suggesting earlier that I think these two things could be combined. | 01:06:13 | |
| To help educate not just the community, but. | 01:06:19 | |
| But all of us have. | 01:06:22 | |
| Hear about how we're trending. | 01:06:23 | |
| Yeah. And I feel like you guys have the guidance that you need. | 01:06:25 | |
| For that right? | 01:06:28 | |
| Or you you feel like you have that. | 01:06:29 | |
| So were you in the middle of making a motion to continue it? | 01:06:32 | |
| You did. | 01:06:37 | |
| I'm gonna keep moving forward with that. | 01:06:38 | |
| With all of that, knowing that everybody got what they wanted out of. | 01:06:40 | |
| That can I get a second? | 01:06:45 | |
| Second, OK. | 01:06:47 | |
| All in favor. | 01:06:49 | |
| Aye, any opposed? | 01:06:50 | |
| All right 7.4 Municipal Code Amendment, Section 13. | 01:06:52 | |
| .16 Public Library Ordinance 2025-10 is asked to be postponed. There's some work to do with the library board, so I just need a | 01:06:57 | |
| motion to continue this item. | 01:07:02 | |
| I move to continue 7.4. | 01:07:07 | |
| To a future meeting. Thank you, Marty. Can I get a second? | 01:07:10 | |
| 2nd thank you Sarah. All in favor. | 01:07:14 | |
| Aye aye. Any opposed? | 01:07:17 | |
| All right. Eric, did you have anything pressing for a report? | 01:07:19 | |
| Nothing pressing. | 01:07:26 | |
| You'll find the. | 01:07:27 | |
| The monthly report attached to the agenda. | 01:07:29 | |
| For today. | 01:07:32 | |
| There's lots of fun updates but. | 01:07:35 | |
| But we could hold it because if you have something fun. | 01:07:37 | |
| Sure, I don't know how to like. | 01:07:39 | |
| Parse it, but let me run through it quick. | 01:07:42 | |
| OK, while you're doing that, I'm going to turn the time over to the City Council. | 01:07:44 | |
| Is there anything pressing that any City Council member would like to share? | 01:07:48 | |
| Sarah, do you have anything? I'm just going to go through all of you. | 01:07:54 | |
| No, not at this time. | 01:07:58 | |
| By all means. | 01:08:01 | |
| OK, well I just want to address. | 01:08:05 | |
| Public comment where I. | 01:08:07 | |
| I was I'll just. | 01:08:10 | |
| I'll just own it that I accused some, that I called somebody a liar. | 01:08:11 | |
| I never actually called you a liar. | 01:08:15 | |
| But I corrected you multiple times on social media. | 01:08:17 | |
| And you continue to spread the same misinformation. | 01:08:20 | |
| So I didn't call you a liar. | 01:08:23 | |
| I started to say what you were spreading was a lie. | 01:08:25 | |
| So I just want to clarify that. | 01:08:28 | |
| For the record. | 01:08:30 | |
| And if you want to have a conversation after council, I'm happy to do that. | 01:08:31 | |
| On the is that. | 01:08:35 | |
| On the liar side. | 01:08:36 | |
| The movie in the park was really cool. | 01:08:38 | |
| And I just wanted to acknowledge that. | 01:08:40 | |
| For doing that, I think that's a really special feature that cities put on and. | 01:08:43 | |
| I think. | 01:08:47 | |
| I think Vineyard is a pretty special place so. | 01:08:48 | |
| All right. Thank you, Jake. | 01:08:51 | |
| Yeah, I I actually agree with the citizen that they're not lying and that they're telling the truth on the City Hall. | 01:08:58 | |
| I've seen many cities over my 20 years that asked for bonding and asked for wiggle room. | 01:09:04 | |
| And once you give them a credit card, they can. | 01:09:10 | |
| Use it for a building and then use the remaining for a truck or for different different things that fit within the definition of | 01:09:13 | |
| it. I know Vineyard's done that with our bonding and water of. | 01:09:18 | |
| Saying we're doing this and then. | 01:09:23 | |
| When you have some access and I think if you look at. | 01:09:24 | |
| The referendum sponsors and I've met with them. | 01:09:28 | |
| Their concern was the credit card of 35,000,000 with the. | 01:09:31 | |
| Interest of 46,000,000 SO. | 01:09:35 | |
| It's just a difference of. | 01:09:37 | |
| Of opinion there. | 01:09:40 | |
| On that. | 01:09:41 | |
| And then I would like to address the. | 01:09:43 | |
| Actually I don't want to address the fake accounts. | 01:09:50 | |
| OK, Brett. | 01:09:54 | |
| Nothing at this time. | 01:09:56 | |
| Marty. | 01:09:58 | |
| I'm good today. | 01:09:59 | |
| OK. Just for clarity, I think it's important to remember that there was. | 01:10:00 | |
| A revolt on a bond. | 01:10:07 | |
| A stipulation vote that brought us to Mary and a no vote. | 01:10:09 | |
| On the financial? | 01:10:13 | |
| Tool and mechanism. | 01:10:15 | |
| So I think that's an important clarity. | 01:10:17 | |
| That all the residents. | 01:10:20 | |
| Need and can benefit from. | 01:10:22 | |
| That brings us. | 01:10:24 | |
| To Eric's really fun updates. | 01:10:25 | |
| OK, I've I've trimmed it down. | 01:10:27 | |
| Events that we have coming up. | 01:10:31 | |
| We secured A sponsorship from Utah City for the 9/11. | 01:10:35 | |
| 911 Patriot Day event. | 01:10:38 | |
| I were working with the Refuge to finalize plans for the Purple Ribbon Walk event in on October 2nd. | 01:10:40 | |
| We have Alex Foyer committed to coming to perform. | 01:10:47 | |
| Form at that event. | 01:10:50 | |
| We for our 911 day of service we've got 2 days of service events. | 01:10:52 | |
| Those are planned for September 6th and September 13th. | 01:10:56 | |
| We hosted. | 01:11:02 | |
| Another successful movie in the park. | 01:11:03 | |
| On July 28th. | 01:11:05 | |
| So some fun events that have just happened and some really great ones in the future here coming up soon. | 01:11:06 | |
| And then I also wanted to mention that we have. | 01:11:13 | |
| 7 new businesses in the city. | 01:11:15 | |
| That seems to be something of interest to all. | 01:11:18 | |
| We had. | 01:11:21 | |
| Neutral cost manufacturing. | 01:11:22 | |
| Priscilla Borges, Tesoro Furniture, LLC. | 01:11:24 | |
| Sycamore Lane Learning. | 01:11:29 | |
| Innovations. | 01:11:31 | |
| Burger King. | 01:11:33 | |
| Crafted design. | 01:11:34 | |
| Orion's Edge and. | 01:11:36 | |
| Celius. | 01:11:38 | |
| And I'll just leave it with that. | 01:11:40 | |
| OK, excellent. Thank you for sharing that. | 01:11:41 | |
| I'm going to turn this time over to our recorders to just give an update on what happens next with the primary just for the | 01:11:45 | |
| public. | 01:11:48 | |
| To better understand next steps. | 01:11:51 | |
| Oh, sorry. | 01:11:57 | |
| Thank you, Mayor. | 01:11:58 | |
| Council, I'm not giving up that an election is one of my favorite parts of my job. So the the primary might be over and the | 01:11:59 | |
| results might be out, but they are preliminary results. | 01:12:04 | |
| And I just got an updated e-mail from. | 01:12:10 | |
| The county there's still about 20,000 ballots that haven't been counted yet. | 01:12:13 | |
| So. | 01:12:18 | |
| Dates done on. | 01:12:20 | |
| Friday at 5:00, next Tuesday and next Friday at 5:00 and then at noon. | 01:12:23 | |
| On the 26th. | 01:12:27 | |
| And on the 26th is when? | 01:12:28 | |
| The Council will convene and. | 01:12:31 | |
