A resolution that we would then, then see what else is on that list there that we, we don't have this covered, that we need to 00:15:44

Where we as a city, we get our essentially authority to enact land use laws. 00:16:39
Very important to understand these. 00:16:44

As it relates to zoning. 00:16:47
I also do want to preference so that I am not a land use attorney either, so I don't have that, you know, knowledge. But if you 00:16:49

So here's just a few of the different sections of blood mide. 00:17:01

So very briefly, when we receive an application in the planning office here. 00:17:16
Our first act is to deem what type of use that that application is. So we have permitted uses, conditional uses, temporary uses. 00:17:21
And then we have non permitted uses. 00:17:29
If it's a permitted use, it's a very simple process. Generally speaking, we have an example as a single family home. 00:17:31
It's either handled through our office itself, like if it is a single family home, we'll just approve it. 00:17:37
If not, there's certain circumstances like commercial or multifamily. 00:17:43
That does require a. 00:17:48
Planning Commission approval. 00:17:49
It's very important to understand that the permitted uses are allowed by rights. 00:17:51
And that there can be no subjective judgment in the. 00:17:55
They're ruling up the decision for this type of use. 00:17:58
Conditional use. We are able to add some conditions to an approval. 00:18:01
The one example I have here is the Mr. Carwash that was built off of Geneva Rd. As you notice, if you leave that tunnel carwash, 00:18:07
there's a large, I think a nine foot tall retaining wall. 00:18:12
That we required them to build to prevent the sound from coming and spilling over into the neighboring residential. So as part of 00:18:17
our review, we said we're worried about the sound of a car wash. 00:18:21
Can you conduct a study to show how the sound of the carwash will impact that the neighboring residential? They came back showing 00:18:26
that it would. 00:18:30
And that's where we came up with this wall to help. 00:18:35
Prevent that and I. 00:18:36
Don't think we've gotten any complaints about the car wash because of. 00:18:37
You know these conditions that we placed on the property. That being said, we cannot restrict a use. If it is a conditional use, 00:18:40
we cannot say. 00:18:44
Outright, you are not allowed to do this. We have to be reasonable in our discretion. 00:18:48
And the conditions we impose the last one temporary use. 00:18:54

David asked me to talk kind of a bit about what our zoning practices are. 00:19:05
Essentially we have two zoning code books that we go off of. We have the the Vineyard zoning code. 00:19:10
That outlines kind of. 00:19:15
Most properties in Vineyard. 00:19:16
Creates a standard. 00:19:18
In terms of like building high or density? 00:19:19
Uses and stuff like that. 00:19:22
And it provides the authority of the city planner, the Planning Commission and the appeal authority. 00:19:24
Then we also have the special purpose zoning district code books that we rely on. 00:19:29
For specific properties. 00:19:33
So this is, you know, downtown Vineyard or Utah City. 00:19:35
The Forge. The RMU Regional mixed-use Waters edge, Geneva Rd. mixed-use holdaway fields. 00:19:38
Generally, when a development comes in and they want to. 00:19:44
And then they have a more complex development. That's one. 00:19:48
Method that we can go through as a city. 00:19:50
To create standards for that type of development and that's what we've done with these specific. 00:19:53
Properties here. 00:19:59
And so. 00:20:02
The one circumstance is. 00:20:03
If a developer brings a project to the city and it can't fit into any of these zones, or they have. 00:20:04
That they're not able to meet our height restrictions or something like that. There's a few options they can go through. They can 00:20:11
try to change the the code itself. 00:20:14
They could do a rezone or another option as a development agreement and this is where they can negotiate or bargain with the city 00:20:19
saying we want to see or we want increased height. 00:20:23
In return will give you. 00:20:27
You know. 00:20:28
Whole myriad of options like more open space or whatever it may be. 00:20:29
But one thing I did want to know as it reflects to these resolutions that that were discussed last week, is, is the state does 00:20:34
prohibit a city. 00:20:37
To require a development agreement if the property meets zoning if it's a permitted use. 00:20:41
And they meet all of our all of our standards. We cannot require them to enter into a development agreement with the city. 00:20:46
Very clear in state law on that. 00:20:53
What the one example I have on here is Topgolf and the additional density for the arm youth. So when X development came into the 00:20:56
city. 00:20:59
With the yard, they said, hey, we're going to bring you a large golf entertainment anchor. 00:21:03
But in return, we want to see increased density. The RMU I think was capped at like 3000 residential units or 2000 or something 00:21:08
like that. 00:21:12
And in return, the city said if you can bring us this large anchor, that's going to bring in a lot of sales and property tax. 00:21:15
We will allow you to have, I think an additional like 370 units or something like that to the RMU. 00:21:20
And so that's now how we govern that site specific standard is through this development agreement that was signed between US and 00:21:26
the developer. 00:21:29
So SB 284. 00:21:34
In my brief review looking through the the Urban Land Institute of Utah as well as the Utah League of Cities and Towns, there are 00:21:36
some things that the city does need to make sure that we are in compliance with. The first one is that we must post our fees and 00:21:41
complete application checklists online. 00:21:46
We do have that already through our consolidated fee schedule and our zoning code. We could make that more legible and easier to 00:21:51
find by posting on our website and we we have no issue doing that. I think we have until October 1st to come into compliance with 00:21:55
that. 00:21:59
There are some regulations about planning commissions. 00:22:04
They have to act in timely matter. They can't keep continuing an item to essentially kill the item. 00:22:07
An applicant does have the right. 00:22:12
From SB-284 to appeal to the City Council for the Planning Commission will not act. 00:22:14
There's some new restrictions on third parties and and how they can challenge a land use law. So generally the the state only 00:22:19
wants an applicant or the city to be able to. 00:22:24
Challenge an issue. 00:22:29
It removes legislative bodies as the appeal authorities and right now there are some some instances in our code where it does say 00:22:31
that the City Council acting as the appeal authority and we. 00:22:36
I'll need to sit down and work with our attorney to make sure that we can clarify. 00:22:40
If it's not the City Council, is that going to our administrative law judge or whoever that might be? 00:22:45
There is some additional Planning Commission training requirements that we need to implement into our code, and then there's some 00:22:51
updates to the. 00:22:54
Detached Adu requirements which I believe we already meet the standards on. 00:22:57
So that's all SB-284 for my understanding with land use is is related. 00:23:00
And so that's what we've gleaned from it. 00:23:06

