| Guide us and direct us in the way that that would have us go. | 00:12:33 | |
| We're grateful for. | 00:12:36 | |
| All that many blessings, the way that was blessed us personally. | 00:12:37 | |
| And also as a community. | 00:12:40 | |
| Yes, that'll be with us now. In the name of my son, Jesus Christ, Amen. Amen. Thank you. | 00:12:42 | |
| I pledge allegiance to the flag. | 00:12:52 | |
| Of the United States of America. | 00:12:54 | |
| And to the Republic for which it stands. | 00:12:56 | |
| One Nation. | 00:12:59 | |
| Indivisible with liberty and justice for all. | 00:13:01 | |
| Awesome you do. | 00:13:05 | |
| Grab a pen. | 00:13:08 | |
| OK, got to snag one of those. | 00:13:09 | |
| That's all right. | 00:13:13 | |
| Passing down 10. | 00:13:15 | |
| Passing down the pin. OK, let's jump into Do we have any public comments today? | 00:13:16 | |
| Pete, you want to say anything? | 00:13:22 | |
| He's the only one. Pete's the only one. | 00:13:23 | |
| Public comments. | 00:13:25 | |
| You can. | 00:13:28 | |
| Again, I'm not sure if you do the public comment. | 00:13:29 | |
| Now or when you're doing the items, but happy to. | 00:13:33 | |
| All the happy to happy to do whatever. | 00:13:36 | |
| So on the SB 284 resolution. | 00:13:41 | |
| Pack. I don't know. | 00:13:45 | |
| I guess I'll reserve my. | 00:13:47 | |
| Comments to. | 00:13:48 | |
| After the discussion. | 00:13:50 | |
| Probably the same for. | 00:13:52 | |
| The hiring 3 advisors for the RDA board if that's OK? Yep, no problem. | 00:13:55 | |
| No problem at all. | 00:13:59 | |
| OK, let's do this. If we let's jump into this, I'm going to sign, we're going to do the business item, the mayor's proclamation | 00:14:01 | |
| for Arbor Day. | 00:14:05 | |
| So Arbor Day is April 24th. | 00:14:09 | |
| And I'm going to sign in. I have a proclamation here to. | 00:14:11 | |
| Officially proclaim. | 00:14:15 | |
| That day to be. | 00:14:17 | |
| The official Arbor Day in the city of Vineyard. | 00:14:20 | |
| And urge all residents to plant as many trees. | 00:14:22 | |
| I'm a landscaper. That's what I do privately, so I am a huge. | 00:14:24 | |
| First off, trees are amazing. | 00:14:29 | |
| Conflict of interest. | 00:14:30 | |
| I wouldn't go that far, right? I will say this though, when we talk about. | 00:14:32 | |
| Global warming and all this stuff. | 00:14:38 | |
| I've said this for years. | 00:14:40 | |
| Trees are one of the big answers to getting that fixed, so plant a lot of trees. | 00:14:41 | |
| Urgent residents to celebrate Arbor Day, supporting trees and protecting our wetlands so. | 00:14:46 | |
| I will. | 00:14:51 | |
| Sign this. | 00:14:52 | |
| DK do you want to take a picture of this or do we even care about a picture on this one? | 00:14:55 | |
| OK, sounds good. I will sign that. | 00:14:59 | |
| OK. So that is the business item we have for today. Do we need to do we need a vote or anything like that or it's just OK? | 00:15:01 | |
| Arbor Day. | 00:15:07 | |
| Everyone. | 00:15:09 | |
| Plant a tree. | 00:15:10 | |
| All right, let's jump to our work session. We'll start at 33.1. | 00:15:13 | |
| Discuss SB 284 and Resolution Pack. I'm gonna turn the time to David Larae. | 00:15:17 | |
| To lead out that discussion. So go ahead, David. Thank you. | 00:15:22 | |
| Yeah, so. | 00:15:25 | |
| As a as a result of our discussions last time, we've determined that we probably need to look into. | 00:15:26 | |
| Exactly what it is that we we do now with our. | 00:15:33 | |
| Current zoning code. | 00:15:36 | |
| And compare it to this compared to what's on this. | 00:15:37 | |
| What was on the initial? | 00:15:41 | |
| Organizing. | 00:15:43 | |
| A resolution that we would then, then see what else is on that list there that we, we don't have this covered, that we need to | 00:15:44 | |
| cover and so forth. And so I've asked, I've asked Cash Hansi if you would take a few minutes and, and give us a little report on | 00:15:49 | |
| what he's found about the differences. | 00:15:54 | |
| All right, let me get this sharing to teams as well. | 00:16:02 | |