| Set of the canvassing board and canvas. Bad election. | 01:12:33 | |
| Then the 6th top rope getters will move on to the primary election. | 01:12:36 | |
| And which will be? | 01:12:41 | |
| I always get that wrong. November 4th. | 01:12:42 | |
| Tony will correct me. | 01:12:45 | |
| So. | 01:12:47 | |
| So I always, always say to the candidates. | 01:12:49 | |
| Happy campaigning. Excellent. | 01:12:52 | |
| That reminds me because we'll be meeting on the 26th of. | 01:12:54 | |
| Canvassing that is not. | 01:12:58 | |
| We're gonna. It's Tuesday. Yeah. | 01:13:00 | |
| Correct. Yep. So we will not be holding a City Council meeting on Wednesday. We will be holding it on Tuesday so we can wrap up | 01:13:02 | |
| all our eyes so that we just have to have one meeting. So that'll help. Is there anything anybody wants to know? Any other | 01:13:07 | |
| information you'd like to know about the election? | 01:13:11 | |
| I don't think so. | 01:13:16 | |
| OK. Thank you. | 01:13:18 | |
| All right, that moves. | 01:13:19 | |
| To our first business item 9.1. This is a public hearing. | 01:13:20 | |
| The Tacker Bonds for Franklin. Discovery Academy Resolution 2025-44. | 01:13:24 | |
| Victoria Carlton will present this item. | 01:13:30 | |
| And what I'll do is I'll have a motion go right into a public hearing. | 01:13:34 | |
| For the residents. | 01:13:40 | |
| Can I get a motion for a public hearing? | 01:13:42 | |
| So moved. Thank you, Brett. Can I get a second? | 01:13:43 | |
| 2nd Thank you Sir, all in favor. | 01:13:47 | |
| Aye, aye. | 01:13:50 | |
| Alright, we are. | 01:13:52 | |
| Now in the public hearing, come on up and. | 01:13:54 | |
| Kind of explain what's going on and then dive right in. | 01:13:56 | |
| Yes, my name is Jacob Carlton. I'm with Gilmore and Bell. | 01:13:59 | |
| So Franklin Discovery Academy, which is located here in Lanyard City. | 01:14:03 | |
| Is looking to do a tax exempt bond financing for an expansion to their existing. | 01:14:08 | |
| Charter school facilities. | 01:14:14 | |
| And the bonds would be issued through the Arizona Industrial Development Authority. | 01:14:16 | |
| Which means that the city would not be the issue where the bond would not be liable in any way. | 01:14:22 | |
| For the repayment of the bonds that would be sliced solely with the school. | 01:14:28 | |
| But since these are being issued as tax exempt bonds, the federal tax code requires that the. | 01:14:33 | |
| Local jurisdiction in which the project is located Approve. | 01:14:38 | |
| The project. | 01:14:42 | |
| And so that's why we're here tonight. We do have. | 01:14:43 | |
| I think a couple of representatives from the school here as well in case anyone has any questions. | 01:14:46 | |
| Specifically about the project itself. | 01:14:51 | |
| Excellent. | 01:14:54 | |
| Hey, are there any questions from the public? | 01:14:55 | |
| OK, any. | 01:15:00 | |
| From anybody at Franklin. | 01:15:02 | |
| You'd like to say anything? | 01:15:05 | |
| All right. | 01:15:08 | |
| If not, I'll go ahead and close the public hearing. | 01:15:10 | |
| Need a motion? | 01:15:13 | |
| Thank you, Sarah. | 01:15:17 | |
| Can I get a second second? | 01:15:19 | |
| Second by Marty, all in favor. | 01:15:20 | |
| Aye, all right. Are there any questions from the Council? | 01:15:23 | |
| Oh, I need to do that by roll call. | 01:15:28 | |
| Jake. | 01:15:30 | |
| Oh, I got. | 01:15:34 | |
| Just kidding, OK? | 01:15:35 | |
| Any questions from the Council? | 01:15:37 | |
| So if you guys, I mean, I know the. | 01:15:41 | |
| Your public entity you have to disclose how you pay for the bonds. I guess you don't need to do. | 01:15:44 | |
| And if you default, we're not. | 01:15:50 | |
| Rival, right? | 01:15:52 | |
| That's correct. So the school. | 01:15:54 | |
| The payment of the bonds is. I mean that. | 01:15:56 | |
| Facilities themselves are pledged. | 01:15:58 | |
| Facilities and then also the state payments, the charter score receives reflections, the payment of the bond. So if there's a | 01:16:00 | |
| default. | 01:16:03 | |
| In the school is unable to pay, the city is in no way liable for repayment of the bonds. So we're literally just voting to say can | 01:16:06 | |
| they be tax exempt on that specific. | 01:16:12 | |
| I don't count. | 01:16:18 | |
| OK, great. So do you want to make a motion or are there any other? | 01:16:22 | |
| Questions for clarity before that. | 01:16:25 | |
| No, go ahead, Jake. | 01:16:28 | |
| Umm, I make I move. | 01:16:31 | |
| To approve, let's see where we are at. | 01:16:33 | |
| I moved to adopt Resolution 2544 approving the issuance of charter school revenue bonds by the American by the Arizona Industrial. | 01:16:37 | |
| Development Authority. | 01:16:46 | |
| Excellent. Can I get a second? | 01:16:47 | |
| 2nd. | 01:16:50 | |
| First by Jake, second by Brat. | 01:16:51 | |
| Any further discussion? | 01:16:53 | |
| All right. So that's done by roll call. | 01:16:55 | |
| Marty. | 01:16:58 | |
| Hi, I bet. | 01:16:59 | |
| Aye. | 01:17:01 | |
| Excellent. | 01:17:03 | |
| All right, 9.2 is the transportation Master plan and impact fee public hearing. This was postponed from the June 20. | 01:17:04 | |
| 5th 2025 City Council meeting and is asked to be moved to the September 10th. | 01:17:12 | |
| 2025. | 01:17:17 | |
| City Council meeting, Can I get a motion? | 01:17:19 | |
| So moved. | 01:17:23 | |
| Thank you. I have a first by Brett to move the meeting. Can I get a second? | 01:17:23 | |
| Second. Second by Marty. | 01:17:27 | |
| All in favor. | 01:17:30 | |
| Do I have to do roll call on that? No. | 01:17:32 | |
| On favor. | 01:17:33 | |
| Any opposed? | 01:17:35 | |
| All right, 9.3. | 01:17:37 | |
| This is the authorizing bid award for Independent Financial Audit and Internal Controls Review Resolution 2025 Dash 41 and I'll | 01:17:40 | |
| turn the time over to. | 01:17:45 | |
| Councilmember Class. | 01:17:50 | |
| Thank you. | 01:17:52 | |
| Mayor umm. | 01:17:53 | |
| I think ultimately we're I'd like to. | 01:17:55 | |
| To move this. | 01:17:57 | |
| Primarily, we have. | 01:17:59 | |
| Proposal we had. | 01:18:01 | |
| Convened our evaluation committee. | 01:18:04 | |
| One of the steps that we wanted to follow in our evaluation was to have essentially a. | 01:18:07 | |
| An interview with a couple of the. | 01:18:12 | |
| Committee members for the evaluation. | 01:18:16 | |
| With the the. | 01:18:19 | |
| The proposing entity. | 01:18:22 | |
| And we were hopeful that we'd be able to get that done today. | 01:18:23 | |
| Earlier today. | 01:18:28 | |
| But we were unable to get that scheduled until tomorrow. | 01:18:30 | |
| So I think that we should wait on this until we've been able to have that to make sure that we. | 01:18:33 | |
| Are checking all of all of the boxes and evaluating. | 01:18:39 | |
| The the proposal. | 01:18:43 | |
| Excellent. Which brings us right to Darius question. And she asked a question about me talking about removing the resolution from | 01:18:45 | |
| the agenda. We had talked about the desire to have the RFP reviewed by the City Council and really look through that. | 01:18:52 | |
