All right. Thank you so much for joining us tonight. Today is June 25th. 00:01:00
2025 the time is. 00:01:05
605 and we're going to start our Redevelopment Board agency meeting. 00:01:08
We will start out with an invocation in the Pledge of Allegiance by Councilmember Clawson. 00:01:12
And then we will move on to our agenda. 00:01:17
Our Father in heaven, we're grateful that we can be gathered. 00:01:22
Evening as a. 00:01:26
City to discuss the business of the city and. 00:01:27
We ask that we can be mindful of the. 00:01:29
As we have spirited discussions. 00:01:33
And this we pray in the name of Jesus Christ, Amen. 00:01:36
Hey, man. 00:01:39
All right. 00:01:41
I pledge allegiance to the flag. 00:01:44
The United States of America. 00:01:47
And the scenery public for which it. 00:01:49
One nation under God. 00:01:52
Indivisible with liberty and justice for all. 00:01:54
All right. On our agenda today, we have some minutes from our last meeting. 00:02:03
I just need a motion to approve those. 00:02:09
Minutes. They're on our consent agenda. 00:02:13
So moved. All right. I have our first by Brett. Can I get a second? 00:02:20
Second. Second by Sarah. All in favor. 00:02:24
Aye. 00:02:27
Aye. 00:02:29
That passed. 00:02:30
That brings us right into our public hearing. 00:02:31
Amending the Vineyard RDA fiscal year 2024-2025 budget. 00:02:33
Amendment Resolution U2024-03 in our RDA Director, Josh Daniels will. 00:02:39
Present this item. 00:02:45
So this item is the amended. 00:02:52
Fiscal year budget. 00:02:54
So by the end of the fiscal year, which ends at. 00:02:55
In June 30th. 00:02:58
We always sort of do one final amendment. 00:03:00
To show some of the actual. 00:03:04
Changes that occurred during the year. 00:03:07
Let me bring up our budget document. 00:03:10
There aren't significant changes. We've had a couple other. 00:03:15
Amendments. Umm. 00:03:18
While you are waiting, I'm going to go ahead and put us into a public hearing. Can I get a motion to go into a public hearing? 00:03:33
Thank you, Marty. Can I get a second? 00:03:39
2nd, thank you, Brett. All in favor. 00:03:42
Aye. 00:03:44
Caring. 00:03:46
And the the budget schedule for this amended budget is also. 00:04:19
In the. 00:04:23
In the agenda as an exhibit. 00:04:24
Josh, are you pulling anything up or should we leave? 00:04:29
I'm trying to pull up the the budget schedule. 00:04:34
OK. 00:04:37
Trying to get this thing down. 00:04:43
Watch the. 00:04:45
There we go. 00:05:06
Actually, there we go. 00:05:26
OK. 00:05:30
All right. Thank you. So this is the. 00:05:34
Fiscal year ending 2025. 00:05:36
Final budget, you know. 00:05:39
And this the budget amendment would adopt. 00:05:41
These final numbers. 00:05:44
There wasn't any changes to the property tax increment revenue. 00:05:45
There were some changes with the way that we characterize the fund balance. 00:05:49
And and then the. 00:05:53
The expenses are the same, it's just. 00:05:58
Really the. 00:06:01
The way the fund balance. 00:06:02
And the grant revenue? 00:06:04
Are being accounted. 00:06:05
OK. 00:06:08
Are there any questions or? 00:06:10
Comments from the public today. 00:06:12
That we can hear. 00:06:15
Remember to come up to the podium, state your name and you have two minutes. 00:06:21
Which panel will put on the screen for you? 00:06:25
My name is John Barrick. I am here to talk about the letter you received from the State Auditor's office last week that you 00:06:28
responded to. 00:06:32
I am an ASD taxpayer, Mr. Bear. 00:06:37
Does this specific item relate to? 00:06:40
Document that we're looking at right now, I believe the letter from the state auditor asked you to restate your financial 00:06:45
statements, including this year. 00:06:48
So I think it does right, OK. 00:06:52
Is that not? 00:06:54
OK. I just wanted to make sure that what you were talking about was for this item so that we could. 00:06:55
Make sure that we're addressing. 00:07:00
What was on the table? Well, I think I am. I mean you're talking about your fiscal year budget and you gave out tax increment and 00:07:02
I think that. 00:07:05
As the state auditor directed you with, I think I was probably right that T20009-01 requires that you have the taxing entity 00:07:09
committee to meet in any year in which you get tax increment, which it includes last year. 00:07:15
And you haven't done that yet. 00:07:22
So that probably puts you outside the law. 00:07:23