| There we go. | 00:16:11 | |
| So just I have a few background slides to show the the council and the public hearing. | 00:16:15 | |
| Can be kind of up. | 00:16:20 | |
| Caught up to date with where we're at with our zoning and. | 00:16:21 | |
| Practices and application practices here in Vineyard. | 00:16:23 | |
| This right here outlines Ludma, or the Municipal Land Use Development Management Act. | 00:16:27 | |
| It's Title 10, Chapter 20 of the Utah State Code. | 00:16:32 | |
| I'd encourage anybody to to review these sections to understand. | 00:16:35 | |
| Where we as a city, we get our essentially authority to enact land use laws. | 00:16:39 | |
| Very important to understand these. | 00:16:44 | |
| These sections here. | 00:16:46 | |
| As it relates to zoning. | 00:16:47 | |
| I also do want to preference so that I am not a land use attorney either, so I don't have that, you know, knowledge. But if you | 00:16:49 | |
| have any questions about legality on stuff, I'd encourage you to reach out to Jesse Riddle on that. | 00:16:55 | |
| So here's just a few of the different sections of blood mide. | 00:17:01 | |
| Encourage you to look into and a lot of what SB 284. | 00:17:03 | |
| Reflects is. | 00:17:09 | |
| Changes to Ludma itself. | 00:17:10 | |
| So very briefly, when we receive an application in the planning office here. | 00:17:16 | |
| Our first act is to deem what type of use that that application is. So we have permitted uses, conditional uses, temporary uses. | 00:17:21 | |
| And then we have non permitted uses. | 00:17:29 | |
| If it's a permitted use, it's a very simple process. Generally speaking, we have an example as a single family home. | 00:17:31 | |
| It's either handled through our office itself, like if it is a single family home, we'll just approve it. | 00:17:37 | |
| If not, there's certain circumstances like commercial or multifamily. | 00:17:43 | |
| That does require a. | 00:17:48 | |
| Planning Commission approval. | 00:17:49 | |
| It's very important to understand that the permitted uses are allowed by rights. | 00:17:51 | |
| And that there can be no subjective judgment in the. | 00:17:55 | |
| They're ruling up the decision for this type of use. | 00:17:58 | |
| Conditional use. We are able to add some conditions to an approval. | 00:18:01 | |
| The one example I have here is the Mr. Carwash that was built off of Geneva Rd. As you notice, if you leave that tunnel carwash, | 00:18:07 | |
| there's a large, I think a nine foot tall retaining wall. | 00:18:12 | |
| That we required them to build to prevent the sound from coming and spilling over into the neighboring residential. So as part of | 00:18:17 | |
| our review, we said we're worried about the sound of a car wash. | 00:18:21 | |
| Can you conduct a study to show how the sound of the carwash will impact that the neighboring residential? They came back showing | 00:18:26 | |
| that it would. | 00:18:30 | |
| And that's where we came up with this wall to help. | 00:18:35 | |
| Prevent that and I. | 00:18:36 | |
| Don't think we've gotten any complaints about the car wash because of. | 00:18:37 | |
| You know these conditions that we placed on the property. That being said, we cannot restrict a use. If it is a conditional use, | 00:18:40 | |
| we cannot say. | 00:18:44 | |
| Outright, you are not allowed to do this. We have to be reasonable in our discretion. | 00:18:48 | |
| And the conditions we impose the last one temporary use. | 00:18:54 | |
| Simple examples of fireworks stand done. | 00:18:57 | |
| Through our planning department and our business licensing office. | 00:18:59 | |
| David asked me to talk kind of a bit about what our zoning practices are. | 00:19:05 | |
| Essentially we have two zoning code books that we go off of. We have the the Vineyard zoning code. | 00:19:10 | |
| That outlines kind of. | 00:19:15 | |
| Most properties in Vineyard. | 00:19:16 | |
| Creates a standard. | 00:19:18 | |
| In terms of like building high or density? | 00:19:19 | |
| Uses and stuff like that. | 00:19:22 | |
| And it provides the authority of the city planner, the Planning Commission and the appeal authority. | 00:19:24 | |