| And she mentioned that I had striked the asked to have the resolution strike from it to turn this over to the City Council for | 01:18:58 | |
| review. | 01:19:02 | |
| And to make sure that we had enough time. | 01:19:05 | |
| Think it was really good process, the RFP went out, but some of the reviews that are happening tomorrow like Brett said. So it'll | 01:19:07 | |
| come back in a future meeting and hopefully everybody. | 01:19:12 | |
| We'll take the time to really understand and get to know it by that point. | 01:19:16 | |
| So with that I need a motion to. | 01:19:20 | |
| Move it to a future council meeting. | 01:19:22 | |
| I moved to. | 01:19:26 | |
| I make a motion to move. | 01:19:28 | |
| This discussion do I have to say the? | 01:19:32 | |
| Resolution 2025-41 to a future meeting. | 01:19:34 | |
| All right. We have a first by Brett. Can I get a second? | 01:19:38 | |
| 2nd is that you, Marty? Second by Marty, first by about, second by Marty. All in favor. | 01:19:41 | |
| Aye, aye. | 01:19:46 | |
| Any opposed? | 01:19:47 | |
| Jake, did you say aye, I'm sorry. | 01:19:49 | |
| OK, great. Thank you. | 01:19:51 | |
| This brings us to 9.4. This is the government records. | 01:19:52 | |
| Access Management Act discussions requested by City Council meeting and so today we will. | 01:19:56 | |
| Proceed with that discussion. I'm going to turn the time over to. | 01:20:02 | |
| Our legal counsel. | 01:20:06 | |
| Jamie Blakely. | 01:20:08 | |
| Yes, please. Thank you. | 01:20:31 | |
| Thank you, Mayor. | 01:20:51 | |
| The city recorder right now is passing out. | 01:20:54 | |
| Stack of information. | 01:20:57 | |
| During. | 01:20:59 | |
| The Council report in the last. | 01:21:00 | |
| City Council meeting. | 01:21:02 | |
| Council member Holdaway raised some. | 01:21:04 | |
| Concerns and issues with a grammar request that related to records in his possession. | 01:21:06 | |
| And the mayor asked me to go through. | 01:21:13 | |
| The materials. | 01:21:16 | |
| That were related to that and then to. | 01:21:17 | |
| Present a summary. | 01:21:20 | |
| And kind of a status report. | 01:21:22 | |
| On that grammar request in that response. | 01:21:24 | |
| So what you have in front of you is. | 01:21:26 | |
| The document on the top of the timeline. | 01:21:29 | |
| That includes the date of certain correspondence and communication. | 01:21:33 | |
| And then the stack of documents behind it. | 01:21:37 | |
| Is. | 01:21:40 | |
| And so if you look in the corner of each document, it will have a number. | 01:21:41 | |
| It'll say Vineyard City 0067, for example. | 01:21:46 | |
| And when you look at the timeline on the column on the left it. | 01:21:50 | |
| Will tell you the bait stamp reference. | 01:21:54 | |
| I'm not going to go through this stack of documents, but it's there so you have it. | 01:21:57 | |
| And can reference. | 01:22:01 | |
| What occurred and then reference the original source document. | 01:22:03 | |
| On each of those items. | 01:22:06 | |
| So I want to go through. | 01:22:08 | |
| 4 primary things today the roles and responsibilities and processes the city follows on. | 01:22:10 | |
| Grammar and records requests when I say grandma. | 01:22:16 | |
| I'm not referring to a relative, but to. | 01:22:20 | |
| Government records law. | 01:22:22 | |
| That applies in Utah. | 01:22:25 | |
| I'm going to go through the timeline of the request, the response of what was requested, what was provided, how did the city | 01:22:28 | |
| respond? | 01:22:31 | |
| The status of the responsive records presently and then. | 01:22:35 | |
| There is an appeal process within the statute within grandma. | 01:22:39 | |
| And uh. | 01:22:43 | |
| I just want to highlight the. | 01:22:44 | |
| That appeals process what it is and. | 01:22:46 | |
| And what we have to do to respect that process and those rights. | 01:22:49 | |
| So in terms of roles and responsibilities, these are the primary actors when we. | 01:22:53 | |
| Talk about a grammar request and who reviews it. | 01:22:58 | |
| There is a requester. In this case it's a Mr. Jensen. | 01:23:02 | |
| There's the records officer. In our city, we have two records officers. It's the city recorder and the deputy city recorder. | 01:23:06 | |
| That ends up being Pam Spencer and Tony Lara. | 01:23:12 | |
| The individual who has the. | 01:23:15 | |
| Response The records that are responsive to the request. | 01:23:18 | |
| This can vary request by request, but on this particular request it's council member Holdaway. | 01:23:21 | |
| The chief administrative officer in the city is Eric Ellis. | 01:23:27 | |
| That's the person that. | 01:23:30 | |
| Here's an administrative appeal of a grandma denial. | 01:23:32 | |
| And then there's the state records on both women. | 01:23:36 | |
| Her name is Monica Minaya. | 01:23:40 | |
| To go through quickly kind of the. | 01:23:43 | |
| The requester makes grandma requests. | 01:23:45 | |
| The requester defines the format in which they would like the rooster. | 01:23:48 | |
| The requested records to be provided. | 01:23:52 | |
| And in this case, they've requested the records in the original format. | 01:23:56 | |
| The Records officer has the role of. | 01:24:00 | |
| Responding to grammar requests. | 01:24:03 | |
| So they. | 01:24:06 | |
| Organize the gathering of the responsive records. | 01:24:07 | |
| And then they have the statutory duty to review the records once they're gathered. | 01:24:11 | |
| Classify the records and then in those circumstances where you have to redact. | 01:24:16 | |
| The portions of records that are classified as private protected. | 01:24:21 | |
| Or control. | 01:24:27 | |
| That they would make those types of redactions. | 01:24:28 | |
| And they make the initial determination on. | 01:24:31 | |
| What records are responsive and then what records? | 01:24:34 | |
| Are provided. | 01:24:37 | |
| The individual city officer or employee who has the records is responsible for. | 01:24:38 | |
| Helping to gather those records and then provide them to the records officer. | 01:24:46 | |
| And the records officer always asked for those records in the format of the request. | 01:24:50 | |
| In this case, the request was to get the records in the original format. | 01:24:55 | |
| And then again, if there's an appeal, it would be to the chief. | 01:25:00 | |
| Administrative Officer. | 01:25:02 | |
| There is a State Records office and within the State Records office the State Records Ombudsman. | 01:25:04 | |
| Her rules by statute are threefold. | 01:25:11 | |
| A sheep can be a resource to requestors and a request. | 01:25:14 | |
| Resource to those who are responding to a request. | 01:25:18 | |
| When there's an appeal of. | 01:25:22 | |
| A final administrative decision, meaning. | 01:25:24 | |
| There's been an appeal to the chief administrative officer within the city. | 01:25:26 | |
| To It used to be the state records committee. It just recently changed to a state. | 01:25:31 | |
| Records Hearing Officer. | 01:25:35 | |
| So if there is an appeal to the hearing officer there. | 01:25:38 | |