To go over these with the resolutions that were presented to staff, I do have some comments I sat down with with Naseem and in our 00:23:11

Especially when we're looking at state code interpretation, we want to make sure that. 00:28:25
We are reading it the same way that the state intended to apply it. 00:28:28
And make sure that any resolutions that are passed. 00:28:32

That there's some things in here that we believe aren't implementation ready. There's dates in there that are that are messed up. 00:28:36
There's code references that need to be cleaned up. 00:28:40
And there's a lot of staff time that would be required to implement all of these that that we don't believe we have adequate. 00:28:44
Coverage to make that happen. 00:28:50
There's key enforcement mechanisms that may be constrained, so there's one or two of the resolutions talk about withholding 00:28:53
certificates of occupancy. 00:28:57
And that is very much so regulated by the state and we need to make sure that if we are implementing anything stricter than the 00:29:01
state that we're OK there. 00:29:05
But our building department did flag a few issues on that. 00:29:09
Utility capacity requirements introduce risk. So this is 1. I think some of the requirements we're asking for developers to bring 00:29:14
in letters from utility companies saying that they can provide. 00:29:20
Adequate utilities to the site and we already kind of do that through the planning process. I don't know if the scene wanted to 00:29:26
add in anything else about the utilities and phasing, but but we already do review all of that through the site planning process. 00:29:31
We we make sure that that. 00:29:36
You know the site's going to have power when they. 00:29:41
You know, want their certificate of occupancy. So we we just felt that that wasn't not necessarily needed. 00:29:44
Application requirements exceed typical development stage, so there are some things that just. 00:29:52
Kind of flips the order in which we do our review on stuff, so it would have us. 00:29:57
Doing stuff that is typically done either during the land disturbance permit stage or the building permit stage. 00:30:00

Before we go through site plan and it's necessary to go through site plan. 00:30:07
Or a pre application meeting. 00:30:11
Frankly, before we get to those other. 00:30:12
Development stages. 00:30:16
And then I think the last one is a significant operational resource impact. So a lot of these requirements were adding a lot more 00:30:17
review to any application, so something like. 00:30:23
Fiscal analysis. Traffic Impact analysis A. 00:30:29
School impacted analysis, All of these things require a lot of staff time to dedicate. 00:30:33
To ensure that those. 00:30:37
Are first of all that they're accurate that the developers not just submitting a paper saying, yeah, we have enough. 00:30:39
Schools for our kids or whatever, you know, we want to make sure that they're. 00:30:44
Good, good documents and we didn't feel that as staff we have enough resources as is. 00:30:48
To ensure that we could comply with. 00:30:53
Those requirements. 00:30:56
And so those are our. 00:30:59
Our initial comments. I did forward my comments and and building an engineering to. 00:31:00

Kind of get their feedback on and they can forward them onto the council. 00:31:07
But we definitely feel, I think. 00:31:11