| Then we also have the special purpose zoning district code books that we rely on. | 00:19:29 | |
| For specific properties. | 00:19:33 | |
| So this is, you know, downtown Vineyard or Utah City. | 00:19:35 | |
| The Forge. The RMU Regional mixed-use Waters edge, Geneva Rd. mixed-use holdaway fields. | 00:19:38 | |
| Generally, when a development comes in and they want to. | 00:19:44 | |
| And then they have a more complex development. That's one. | 00:19:48 | |
| Method that we can go through as a city. | 00:19:50 | |
| To create standards for that type of development and that's what we've done with these specific. | 00:19:53 | |
| Properties here. | 00:19:59 | |
| And so. | 00:20:02 | |
| The one circumstance is. | 00:20:03 | |
| If a developer brings a project to the city and it can't fit into any of these zones, or they have. | 00:20:04 | |
| That they're not able to meet our height restrictions or something like that. There's a few options they can go through. They can | 00:20:11 | |
| try to change the the code itself. | 00:20:14 | |
| They could do a rezone or another option as a development agreement and this is where they can negotiate or bargain with the city | 00:20:19 | |
| saying we want to see or we want increased height. | 00:20:23 | |
| In return will give you. | 00:20:27 | |
| You know. | 00:20:28 | |
| Whole myriad of options like more open space or whatever it may be. | 00:20:29 | |
| But one thing I did want to know as it reflects to these resolutions that that were discussed last week, is, is the state does | 00:20:34 | |
| prohibit a city. | 00:20:37 | |
| To require a development agreement if the property meets zoning if it's a permitted use. | 00:20:41 | |
| And they meet all of our all of our standards. We cannot require them to enter into a development agreement with the city. | 00:20:46 | |
| Very clear in state law on that. | 00:20:53 | |
| What the one example I have on here is Topgolf and the additional density for the arm youth. So when X development came into the | 00:20:56 | |
| city. | 00:20:59 | |
| With the yard, they said, hey, we're going to bring you a large golf entertainment anchor. | 00:21:03 | |
| But in return, we want to see increased density. The RMU I think was capped at like 3000 residential units or 2000 or something | 00:21:08 | |
| like that. | 00:21:12 | |
| And in return, the city said if you can bring us this large anchor, that's going to bring in a lot of sales and property tax. | 00:21:15 | |
| We will allow you to have, I think an additional like 370 units or something like that to the RMU. | 00:21:20 | |
| And so that's now how we govern that site specific standard is through this development agreement that was signed between US and | 00:21:26 | |
| the developer. | 00:21:29 | |
| So SB 284. | 00:21:34 | |
| In my brief review looking through the the Urban Land Institute of Utah as well as the Utah League of Cities and Towns, there are | 00:21:36 | |
| some things that the city does need to make sure that we are in compliance with. The first one is that we must post our fees and | 00:21:41 | |
| complete application checklists online. | 00:21:46 | |
| We do have that already through our consolidated fee schedule and our zoning code. We could make that more legible and easier to | 00:21:51 | |
| find by posting on our website and we we have no issue doing that. I think we have until October 1st to come into compliance with | 00:21:55 | |
| that. | 00:21:59 | |
| There are some regulations about planning commissions. | 00:22:04 | |
| They have to act in timely matter. They can't keep continuing an item to essentially kill the item. | 00:22:07 | |
| An applicant does have the right. | 00:22:12 | |
| From SB-284 to appeal to the City Council for the Planning Commission will not act. | 00:22:14 | |
| There's some new restrictions on third parties and and how they can challenge a land use law. So generally the the state only | 00:22:19 | |
| wants an applicant or the city to be able to. | 00:22:24 | |
| Challenge an issue. | 00:22:29 | |