| Between before that appeal is heard, there's a mediation process that's offered in the ombudsman. | 01:25:41 | |
| Overseas that mediation process. | 01:25:47 | |
| There is. | 01:25:50 | |
| A language in the statute that prohibits the. | 01:25:51 | |
| State records ombudsman from going on record or testifying. | 01:25:54 | |
| For or against somebody that she either provides advice to or. | 01:25:59 | |
| A mediation that she conducts. So her role is limited a little bit again. | 01:26:04 | |
| That she provides that guidance and that advice. | 01:26:09 | |
| She provides that mediation services, but she's not someone who. | 01:26:12 | |
| Take sides or call shots, so to speak. | 01:26:17 | |
| On grandma matters. | 01:26:20 | |
| How does? | 01:26:22 | |
| Vineyard City. | 01:26:23 | |
| What is its process for gathering and reviewing records so? | 01:26:25 | |
| When the city recorder received a record request. | 01:26:29 | |
| What she does is works with the requester to clarify the request and to clarify the search parameters that she'll follow. | 01:26:32 | |
| Sometimes she will get requests that are either really broad, really detailed. | 01:26:39 | |
| And might follow up with the requester to say if we search these databases or these e-mail addresses. | 01:26:44 | |
| Using these search terms will that satisfy your request. | 01:26:51 | |
| And work with the requester to identify what those are and then to conduct the search in that way. | 01:26:55 | |
| C then will work to pull the records if she has direct access to the records. | 01:27:01 | |
| If she doesn't have direct access to the records, then she'll ask. | 01:27:06 | |
| 4 copies of the records from whoever it is. | 01:27:11 | |
| That has those records. | 01:27:14 | |
| So an example. | 01:27:16 | |
| Some city employees may have cell phones. | 01:27:17 | |
| Or use personal phones to conduct city business. | 01:27:20 | |
| Text messages are not stored on a. | 01:27:24 | |
| Central database and so if you had a records request that was for a text message. | 01:27:26 | |
| Pam would have to go to the individual that has that device. | 01:27:31 | |
| Work to search their messages and then to take screenshots and gather the records from that source. | 01:27:35 | |
| Sometimes a similar thing will happen with emails or e-mail records. | 01:27:41 | |
| Or with other records that might be located on an individual device, not a central location or file. | 01:27:44 | |
| To which she can access it directly. | 01:27:51 | |
| When the records officer gets request. | 01:27:54 | |
| That relate to controversial or notable topics. | 01:27:57 | |
| The city's practice for at least the entire time that I've been the city attorney and I think before that. | 01:28:01 | |
| Even is for searches to be witnessed or observed. | 01:28:06 | |
| What this means is. | 01:28:10 | |
| The records officer will ask the person gathering the records to have somebody sit with. | 01:28:12 | |
| And to conduct those searches. So we have in the past, for example. | 01:28:18 | |
| Records request for. | 01:28:22 | |
| Records in the mayor's e-mail. | 01:28:24 | |
| Or the mayor's text messages. And so we would have. | 01:28:26 | |
| Either an administrative assistant or the city reporter, whoever was available. | 01:28:29 | |
| Sit with the mayor. | 01:28:34 | |
| And conduct that search so that. | 01:28:36 | |
| If we're questioned about it, we have not just the mayor who can answer and say I did a search, but somebody else who can say. | 01:28:38 | |
| I observed and I witnessed. | 01:28:45 | |
| That search there the. | 01:28:46 | |
| Records Officer uses her discretion to determine what our. | 01:28:50 | |
| Those controversial or notable topics for which. | 01:28:54 | |
| You want to have somebody else there? | 01:28:58 | |
| With the search. | 01:29:00 | |
| That's proven a good and a useful practice, and when we've had things going uphill to the records committee, we've been able to | 01:29:01 | |
| justify the search. | 01:29:05 | |
| And state with certainty with two witnesses that it's been a full. | 01:29:09 | |
| Search of the records. | 01:29:14 | |
| And again, the city recorder is the records officer. | 01:29:15 | |
| By law and as such, she has the statutory responsibility for revealing. | 01:29:19 | |
| And classifying records and for defining the process by which. | 01:29:24 | |
| The city conducts its search of records. | 01:29:28 | |
| Turning to the. | 01:29:32 | |
| The actual request that was the subject of the conversation. | 01:29:34 | |
| This is what was requested. | 01:29:38 | |
| They are records related to. | 01:29:40 | |
| Communication between Councilmember Jacob Holdaway and. | 01:29:43 | |
| A reporter at the Salt Lake Review named Leah Larson. | 01:29:47 | |
| They gave a date range. | 01:29:51 | |
| They give a scope of what was requested. The scope included emails. | 01:29:52 | |
| Internal correspondence communication allows text messages. | 01:29:57 | |
| And it. | 01:30:02 | |
| Went on to define. | 01:30:03 | |
| What it meant by? | 01:30:05 | |
| Records to include all types of records, not. | 01:30:07 | |
| Adjust these things. | 01:30:10 | |
| They expressed A preferred format which was electronic format, so they wanted their PDF or a native file format. | 01:30:12 | |
| If that were easier. | 01:30:18 | |
| So here I put together a little timeline of events. This again, is a summary. It's not intended to be comprehensive, it's just | 01:30:22 | |
| intended to give a snapshot of. | 01:30:26 | |
| When the request was received, what happened to it? | 01:30:30 | |
| What kind of the basic communication was? | 01:30:35 | |
| So May 30th was when the grammar request was received on the same day. | 01:30:39 | |
| The city Recorder's Office forwarded the request to Councilmember Holloway. | 01:30:44 | |
| With the request that he gathered the responsive records that are in his possession. | 01:30:49 | |
| On June 10th. | 01:30:54 | |
| The city recorder sent a reminder e-mail the council member Holdaway asking him to provide those responsive records. | 01:30:56 | |
| On June 11th, Council Member Holdaway sent a PDF with some of the responsive records. | 01:31:02 | |
| And the City of Recorder began her review. | 01:31:08 | |
| The deadline for the response is 10 business days from the date the request is received. | 01:31:11 | |
| 10 business days from May 30th. | 01:31:16 | |
| Ended up being June 13th. | 01:31:19 | |
| On the calendar. | 01:31:21 | |
| Because that was the deadline. | 01:31:23 | |
| There's an option to extend if needed, and so the city recorder. | 01:31:25 | |
| Sent an e-mail to the requester. | 01:31:29 | |
| Indicating. | 01:31:32 | |
| That the city would need an extension on that time. | 01:31:34 | |
| On June 18th. | 01:31:37 | |
| Pam Spencer requested records. | 01:31:39 | |
| In the original. | 01:31:41 | |
| Original format from Councilmember Holloway. | 01:31:42 | |
| He had provided some records and she had questions about whether. | 01:31:45 | |
| Those records had been. | 01:31:51 | |
| Compiled or modified in their format. | 01:31:52 | |
| And Council member Holdaway clarified that one of the things he. | 01:31:55 | |