Is that your comment? 00:07:27
Do you have any other questions? That's not my comment, I'm just wondering if you think it's a. 00:07:28
Appropriate to discuss this now or you want me to wait till the next? I don't know if you feel this is. I wanted to make sure it 00:07:32
was on the right agenda item. 00:07:35
Please continue. 00:07:38
Well, according to the auditor, state auditor, Vineyard failed to report more than 35 million in transactions from 2018 to 2025. 00:07:41
And you're the board that approved that? 00:07:46
So those payments included substantially and potentially concealed sums to developers. 00:07:51
Involved in Utah City and other RDA projects. 00:07:57
This is not a clerical error. 00:08:00
This is a failure of basic public accountability. 00:08:02
That is a failure of basic. 00:08:05
Public accountability, like I mentioned, it raises questions about whether these funds were spent properly, transparently and in 00:08:07
the public interest. 00:08:11
And I'm wondering what you're going to do about it. 00:08:14
I would like you to publish a full list of all developers and businesses who received RDA funds. 00:08:17
In 2025 and in the prior seven years that you're required to restate. 00:08:22
I would like to know their names. 00:08:26
Who received them? Broken down by year? 00:08:28
I would like you to disclose the name of all city employees and officials. 00:08:31
Who involved were involved in failing to report the transactions? 00:08:35
And if anyone will be disciplined? 00:08:39
Maybe just for a few seconds because I interact with some of this time. 00:08:47
Go ahead, I'm wondering. 00:08:53
What you're going to do to reduce the unilateral spending threshold that you were criticized from by the state auditor? 00:08:56
Vineyards RDA was created to clean up Geneva Steel the contamination. 00:09:02
Not to become a vehicle for secret developer payments. 00:09:06
Payments and unchecked. 00:09:09
Discretion. It's not to steal. 00:09:11
Money from schoolchildren. 00:09:14
And I believe all of those things have been. 00:09:15
Done as. 00:09:17
Mr. Holdaway has told you. 00:09:18
So I'd like to know what you would like to do about it. Thank you. 00:09:20
Thank you for your comment. 00:09:25
Hi Daria Evans, Villas Vineyard resident. Thank you for letting me. 00:09:32
Ask question. 00:09:37
I'm on my Internet vineyard portal. 00:09:39
Clerk com. 00:09:42
And. 00:09:44
My information says the fiscal impact. 00:09:46
It's different from what's up there, so I want to know what is different. 00:09:49
Mine says the RDA fund has $12,226,269. 00:09:54
With revenues of 24. 00:10:00
1,061,739 Fund balance appropriation. 00:10:04
With the total expenditure and transfer out of 36,288,000. 00:10:09
And $8 so I would like to have an explanation. 00:10:15
Of why what was on the Internet is different from here. 00:10:20
Thank you very much. 00:10:23
Thanks, Dia. 00:10:26
Any other comments? 00:10:34
So all right, seeing that there are none, we'll go ahead and. 00:10:37
Exit the public hearing. 00:10:41
You need a motion to go out of the public hearing. 00:10:43
So moved all right, add a first by Marty. Can I get a second? 00:10:46
2nd. 00:10:50
Second by Brett all in. 00:10:51
Aye, all right. We're now out of the public hearing. 00:10:53
Aye, all right. 00:10:56
Board, does you have any questions? 00:10:58
Do we want to start with questions from the board? Is there anything that you would like to address so far? 00:11:02
Before questions from the board. 00:11:06
We you. 00:11:08
Will you explain to me the grant revenue change versus the? 00:11:11
Which is why the numbers were moved. 00:11:16
Yeah, I believe that has to do with. 00:11:18
The Rail Rail grant. 00:11:21
Maybe, yeah. 00:11:24
That's that's the rail grant. 00:11:25
So for rail realignment? 00:11:28
For Union Pacific. 00:11:30
We just didn't receive the same amount of grant revenue for this particular year that we thought we would for that project. 00:11:33
OK. Any other questions from the board? 00:11:40
All right. We will be discussing the audit findings. 00:11:48
And you'll have more answers in the next meeting. So I just wanted to give you a heads up on that. 00:11:51
All right at this point. 00:11:57
Can I get a motion? 00:11:59
I move to adopt resolution U2025-03. 00:12:09
The Vineyard RDA, fiscal year 20. 00:12:14
2025 budget amendment as presented by staff. 00:12:17