| It removes legislative bodies as the appeal authorities and right now there are some some instances in our code where it does say | 00:22:31 | |
| that the City Council acting as the appeal authority and we. | 00:22:36 | |
| I'll need to sit down and work with our attorney to make sure that we can clarify. | 00:22:40 | |
| If it's not the City Council, is that going to our administrative law judge or whoever that might be? | 00:22:45 | |
| There is some additional Planning Commission training requirements that we need to implement into our code, and then there's some | 00:22:51 | |
| updates to the. | 00:22:54 | |
| Detached Adu requirements which I believe we already meet the standards on. | 00:22:57 | |
| So that's all SB-284 for my understanding with land use is is related. | 00:23:00 | |
| And so that's what we've gleaned from it. | 00:23:06 | |
| And then I do have some comments if you wanted. | 00:23:09 | |
| To go over these with the resolutions that were presented to staff, I do have some comments I sat down with with Naseem and in our | 00:23:11 | |
| building department. | 00:23:14 | |
| To get some overarching comments on. | 00:23:18 | |
| Where we. | 00:23:20 | |
| Feel as a staff with. | 00:23:21 | |
| These resolutions, I'm happy to go into that now or if we want to kind of talk about what what I've already presented. | 00:23:22 | |
| Agree with that too. | 00:23:27 | |
| Have you had a chance to look at the water rights issues that were part of a 284? | 00:23:28 | |
| I I haven't, I don't really deal with water rights, so I'll. | 00:23:36 | |
| See if Nassim has any comments on that. | 00:23:39 | |
| Turn the time over to the seam. The seam. | 00:23:43 | |
| You can go ahead and answer that please. | 00:23:45 | |
| So can you hear me? | 00:23:47 | |
| Yeah, go ahead. Yeah. So in essence. | 00:23:49 | |
| In regards to that, I mean kind of follows the whole exactions portion where our exactions have to be. | 00:23:52 | |
| I have to. Can you hear me? | 00:24:00 | |
| Not very well. | 00:24:01 | |
| Hello. Can you bump that up? Yeah, let's, let's get that well. | 00:24:03 | |
| Vault fire. | 00:24:06 | |
| OK, can you hear me? | 00:24:09 | |
| Yeah, that's very good. Thanks. OK. So in essence it talks about the exhaustion. So portion of it in terms of in terms of water | 00:24:10 | |
| rights, I mean, in short, I mean what states? | 00:24:16 | |
| And surely what was getting at is in terms of? | 00:24:22 | |
| That. | 00:24:26 | |
| Excuse me in terms of the water rights for the. | 00:24:28 | |
| Bringing bringing the water. This has to be equal to the types of impacts. | 00:24:33 | |
| That would be done as an example I think. | 00:24:38 | |
| An example, it has to be, excuse me, it has to be in line to the. | 00:24:41 | |
| Type of use. | 00:24:44 | |
| On that. So as an example, the developer has. | 00:24:46 | |
| You know, like 5050. | 00:24:49 | |
| Right 50 writes onto 1. | 00:24:52 | |
| Piece of property. | 00:24:55 | |
| The city or the municipality cannot. | 00:24:56 | |
| Require all 50 rights. | 00:24:59 | |
| In terms of the the property. | 00:25:00 | |
| If the use of the of the approved or the, excuse me, of the applied use. | 00:25:03 | |
| Is all they're going to require about. | 00:25:08 | |
| 30 water right. 30 like water rights for that type of use. | 00:25:10 | |
| But and then bringing in and then of course, the cities can have a policy. | 00:25:15 | |
| In terms of requiring developers to bring in water rights, in terms of. | 00:25:19 | |
| The developments that. | 00:25:23 | |
| There is no. | 00:25:24 | |
| Specific. | 00:25:25 | |
| Obligations for cities to provide water rights. | 00:25:26 | |
| Towards develop, Towards developments. | 00:25:30 | |
| And in essence, that's kind of how we are structured in terms of our takedown fees. | 00:25:33 | |
| From our central Utah water, those are water rights of city currently. | 00:25:38 | |
| Already owns. | 00:25:42 | |
| And as a developer comes in. | 00:25:43 | |
| Those are those are that's water that. | 00:25:46 | |
| In essence, that developer is purchasing the rights that the that they're purchasing in order. | 00:25:50 | |