| Provided was a presentation format. | 01:31:59 | |
| And that's what he had provided to the report. | 01:32:02 | |
| Quarter and so it had appeared in that presentation like there was some. | 01:32:05 | |
| Editorializing or. | 01:32:09 | |
| Comments or labels put over. | 01:32:11 | |
| Emails, but you clarified at that point that. | 01:32:13 | |
| That was the format in which he shared those materials with. | 01:32:16 | |
| Order and so I think that's the format. | 01:32:19 | |
| We've learned that. | 01:32:22 | |
| The original format that those documents were in when they were shared. | 01:32:23 | |
| He had not provided at that point in time the text messages or the contents of a Google Drive that were shared with. | 01:32:28 | |
| Reporter. | 01:32:35 | |
| On June 25th. | 01:32:36 | |
| Penn Spencer sent an update to the requester. | 01:32:40 | |
| Providing. | 01:32:42 | |
| A portion of the records and the requester at that point time amended the. | 01:32:45 | |
| To include call logs. | 01:32:48 | |
| On top of the. | 01:32:51 | |
| Documents that he had requested previously. | 01:32:52 | |
| On the 26th, Pam sent the first conship responsive records. | 01:32:55 | |
| And then on the 20. | 01:33:00 | |
| First, umm. | 01:33:02 | |
| The reporter's office followed up with Councilmember Holloway to try to track down the missing records. | 01:33:03 | |
| And to clarify that the records provided need to be in their original format. | 01:33:08 | |
| There were some things that were provided in a different format initially. | 01:33:13 | |
| On July 23rd, the Recorder's Office sent a second request. | 01:33:17 | |
| For the missing records. | 01:33:22 | |
| Some of the missing records were then submitted by Councilmember Holdaway. | 01:33:23 | |
| And on that same day, we had our last. | 01:33:28 | |
| City Council meeting in which there was an allegation of non compliance by. | 01:33:31 | |
| Council member holder way that. | 01:33:36 | |
| The recorder's office hadn't. | 01:33:38 | |
| Complied with grandma. | 01:33:40 | |
| I think we can see in the previous slide what the deadlines were and then how they corresponded and followed. | 01:33:42 | |
| And tracked with what the statute requires. | 01:33:49 | |
| On July 29th. | 01:33:52 | |
| After reviewing the additional records that were provided, the reporter's office supplemented the response to the requester. | 01:33:54 | |
| And Tony? | 01:34:01 | |
| 3rd request to Councilmember Holdaway for the records that we're still missing. | 01:34:04 | |
| On July 30th, Councilmember Holloway confirmed. | 01:34:08 | |
| Transmission of all the responsive records except for the Google Drive. | 01:34:11 | |
| I'll go through a summary of what was requested and what was provided and what we're still. | 01:34:16 | |
| Missing and then on August 4th. | 01:34:21 | |
| Council member Holdaway made a. | 01:34:24 | |
| Separate grammar requests for correspondence between the city and the. | 01:34:26 | |
| Buster on August 7th. | 01:34:29 | |
| Constants are sent an update to the requester based on that e-mail from Councilmember Holdaway confirming. | 01:34:33 | |
| What records existed, what we had? | 01:34:39 | |
| And then providing. | 01:34:41 | |
| Those that we did have. | 01:34:43 | |
| There were a few light redactions made that were redactions of. | 01:34:44 | |
| Personal information. | 01:34:47 | |
| Phone numbers, e-mail addresses, those kinds of things. | 01:34:49 | |
| So the stat as to the status of the responsive records. | 01:34:53 | |
| This is the list of. | 01:34:57 | |
| Things that were responsive. | 01:34:59 | |
| We received the text messages and the slides the. | 01:35:01 | |
| Slide presentation. | 01:35:06 | |
| And those have been provided to the requester. | 01:35:07 | |
| Council member Holdaway has confirmed. | 01:35:10 | |
| That no records exist. | 01:35:13 | |
| In e-mail format. | 01:35:15 | |
| That there were no recordings of the Zoom meetings that were held. | 01:35:17 | |
| And that there are no call logs that were retained. | 01:35:21 | |
| There was a Zoom meeting. Let me get through this and I think that mayor will have. | 01:35:25 | |
| But as long as I'm given the version to correct things, sure. | 01:35:31 | |
| But I mean, I like to. | 01:35:36 | |
| All right, I won't have time. I will give you some temperature. | 01:35:37 | |
| Go ahead, Jamie. | 01:35:41 | |
| And then on the. | 01:35:42 | |
| The records that are pending. | 01:35:43 | |
| The contents of the Google Drive. | 01:35:45 | |
| Have not been. | 01:35:48 | |
| Provided. | 01:35:49 | |
| There. | 01:35:51 | |
| It's not your turn yet. I will provide time for the council. So please, if we could avoid the interruptions and let Jamie continue | 01:35:53 | |
| his presentation. Let's just make sure people time. | 01:35:58 | |
| I will let you know the time that all of the council members get and each council member will get equal time. | 01:36:03 | |
| And again, what I'm relaying here is. | 01:36:11 | |
| You have the original source documents here in front of you. | 01:36:14 | |
| This is our best understanding of what's been provided, what exists. | 01:36:18 | |
| And what we don't yet have. | 01:36:22 | |
| There. So this conversation today is interesting because. | 01:36:24 | |
| Typically, this wouldn't be a discussion that you'd have at the City Council level, and the reason for that is. | 01:36:28 | |
| The requester has the right. | 01:36:34 | |
| And in this circumstance, he's indicated orally to the reporters office that he intends to. | 01:36:36 | |
| Final appeal to the Chief Administrative officer. | 01:36:42 | |
| There's a process for this appeal. | 01:36:45 | |
| To occur, it's outlined in state law. | 01:36:48 | |
| How it is to occur when the decisions to be made? | 01:36:50 | |
| What the format of the decision has to be and so. | 01:36:53 | |
| Part of the conversation today has to be a little bit abbreviated because we have to respect the fact. | 01:36:57 | |
| That that appeal process can. | 01:37:03 | |
| Occur, and if it does occur, it has to occur in. | 01:37:06 | |
| That forum and not in a. | 01:37:09 | |
| City Council meeting. | 01:37:11 | |
| So that's. | 01:37:13 | |
| Kind of the end of. | 01:37:14 | |
| Of my presentation and the overview of how I understand things, and I think the mayor will get a discussion from there and to the | 01:37:16 | |
| extent you wish to. | 01:37:20 | |
| Thank you, Jamie. Additionally, Council member Holder Way did ask that we. | 01:37:24 | |
| That we. | 01:37:31 | |
| Decide if there was something that we could intervene on. There were a few things that were. | 01:37:32 | |
| Requested. | 01:37:37 | |
| One was that we could see the records. | 01:37:38 | |
| As you see before you, there's a large stack of all of the records. | 01:37:41 | |
| I'm outlined as far as the dates that were provided in Jamie's slide. | 01:37:45 | |
| They are all categorized and outlined. | 01:37:50 | |
| Within your packet. | 01:37:53 | |
| So now you can see them. | 01:37:54 | |
| There was a question about whether or not Monica, the Ombudsman, could. | 01:37:57 | |