Excellent. We have a first price, Sarah. 00:12:20
OK. Did you say 03 or 04? 00:12:22
Right here. 00:12:27
OK. 00:12:28
Sorry, that's OK. 00:12:31
Thank you. 00:12:33
Can I get a second? 00:12:35
2nd. 00:12:38
All right, a second by Marty. 00:12:39
I'm going to do this by roll call. 00:12:41
Say no, Pratt. 00:12:42
Aye, aye, Marty. 00:12:45
Aye, Sarah, aye. 00:12:47
Right. 00:12:48
Carried. Let's go ahead and move on to. 00:12:50
4.4 Discussion and action final fiscal year 20252026 RDA budget. 00:12:53
Resolution U202504. 00:13:00
Go ahead, Josh. 00:13:04
Great. So this is next year's budget, fiscal year 2026. This is the budget schedule. 00:13:05
This, of course, you have the tentative budget hearing earlier. 00:13:11
With the hearing. 00:13:15
And this is the hearing item for. 00:13:16
For the well, sorry, they won't be hearing for this one. 00:13:21
This is discussion in action. 00:13:23
Already had a budget hearing. 00:13:24
The hearings take place before the action. 00:13:26
Here that I've got up on the screen is the fiscal year 26 budget. 00:13:29
So next year. 00:13:34
I think that might have been. 00:13:35
The comment about the discrepancy that might have been just looking at one year versus the other, so there's. 00:13:37
Just to be clear, there's two different budgets on today's agenda. 00:13:42
There's the final budget for the year that's ending right now, and now this is next year's budget. So this was for fiscal year 26. 00:13:45
So here's the schedule. 00:13:54
As we talked about during. 00:13:55
Tentative budget discussions. 00:13:57
We're anticipating an increase in tax increment revenue because of the triggering of additional. 00:13:59
Parcels that are. 00:14:05
Are now finished developing that you. 00:14:06
I triggered the tax increment collection earlier. 00:14:08
And so. 00:14:12
Where the biggest change is. 00:14:14
Year over year are going to come from. 00:14:16
All right, Ward, are there any questions? 00:14:21
Do you have a question? 00:15:01
Why don't you just come up? We might not be able to answer it tonight, but go ahead and make your comment. 00:15:03
Tanya Evansville's Vineyard resident. 00:15:11
Again, this is another. 00:15:14
Question of my numbers here on. 00:15:17
On the civic portal are different from what is up on the screen. 00:15:20
For 2026. 00:15:24
The RDA fund is 22,000,937. 00:15:25
$1500 in total revenues. 00:15:29
With $11,271,091.00 for fund balance appropriation. 00:15:32
And then $34,000,208. 00:15:38
$208,591.00 in total expenditures and transfers out. 00:15:41
I would like to know why this is different from that also. 00:15:46
Thank you. 00:15:50
Astoria. 00:15:51
All right, Board, any questions? 00:15:52
I'm not sure if that's is you're looking at the staff report. 00:16:11
Or the budget schedule. 00:16:14
Sorry, I know it's not a back and forth, but it would be helpful just to be on the same page. 00:16:19
Right there. 00:16:26
OK, And this is more information background. This is the official budget schedule. Why don't you have the same? 00:16:28
Here here. 00:16:36
That's my question. I think it would be more appropriate if we assist include exactly what you're going to show. 00:16:39
So that's what we could be prepared. I don't ask some questions. 00:16:45
When I was still right here. 00:16:48
Just do you want to just explain it for the public? 00:16:52
Schedule. 00:16:58
All right. And that's the resolution points with the button schedule. That's a good question. 00:16:59
OK, so I think the question was about some. 00:17:05
Numbers that are summarized in the. 00:17:09
The background report. 00:17:11
And then they might not match just so just to be clear. 00:17:13
If there's an error. 00:17:16
We apologize for that. 00:17:17
The the official budget is this schedule. 00:17:18
So every time that we have budget actions on the agenda. 00:17:22
There will always be. 00:17:25
A resolution and a resolution is saying. 00:17:27
That we're adopting the attached schedule. 00:17:30
And then these are the budget schedules right here. So these are the official budget documents that are being adopted. So if 00:17:33
there's any. 00:17:35
Mismatching or typos or errors. 00:17:39
In any other. 00:17:42
Background. 00:17:43
Information that the official. 00:17:44
Budget schedule is is this schedule here? 00:17:46
When we're done adopting the official, do you go back and update those? 00:17:49
We could. 00:17:54
Is there a reason why we wouldn't? 00:17:55