| For their development. | 00:25:55 | |
| Being X. | 00:25:57 | |
| The city and then kind of reviewing the resolution. | 00:25:59 | |
| It was, it took, it was taking a step further in terms of. | 00:26:02 | |
| Directing the say staff and so forth to develop. | 00:26:07 | |
| The policy towards the. | 00:26:10 | |
| Water rights exactions. I don't want to use the word exactions because I might that might not be the most appropriate word, but | 00:26:12 | |
| water rights so. | 00:26:15 | |
| Requirements. There we go. | 00:26:19 | |
| On that and which is a policy that. | 00:26:21 | |
| OK, which is a policy that other municipalities have? | 00:26:25 | |
| Have had. | 00:26:29 | |
| And definitely something that the Vineyard City itself. | 00:26:29 | |
| Has been working towards. | 00:26:32 | |
| So I mean. | 00:26:35 | |
| That's in short. | 00:26:36 | |
| My reading on that, but again. | 00:26:39 | |
| This type of conversation will probably be best to have my final opinion done by the City Attorney. | 00:26:41 | |
| Thank you. | 00:26:47 | |
| Any other questions to staff regarding SP 284? | 00:26:48 | |
| Can we? | 00:26:53 | |
| Pull back up the slide on the staff comments. I hadn't made it through all of those yet. Yeah. | 00:26:54 | |
| Sorry, this one right here. Yeah, right there. Yeah. So this one is regarding the resolution. This ones going regarding the | 00:26:59 | |
| resolution. | 00:27:02 | |
| The the the comment was. | 00:27:06 | |
| Any other questions to staff on SB 284 specifically? | 00:27:08 | |
| From Council. | 00:27:12 | |
| No, I met with UC3 last night, watched their presentation and Jesse. | 00:27:16 | |
| Let me or our attorney. | 00:27:22 | |
| Said to attend and they recorded it and I learned a lot. | 00:27:25 | |
| But I didn't get to watch the whole thing. | 00:27:28 | |
| But I did. | 00:27:31 | |
| I think it would be wise for Jesse to meet with Sarah directly and I set up kind of a cordial time on. | 00:27:32 | |
| Thursday just to hear her out. | 00:27:38 | |
| Kind of. | 00:27:40 | |
| She was willing to come today, but it wasn't on the agenda or anything so but I just think it would be wise to hear her | 00:27:41 | |
| constitutional issues with it. | 00:27:44 | |
| OK, so they'll do that Thursday if that's OK with everyone, just. | 00:27:48 | |
| Hear it out, OK? Sounds good. | 00:27:52 | |
| So I would like to hear the. | 00:27:55 | |
| What Cash had to say about. | 00:27:57 | |
| His recommendations? | 00:27:59 | |
| Yep, Cash, you want to go through that regarding the the resolution, yeah, absolutely. So our first one that that we've determined | 00:28:00 | |
| is, is. | 00:28:04 | |
| We would like to see any league review comments prior to our formal review. | 00:28:08 | |
| We have conducted kind of an initial review of all these resolutions. | 00:28:13 | |
| But but we haven't sat down with our attorney yet to determine. | 00:28:17 | |
| Some of the legal questions that we have about these. | 00:28:19 | |
| And so that'd be the first one. | 00:28:22 | |
| Especially when we're looking at state code interpretation, we want to make sure that. | 00:28:25 | |
| We are reading it the same way that the state intended to apply it. | 00:28:28 | |
| And make sure that any resolutions that are passed. | 00:28:32 | |
| Line up uh. | 00:28:34 | |
| That there's some things in here that we believe aren't implementation ready. There's dates in there that are that are messed up. | 00:28:36 | |
| There's code references that need to be cleaned up. | 00:28:40 | |
| And there's a lot of staff time that would be required to implement all of these that that we don't believe we have adequate. | 00:28:44 | |
| Coverage to make that happen. | 00:28:50 | |
| There's key enforcement mechanisms that may be constrained, so there's one or two of the resolutions talk about withholding | 00:28:53 | |
| certificates of occupancy. | 00:28:57 | |
| And that is very much so regulated by the state and we need to make sure that if we are implementing anything stricter than the | 00:29:01 | |
| state that we're OK there. | 00:29:05 | |