| Provide mediation. I did call her. | 01:38:01 | |
| She presented me with the law. | 01:38:05 | |
| State law. | 01:38:08 | |
| 63D. | 01:38:09 | |
| G Excuse me, 63G. | 01:38:11 | |
| 2-204. | 01:38:14 | |
| Section 1. | 01:38:17 | |
| Part A. | 01:38:19 | |
| In Section 3. | 01:38:22 | |
| Where it outlines her duties. | 01:38:23 | |
| As far as mediation goes and when that happens and that happens further along in the appeal process, she is a resource to people | 01:38:26 | |
| who have requested or I need to submit documents and so you can continue to ask anything. | 01:38:32 | |
| Clarifying questions, but at this time she. | 01:38:38 | |
| Not able Her role does not identify her. | 01:38:41 | |
| As mediating this conversation. | 01:38:45 | |
| Within this portion of time, you can review that law. | 01:38:49 | |
| Jamie covered it in his slide, but please feel free to review it. | 01:38:53 | |
| There was a question about conflicts of interest. Right now it looks like we're going through the proper process. It looks like | 01:38:57 | |
| all of your records were turned over. | 01:39:01 | |
| So the you had a concern. | 01:39:05 | |
| On July 23rd that records had been withheld or not. | 01:39:08 | |
| Turned over, but it looks like in June they were turned over. | 01:39:12 | |
| And then as you continue to provide additional information. | 01:39:16 | |
| And those records have been. | 01:39:21 | |
| Put forward as well. | 01:39:24 | |
| Let's see to see where we are in the process. | 01:39:26 | |
| I believe I have covered. | 01:39:29 | |
| All of your requests. | 01:39:32 | |
| And now we are at this place of seeing where the Council can. | 01:39:34 | |
| Take an action and it looks like what you're still waiting on, from what I understand, is that they're waiting on shared | 01:39:38 | |
| documents. | 01:39:41 | |
| From you from Google Drive doc. | 01:39:45 | |
| Moving forward. | 01:39:48 | |
| Council, at this time I'd like to provide about 20 minutes for this discussion where everybody would get. | 01:39:49 | |
| Or minutes. | 01:39:55 | |
| And Jake? | 01:39:57 | |
| Why don't we go ahead and. | 01:39:58 | |
| If you would like to up it by one minute, I'm happy to provide 5 minutes for everybody. But Jake, why don't you go ahead and. | 01:40:00 | |
| Sarah, your your comments and. | 01:40:07 | |
| Tony, if you could set a 5 minute timer so we can get through this and make sure everybody has equal time like. | 01:40:09 | |
| Council member Holdaway requested that would be helpful. | 01:40:15 | |
| The focus of the entire New York Times story is about 12 fake accounts that targeted my family. | 01:40:19 | |
| And made-up stories about bribery of my father. | 01:40:26 | |
| With city officials. | 01:40:30 | |
| Stealing land. | 01:40:32 | |
| Or whatnot. | 01:40:34 | |
| And recently on the social media. | 01:40:35 | |
| And three other. | 01:40:38 | |
| Employees have come forward to let me know. | 01:40:41 | |
| That they have been told or in meetings. | 01:40:44 | |
| Where they have confirmed that those fake accounts were from upper letter leadership within Vineyard City. | 01:40:48 | |
| I do not have any proof of that. | 01:40:55 | |
| I have stayed quiet over the last three or four days. | 01:40:58 | |
| When this happened over a year ago. | 01:41:02 | |
| It was terrifying. | 01:41:05 | |
| I didn't know who they were. | 01:41:07 | |
| They were talking about coming in through the entrance of my home with my young daughters. | 01:41:09 | |
| In the grammar request, you can see that I reach out to the Attorney General about it. | 01:41:15 | |
| He advises me that it's not illegal to view. | 01:41:20 | |
| My home from the street. | 01:41:24 | |
| And that there's nothing illegal about it. | 01:41:27 | |
| Umm. | 01:41:29 | |
| Because of the content. | 01:41:33 | |
| And the history of our city. | 01:41:36 | |
| And the. | 01:41:39 | |
| Major of our leadership, I turned over everything to Leah Larson, an independent person, to be able to investigate who these | 01:41:41 | |
| people were. | 01:41:45 | |
| Every single meeting that we ever had was that. | 01:41:50 | |
| Via Zoom, so nothing. | 01:41:53 | |
| Was recorded. | 01:41:55 | |
| There's no emails being sent and I was very clear that you didn't turn over any. | 01:41:56 | |
| Everyone knows me to be a zoom. | 01:42:01 | |
| So I would prepare a PowerPoint. | 01:42:03 | |
| And if you could imagine contacting the salt. | 01:42:05 | |
| The New York Times. | 01:42:08 | |
| They don't have a lot of time, so you have to organize things. | 01:42:09 | |
| So the description in all of the PowerPoints were to help the editors of. | 01:42:12 | |
| Both boards. | 01:42:17 | |
| Understand what my family was facing. | 01:42:19 | |
| That's all I have. | 01:42:22 | |
| At the end of every Zoom meeting. | 01:42:23 | |
| If they ask for a copy of it, I would. | 01:42:26 | |
| Send them a Google Drive and say download it. | 01:42:28 | |
| And I would have another conversation with them and I would delete the. | 01:42:31 | |
| The Google Drive just because. | 01:42:36 | |
| It's on my take a hold of it. It's e-mail e-mail and I don't have a lot of content to store because it costs $5 a month so I'm | 01:42:37 | |
| cheap. | 01:42:41 | |
| But every single. | 01:42:46 | |
| PowerPoint. | 01:42:48 | |
| Is saved on a folder on my. | 01:42:49 | |
| Computer and so when they came to ask it, I had every PowerPoint. | 01:42:51 | |
| So the accusation that. | 01:42:55 | |
| I had emailed her that I wasn't forthcoming now in the PowerPoint. | 01:42:58 | |
| There are snippets of emails. | 01:43:02 | |
| That I shared. | 01:43:04 | |
| Following Grandma Law. | 01:43:05 | |
| If I never shared them an e-mail. | 01:43:08 | |
| I never did share an existing e-mail. | 01:43:10 | |
| I sent them a PowerPoint of the e-mail so. | 01:43:14 | |
| For me to go into my e-mail and say. | 01:43:17 | |
| Hey, here's the e-mail. | 01:43:20 | |
| But I've never sent them this. | 01:43:22 | |
| I sent them the PowerPoint. | 01:43:25 | |
| Would be giving them a record that I'd never sent them before and I'd be lying to. | 01:43:27 | |
| Say that I'd given them. | 01:43:31 | |
| I've sent them a screenshot of that. | 01:43:33 | |
| And so that's the first so to say that I'm not complying with emails. It's like. | 01:43:35 | |
| You can look through my emails. | 01:43:40 | |
| I've looked through every single one, there's not one. | 01:43:41 | |
| Number so and then #2 on the Google Drive. | 01:43:43 | |
| It's just a file like. I have the folder so I don't have the thing. | 01:43:47 | |
| There is a recording. | 01:43:52 | |
| That did exist and I did not. | 01:43:54 | |
| The text messages. | 01:43:56 | |
| About 50 pages. | 01:43:57 | |
| I did not read the. | 01:43:59 | |
| Back and forth between me and Leah. | 01:44:01 | |
| 48 hours after. | 01:44:05 | |
| Interviewing. | 01:44:06 | |
| All of. | 01:44:10 | |
| People that they did within our city. | 01:44:11 | |
| And telling them that we knew what was going on. | 01:44:14 | |
| All twelve of those accounts were deleted. | 01:44:17 | |