Necessarily needed if the council has a request or they're concerned about a state law or something like that, we do have 00:31:26

So that staff can work on those things and make sure that we're compliant with stuff and that we are staying ahead of the game and 00:31:34
that we're making sure that that developers aren't aren't taking. 00:31:38

I think that's one of those things is a lot of these resolutions could have been resolved by the council. 00:31:44
Requesting the mayor or the administrative director of the city manager when we hire one. 00:31:48
To work with staff on these things and that way we can stay ahead of the game more as staff. We're more than happy to work on 00:31:53
those things and and make sure that that we're protecting the city and the city's interests. 00:31:57

Yeah. So the the one of the resolutions did outline a few different topics and said make sure you have good definition on these. I 00:32:45

I think on all but one we had a pretty solid definition on OK. 00:32:52
But that being said, we as staff are more than happy to re examine our entire definition. 00:32:56
Section of code and make sure that we're crossing our T's and dotting our eyes on that and and compare it to best practices of 00:33:01

But but there were no red flags, essentially saying by May 6 the developer is going to get away with. 00:33:08
AB and C if we don't tighten up the definition, there was nothing like that. 00:33:14

we bring in or any new. 00:34:30
Requirements are objective based, they can't be subjective based, right. And so if we do say we want a fiscal impact analysis to 00:34:38
be part of the the complete application checklist, we need to make sure as a city we're outlining what we're looking for in that 00:34:43
analysis. 00:34:48
To ensure that we. 00:34:53
If we deny the application on the basis of an inadequate fiscal impact analysis, we can say. 00:34:54
The exact reason why we can't just say, oh, we don't like that, that this isn't going to provide us enough sales tax, so we're 00:35:00

They are permitted use. 00:35:07
They're allowed to build. We cannot deny because we don't like it. 00:35:09
Right. And so that's one thing that that. 00:35:12
Would be required if we do add any of these standards. Same thing with the the school study. 00:35:14

Our first act is to deem what type of use that that application is. So we have permitted uses, conditional uses, temporary uses. 00:17:21

If it's a permitted use, it's a very simple process. Generally speaking, we have an example as a single family home. 00:17:31
It's either handled through our office itself, like if it is a single family home, we'll just approve it. 00:17:37
If not, there's certain circumstances like commercial or multifamily. 00:17:43
That does require a. 00:17:48
Planning Commission approval. 00:17:49
It's very important to understand that the permitted uses are allowed by rights. 00:17:51
And that there can be no subjective judgment in the. 00:17:55
They're ruling up the decision for this type of use. 00:17:58
Conditional use. We are able to add some conditions to an approval. 00:18:01
The one example I have here is the Mr. Carwash that was built off of Geneva Rd. As you notice, if you leave that tunnel carwash, 00:18:07
there's a large, I think a nine foot tall retaining wall. 00:18:12
That we required them to build to prevent the sound from coming and spilling over into the neighboring residential. So as part of 00:18:17
our review, we said we're worried about the sound of a car wash. 00:18:21
Can you conduct a study to show how the sound of the carwash will impact that the neighboring residential? They came back showing 00:18:26
that it would. 00:18:30
And that's where we came up with this wall to help. 00:18:35
Prevent that and I. 00:18:36
Don't think we've gotten any complaints about the car wash because of. 00:18:37
You know these conditions that we placed on the property. That being said, we cannot restrict a use. If it is a conditional use, 00:18:40
we cannot say. 00:18:44
Outright, you are not allowed to do this. We have to be reasonable in our discretion. 00:18:48
And the conditions we impose the last one temporary use. 00:18:54

So this is, you know, downtown Vineyard or Utah City. 00:19:35
The Forge. The RMU Regional mixed-use Waters edge, Geneva Rd. mixed-use holdaway fields. 00:19:38
Generally, when a development comes in and they want to. 00:19:44
And then they have a more complex development. That's one. 00:19:48
Method that we can go through as a city. 00:19:50
To create standards for that type of development and that's what we've done with these specific. 00:19:53

The one circumstance is. 00:20:03
If a developer brings a project to the city and it can't fit into any of these zones, or they have. 00:20:04
That they're not able to meet our height restrictions or something like that. There's a few options they can go through. They can 00:20:11

They could do a rezone or another option as a development agreement and this is where they can negotiate or bargain with the city 00:20:19
saying we want to see or we want increased height. 00:20:23

But one thing I did want to know as it reflects to these resolutions that that were discussed last week, is, is the state does 00:20:34

With using our complete application checklist and and essentially what we do is we have a fairly basic checklist for a permitted 00:45:03