| But our building department did flag a few issues on that. | 00:29:09 | |
| Utility capacity requirements introduce risk. So this is 1. I think some of the requirements we're asking for developers to bring | 00:29:14 | |
| in letters from utility companies saying that they can provide. | 00:29:20 | |
| Adequate utilities to the site and we already kind of do that through the planning process. I don't know if the scene wanted to | 00:29:26 | |
| add in anything else about the utilities and phasing, but but we already do review all of that through the site planning process. | 00:29:31 | |
| We we make sure that that. | 00:29:36 | |
| You know the site's going to have power when they. | 00:29:41 | |
| You know, want their certificate of occupancy. So we we just felt that that wasn't not necessarily needed. | 00:29:44 | |
| Application requirements exceed typical development stage, so there are some things that just. | 00:29:52 | |
| Kind of flips the order in which we do our review on stuff, so it would have us. | 00:29:57 | |
| Doing stuff that is typically done either during the land disturbance permit stage or the building permit stage. | 00:30:00 | |
| Or. | 00:30:06 | |
| Before we go through site plan and it's necessary to go through site plan. | 00:30:07 | |
| Or a pre application meeting. | 00:30:11 | |
| Frankly, before we get to those other. | 00:30:12 | |
| Development stages. | 00:30:16 | |
| And then I think the last one is a significant operational resource impact. So a lot of these requirements were adding a lot more | 00:30:17 | |
| review to any application, so something like. | 00:30:23 | |
| Fiscal analysis. Traffic Impact analysis A. | 00:30:29 | |
| School impacted analysis, All of these things require a lot of staff time to dedicate. | 00:30:33 | |
| To ensure that those. | 00:30:37 | |
| Are first of all that they're accurate that the developers not just submitting a paper saying, yeah, we have enough. | 00:30:39 | |
| Schools for our kids or whatever, you know, we want to make sure that they're. | 00:30:44 | |
| Good, good documents and we didn't feel that as staff we have enough resources as is. | 00:30:48 | |
| To ensure that we could comply with. | 00:30:53 | |
| Those requirements. | 00:30:56 | |
| And so those are our. | 00:30:59 | |
| Our initial comments. I did forward my comments and and building an engineering to. | 00:31:00 | |
| David Colin, the attorney today. | 00:31:06 | |
| Kind of get their feedback on and they can forward them onto the council. | 00:31:07 | |
| But we definitely feel, I think. | 00:31:11 | |
| Talking with Nassim today. | 00:31:13 | |
| One of our biggest recommendations. | 00:31:15 | |
| Is is that? | 00:31:18 | |
| These resolutions. | 00:31:19 | |
| Are asking staff to do stuff and and we felt that. | 00:31:21 | |
| The resolution wasn't necessary. | 00:31:24 | |
| Necessarily needed if the council has a request or they're concerned about a state law or something like that, we do have | 00:31:26 | |
| processes and procedures in place. | 00:31:30 | |
| So that staff can work on those things and make sure that we're compliant with stuff and that we are staying ahead of the game and | 00:31:34 | |
| that we're making sure that that developers aren't aren't taking. | 00:31:38 | |
| Advantage of the city. | 00:31:41 | |
| And so. | 00:31:43 | |
| I think that's one of those things is a lot of these resolutions could have been resolved by the council. | 00:31:44 | |
| Requesting the mayor or the administrative director of the city manager when we hire one. | 00:31:48 | |
| To work with staff on these things and that way we can stay ahead of the game more as staff. We're more than happy to work on | 00:31:53 | |
| those things and and make sure that that we're protecting the city and the city's interests. | 00:31:57 | |
| Right. Yeah. | 00:32:02 | |
| Any any discussion? | 00:32:04 | |
| With what cash is presented here. | 00:32:06 | |
| Council. | 00:32:08 | |
| Could I ask was there? | 00:32:10 | |
| One of the key points that I took out of. | 00:32:13 | |
| SB-284 was that. | 00:32:16 | |
| We have. | 00:32:18 | |