| So whoever we interviewed went in and deleted every single one. | 01:44:20 | |
| So we knew they were coordinating. | 01:44:24 | |
| I did a recorded zoom meeting. | 01:44:27 | |
| I didn't realize this at the time. | 01:44:29 | |
| So looking for the text message. | 01:44:31 | |
| And I went through every single one of my Facebook accounts where each one of them. | 01:44:34 | |
| Within a 48 hour period of those interviews were deleted. | 01:44:38 | |
| It's a great piece of evidence and I contacted Zoom. | 01:44:42 | |
| Zoom has an automatic delete feature after 30 days. | 01:44:45 | |
| So when it's recorded it's saved in the cloud and then it auto deletes. | 01:44:49 | |
| I have a text message of reaching back out to Leah saying when you, when I sent you that recording, did you ever download it? She | 01:44:55 | |
| never downloaded it. She just looked at it and sent it to the to the New York Times body. | 01:45:01 | |
| That's why they knew I was credible. | 01:45:06 | |
| Is because they were able to see every single thing of how those accounts moved when they targeted my family. | 01:45:09 | |
| So that's that. So there are no emails on phone records. | 01:45:18 | |
| The phone that I have. | 01:45:22 | |
| Does not go in detail. | 01:45:23 | |
| It only holds the 30 days. | 01:45:25 | |
| Of my last I'll give you one more minute so that we can all have the same time, please. | 01:45:28 | |
| Please wrap up your thoughts. | 01:45:33 | |
| It only holds. | 01:45:34 | |
| The last 30 days of my. | 01:45:36 | |
| And at which I didn't have any calls with Leah. | 01:45:39 | |
| I went to the responder and I said. | 01:45:42 | |
| I have no problem sitting down with you and showing you why I don't have a Google Drive and Gmail. | 01:45:44 | |
| Or because it's just. | 01:45:49 | |
| Of the file number that. | 01:45:51 | |
| Doesn't exist, but every single PowerPoint over 100 pages. | 01:45:54 | |
| Are there so? | 01:45:58 | |
| The accusations that. | 01:46:00 | |
| I have emails. | 01:46:03 | |
| That I didn't share. I just don't. | 01:46:05 | |
| We never that way. | 01:46:08 | |
| All right. However, I want to say one last thing. | 01:46:12 | |
| The people conducting the grammar. | 01:46:17 | |
| And the Council. | 01:46:19 | |
| Are all the subject of the matter except. | 01:46:21 | |
| Sarah, Marty and Brett. But the mayor? | 01:46:25 | |
| The attorney. | 01:46:27 | |
| Our city clerk. | 01:46:29 | |
| Our city manager. | 01:46:31 | |
| They are all the focus of this and I brought this to say. | 01:46:32 | |
| Could Orem City and you're right, Mayor the. | 01:46:35 | |
| The state is not. There is no code. I contacted them and they said. | 01:46:39 | |
| I can see the conflict of interest. | 01:46:43 | |
| In this and maybe it does need to be arbitrated at the state. | 01:46:46 | |
| I have no problem with that, but. | 01:46:50 | |
| I will not have the subject. | 01:46:52 | |
| Of who this is investigated the Muhammad's. | 01:46:54 | |
| Reviewing me because I know. | 01:46:58 | |
| I had a good idea. | 01:47:00 | |
| As he was behind the fake accounts. | 01:47:02 | |
| OK. Thank you. | 01:47:05 | |
| Fret. | 01:47:06 | |
| And the only thing I want to say is. | 01:47:12 | |
| I find. | 01:47:15 | |
| Fake accounts and. | 01:47:16 | |
| Harassment like that? | 01:47:18 | |
| I don't understand. | 01:47:20 | |
| Why anybody? | 01:47:21 | |
| Would do it. | 01:47:22 | |
| But as it relates to the grandma with the documents in front of us. | 01:47:25 | |
| I have no. | 01:47:29 | |
| No additional. | 01:47:30 | |
| OK, Marty or Sarah? | 01:47:33 | |
| I just, I appreciate all the work that's gone into this. | 01:47:40 | |
| And we'll take the time to go through it. | 01:47:44 | |
| I I also don't. | 01:47:47 | |
| I mean, I'm not really. | 01:47:49 | |
| Social media savvy so I can't really comprehend somebody having more than. | 01:47:50 | |
| One account. | 01:47:54 | |
| Put a lot of fake account so. | 01:47:55 | |
| So and again. | 01:47:57 | |
| Totally inappropriate to threaten people or make you feel unsafe in your home own home. | 01:47:59 | |
| That's nobody. Nobody would. | 01:48:03 | |
| Condone that so. | 01:48:07 | |
| Anyway, but thanks for all your work and. | 01:48:09 | |
| Can you see me? | 01:48:15 | |
| It looks like. | 01:48:20 | |
| I I don't really have any comments on this either. | 01:48:25 | |
| I've seen fake accounts used. | 01:48:29 | |
| And specifically recently. | 01:48:33 | |
| Fake account. | 01:48:35 | |
| Said that they were my supporter and then they started making racing. | 01:48:37 | |
| Racist comments. | 01:48:40 | |
| So I wonder. | 01:48:41 | |
| Was that someone that was against me, that was trying to make me look like a racist? | 01:48:42 | |
| But I didn't really go in to do any research just because I feel like those are really hard to. | 01:48:48 | |
| Right out and it's not worth my time. I think people understand. | 01:48:53 | |
| That thank you councillor. Fake accounts. | 01:48:58 | |
| But I agree that. | 01:49:00 | |
| Having them come. | 01:49:02 | |
| Threaten you and make you feel uncomfortable. | 01:49:04 | |
| Not OK. | 01:49:06 | |
| Just like some of the things I've read, it seems like there has been some misunderstandings. | 01:49:07 | |
| But also, you know. | 01:49:11 | |
| I need to spend more time. | 01:49:13 | |
| Really looking through this. | 01:49:15 | |
| And, umm. | 01:49:17 | |
| Yeah, that's it. | 01:49:21 | |
| All right, and thank you. | 01:49:23 | |
| Pam and can I make one clear? | 01:49:25 | |
| So I. | 01:49:29 | |
| I want to back away from any. | 01:49:30 | |
| This version that what this presentation is an allegation or targeted at anybody. | 01:49:32 | |
| This is follow up from the last council meeting. | 01:49:38 | |
| And the topic that was brought up, it was a. | 01:49:41 | |
| Something we were tasked with putting together and then reporting on. | 01:49:43 | |
| There is. | 01:49:47 | |
| Nothing in. | 01:49:48 | |
| This slide that is an allegation. It is simply. | 01:49:50 | |
| These are the things that were provided to the requester. | 01:49:54 | |
| There are three categories of things. | 01:49:57 | |
| Where Councilmember Holloway has indicated that no records exist, I think he confirmed that. | 01:49:59 | |
| During what he just said. | 01:50:05 | |
| That those records don't exist. | 01:50:07 | |
| And the contents of the Google Drive, I think he explained. | 01:50:09 | |
| That they weren't provided because apparently they don't exist either. | 01:50:13 | |
| Like I went back into Google, I emailed them and said. | 01:50:19 | |
| If I sent a drive to use it and then deleted the folder. | 01:50:22 | |
| Like when it, when it. | 01:50:26 | |
| Build up. Can you go back? And they're like, no, you can't. I'm like oh, OK, well. | 01:50:27 | |
| I just to prove like this is the number link that was used but like. | 01:50:31 | |
| I know. | 01:50:36 | |
| And then we're talking about multiple Zoom meetings over a year. So we're, I mean. | 01:50:37 | |
| We're talking, you know, there's 100 pages in here. | 01:50:42 | |
| OK. I'm going to go ahead and take some time and then we're going to close up this discussion. | 01:50:46 | |