It was a staff report. It's a summary of a staff report, so numbers may have changed so the original document so. 00:17:59
What what we're saying is we would not update the staff report. 00:18:06
The numbers have changed. These are official and of course we would post these publicly. 00:18:09
I hope that's clear. 00:18:13
OK. Sorry for the confusion on that. 00:18:15
All right, Board, do you have any other questions? Otherwise I need a motion. 00:18:17
Could you move your microphones closer to your mouth because I can't hear. 00:18:25
These guys and I've even got my hearing aids. 00:18:30
I thought I'm cranked up. I can't hear you guys. 00:18:33
Can everybody move their microphones closer to them so that our audience can hear you a little bit better when you're speaking? 00:18:38
Remember to pull it close. 00:18:42
And speak into it. 00:18:45
And you'll feel really loud. 00:18:47
But then you know it's right. 00:18:49
All right, Board, I need a motion or question. I move to adopt resolution new 2025-0 for the Vineyard RDA fiscal year 2025 Dash 00:18:51
2026 budget as presented by all right, we have a first by Marty. Can I get a second? 00:18:59
Second Second by Sarah. 00:19:07
The system by roll call. 00:19:09
Jake. 00:19:11
Aye. 00:19:14
Aye, Sir, aye. 00:19:16
All right, that brings us to the close of this meeting. Is there any? 00:19:17
Anything else that we are discussing or? 00:19:22
Do we need to go? 00:19:25
To the next meeting to go into any closed sessions. 00:19:27
I do have one informational item as a follow up from the last meeting I'd like to share. 00:19:29
Thank you. So at the last meeting there was lengthy discussion about? 00:19:33
Annual tech meetings, those commented again today. 00:19:37
I just wanted to. 00:19:41
Officially apologized to you and Mr. Barrack for issuing an. 00:19:42
Erroneous memo that had errors in it. 00:19:45
We did try to respond quickly to the questions raised several weeks ago about annual meetings. 00:19:48
And in haste. 00:19:53
Created. 00:19:54
Some answers and and. 00:19:55
There were errors. 00:19:57
Didn't follow the normal process and get. 00:19:59
Our attorneys review. 00:20:02
Of that memo and so. 00:20:04
We wanted to apologize for. 00:20:05
Giving you that. 00:20:07
Error and rescind the memo. We did some more research looking at 20 years of state code. 00:20:08
What we found was that. 00:20:15
In 2009, when the Taxing Entity Committee was first formed. 00:20:17
State law had a requirement the taxing entity committees. 00:20:21
Meet annually for informational purposes. 00:20:24
And that's why that. 00:20:27
Language was in the founding resolution. 00:20:28
State law was then changed in 2011 to create an option for RDA's to issue. 00:20:31
Annual informational reports. 00:20:36
Instead of having meetings. 00:20:38
And our understanding is that's why. 00:20:40
There weren't annual meetings that took place after the last. 00:20:43
Official tech meeting in 2011. 00:20:47
So the RDA issued annual reports. 00:20:49
That would be filed with the county auditor starting in 2012. 00:20:52
That continued until. 00:20:56
2021 Those reports are available online currently to the public on the county auditors website. 00:20:58
And then? 00:21:05
More recently in. 00:21:06
About 2020 they changed the law again. 00:21:07
Requiring Rdas to issue annual. 00:21:10
Informational data reports to the Governor's Office of Economic Opportunity. 00:21:12
Those reports are also online. There's a data portal. 00:21:16
On the Go EO website. 00:21:20
Where you can see the last three or four years of those reports. 00:21:22
Ports since that began in 2022. 00:21:25
And by the way, working on. 00:21:28
An RDA section of the city website where all those reports will also be. 00:21:30
Listed and linked. 00:21:35
But they are publicly available now and the county auditor's website. 00:21:36
And on the Governor's Office of Economic Opportunity website. So. 00:21:39
I want to rescind that memo that was made in error. We wanted to be hasty in responding to Mr. Baird's questions. 00:21:42
We now have more information, just wanted to apologize for that. 00:21:48
OK. Thank you. 00:21:52
Thank you for your question and for that clarity. 00:21:54
I'm going to adjourn this meeting and then we will. 00:21:59
Start our next meeting in a few minutes, as soon as we. 00:22:03
Switch over the recording. 00:22:06
Second meeting is adjourned. 00:22:10