| I want to review that. | 01:50:53 | |
| Jamie mentioned it. | 01:50:56 | |
| But you did ask. | 01:50:57 | |
| Myself and the Council to review this and see if we could intervene. | 01:50:59 | |
| That is why I brought it before the Council and the public, to make sure that we truly understood the timeline that was presented. | 01:51:04 | |
| I think that's important. | 01:51:13 | |
| Secondly, I think it's important as we look through the slides and they're available to the public. | 01:51:14 | |
| For the public to know that I am not a grandma officer. | 01:51:19 | |
| And naturally, I don't review them. | 01:51:22 | |
| There were some allegations that said there's fake accounts. | 01:51:25 | |
| By executive. | 01:51:29 | |
| People in charge of this. | 01:51:30 | |
| I've seen all over Facebook that I have so many fake accounts thorough Searle was even. | 01:51:32 | |
| Me at some point, but she's actually a royal citizen, so. | 01:51:38 | |
| Very appalling. | 01:51:42 | |
| That you were attacked. | 01:51:43 | |
| By people. | 01:51:46 | |
| Who if they were real or fake? | 01:51:47 | |
| There, it's not justified. | 01:51:51 | |
| I would say that the. | 01:51:53 | |
| Records as I review them. | 01:51:56 | |
| We're about multiple stories. | 01:51:59 | |
| Over a long, expansive amount of. | 01:52:01 | |
| Time and they weren't really about the people that were reviewing the grammar records. | 01:52:03 | |
| Rather, they were targeted specifically at me and a few others, but. | 01:52:09 | |
| Nothing really that would provide a conflict for interest. I think one of the things that you mentioned that I want to make sure | 01:52:14 | |
| the public knows is. | 01:52:17 | |
| One of your biggest concerns? | 01:52:20 | |
| Was that it would. | 01:52:23 | |
| It was being blocked. | 01:52:24 | |
| And we know that it was turned over before. | 01:52:26 | |
| July 23rd in June, what you did provide and then? | 01:52:29 | |
| As soon as your records were sent. | 01:52:33 | |
| We know that they continue to be offered to the requester, so you can be rest assured that there's no conflict. Everything that | 01:52:35 | |
| you shared is before you. | 01:52:40 | |
| If you want to go through it and make sure that nothing was blocked. | 01:52:45 | |
| And that would be the reason for a conflict of interest and that everything went through the proper process. | 01:52:48 | |
| It is before you. | 01:52:53 | |
| Last meeting we talked about how. | 01:52:55 | |
| We don't want to miss steps in the process and Jamie articulated, I think very clearly. | 01:52:58 | |
| That everything was done in a written format. | 01:53:04 | |
| Grandma does. The grandma law does. | 01:53:07 | |
| Account for these things and talks about the process and our residents can look through them. | 01:53:10 | |
| Like I mentioned, I did talk to the Ombudsman and she presented the law. | 01:53:16 | |
| We do have it and so and I presented it to you which was 63G-2-0. | 01:53:20 | |
| 204. | 01:53:26 | |
| One a #3 that was particularly mentioned about mediation, but the entire. | 01:53:28 | |
| The entire statute. | 01:53:35 | |
| Talks about roles. | 01:53:37 | |
| Responsibilities. | 01:53:39 | |
| How and when the investment can get involved? How we do grandma what? | 01:53:41 | |
| Records Office is in charge of when it talks about. | 01:53:46 | |
| How things are processed and how things. | 01:53:49 | |
| Are done. The great news is what Jamie explained at the beginning. | 01:53:52 | |
| Or I mean at the end. | 01:53:57 | |
| Of the presentation that was done in the beginning. | 01:53:58 | |
| Is that? | 01:54:02 | |
| There is a process for. | 01:54:03 | |
| And if you do. | 01:54:05 | |
| Present your case. You can go through that at that time and experience mediation. | 01:54:07 | |
| And then I would say. | 01:54:11 | |
| While we have. | 01:54:14 | |
| Well, we can talk about that in the future, but I think that. | 01:54:16 | |
| Some of the things you may want to go back. | 01:54:20 | |
| Through and review some of your. | 01:54:22 | |
| Your records it was shown that there was a potential Google Drive. | 01:54:24 | |
| Record. | 01:54:30 | |
| Accessible during the time of the request. | 01:54:32 | |
| So it might be that you. | 01:54:36 | |
| You missed it, but I think that's important to talk about. | 01:54:38 | |
| At this time, the Council. | 01:54:41 | |
| Through all the commentary that has gone on. | 01:54:44 | |
| Has not. Has no need to make an action on this, so I'm going to go ahead and close this item. | 01:54:46 | |
| And, umm. | 01:54:52 | |
| Further and let us. | 01:54:53 | |
| Let it go back through the. | 01:54:54 | |
| The regular process that it's been going through and then. | 01:54:56 | |
| If we have any further questions. | 01:55:00 | |
| In the future, we can come back to that. | 01:55:02 | |
| We do have a closed session request that needs to go through which is. | 01:55:04 | |
| Discussion of character, professional competence, or physical or mental health of an individual and Jake at this time. | 01:55:09 | |
| Because I think we've all gotten equal footing and time. | 01:55:15 | |
| I'm not going to allow for more conversation on this. | 01:55:19 | |
| But umm. | 01:55:23 | |
| Like I said, if there is something that you feel is amiss as you review the documents. | 01:55:24 | |
| Please come back at that time. | 01:55:29 | |
| So I need a motion to go into a closed session as soon as we close this. | 01:55:30 | |
| I just need to know if. | 01:55:34 | |
| That subject is a matter of me and my family. | 01:55:37 | |
| What I wasn't told about doing a closed door session, so if it's about. | 01:55:42 | |
| The conduct of me? Oh, no. | 01:55:48 | |
| It's the discussion of character, professional competence, or physical or mental health of an individual. | 01:55:50 | |
| I need a motion to go into that closed session right after this meeting closes. | 01:55:56 | |
| Thank you, Sarah. I got her first. Can I get a second? | 01:56:01 | |
| Oh. | 01:56:08 | |
| I'm sure talking. | 01:56:10 | |
| I have a clarification real quick. | 01:56:12 | |
| Can we ensure that this grammar and all the contents are part of the meeting records so that the citizens can go access? | 01:56:14 | |
| Yeah, it will be when it would. | 01:56:22 | |
| When we put it together and send it to the city, Recorder was with the. | 01:56:24 | |
| The intent that it would be included in the. | 01:56:28 | |
| End the meeting record. | 01:56:31 | |
| OK, I moved to go into a closed session immediately following the City Council meeting in the City Council chambers. | 01:56:33 | |
| For a discussion. | 01:56:41 | |
| For a discussion of the character, professional competence, or physical or mental health of an individual. | 01:56:44 | |
| All right, we have a first by Sarah. Could I get a second? | 01:56:49 | |
| Second. Second by Brett, all in favor. | 01:56:53 | |
| Just kidding. Roll call. | 01:56:57 | |
| I, Marty. | 01:56:59 | |
| Hi, Brett. | 01:57:01 | |
| Sarah. | 01:57:04 | |
| All right. Thank you so much for coming. This meeting has been adjourned. | 01:57:05 |