| As a city, an obligation to define. | 00:32:19 | |
| A lot in our code and ordinances, absolutely. And then if we don't? | 00:32:22 | |
| Clearly state those definitions. | 00:32:26 | |
| Any ambiguity or Gray area automatically defaults to. | 00:32:28 | |
| Ruling in the side of the developer. | 00:32:33 | |
| Was there anything that you identified while going through this? | 00:32:35 | |
| As areas that we needed to make those revisions or those definitions when it came to our code or our ordinances. | 00:32:39 | |
| Yeah. So the the one of the resolutions did outline a few different topics and said make sure you have good definition on these. I | 00:32:45 | |
| did look through our definitions and felt that. | 00:32:48 | |
| I think on all but one we had a pretty solid definition on OK. | 00:32:52 | |
| But that being said, we as staff are more than happy to re examine our entire definition. | 00:32:56 | |
| Section of code and make sure that we're crossing our T's and dotting our eyes on that and and compare it to best practices of | 00:33:01 | |
| other cities nearby. | 00:33:04 | |
| But but there were no red flags, essentially saying by May 6 the developer is going to get away with. | 00:33:08 | |
| AB and C if we don't tighten up the definition, there was nothing like that. | 00:33:14 | |
| Thank you. | 00:33:18 | |
| Any other questions? | 00:33:19 | |
| Discussion is hurting this. | 00:33:20 | |
| One of the things I asked about is that whether some. | 00:33:22 | |
| Areas where we. | 00:33:25 | |
| Where our code doesn't or. | 00:33:26 | |
| Current existing zoning code doesn't cover some of the things listed in say, Section 3 of that first. | 00:33:29 | |
| Proposed resolution. | 00:33:34 | |
| They go through the different things that. | 00:33:35 | |
| Ought to go into a. | 00:33:37 | |
| Developer agreement. | 00:33:39 | |
| Can you state that again? | 00:33:41 | |
| Yeah. | 00:33:43 | |
| I wanted to. | 00:33:44 | |
| Dual comparison between. | 00:33:45 | |
| The things that are being requested in that resolution, Section 3 of that resolution, the required completeness. | 00:33:47 | |
| With what we have, what we're asking for in code currently. | 00:33:53 | |
| Yeah, I think we nothing we're missing in our current code. | 00:33:57 | |
| That is specified here that it might be. | 00:34:00 | |
| Better. | 00:34:02 | |
| So yeah, essentially from what I'm. | 00:34:04 | |
| Getting here, you're wanting to know is there anything that we could update to our complete application standards essentially, | 00:34:06 | |
| right, Yeah. And this goes back to. | 00:34:09 | |
| The the significant operational resource impact, the more we add to these standards that requires additional staff time to review | 00:34:13 | |
| these these documents as they come in and these applications and they're already hefty applications as is. That being said, we're | 00:34:19 | |
| not at all opposed to adding additional requirements as we see need fit. That being said, we do need to make sure any applications | 00:34:25 | |
| we bring in or any new. | 00:34:30 | |
| Requirements are objective based, they can't be subjective based, right. And so if we do say we want a fiscal impact analysis to | 00:34:38 | |
| be part of the the complete application checklist, we need to make sure as a city we're outlining what we're looking for in that | 00:34:43 | |
| analysis. | 00:34:48 | |
| To ensure that we. | 00:34:53 | |
| If we deny the application on the basis of an inadequate fiscal impact analysis, we can say. | 00:34:54 | |
| The exact reason why we can't just say, oh, we don't like that, that this isn't going to provide us enough sales tax, so we're | 00:35:00 | |
| going to deny this application. | 00:35:03 | |
| They are permitted use. | 00:35:07 | |
| They're allowed to build. We cannot deny because we don't like it. | 00:35:09 | |
| Right. And so that's one thing that that. | 00:35:12 | |
| Would be required if we do add any of these standards. Same thing with the the school study. | 00:35:14 | |
| Or a utility capacity like we need to make sure that that it's very. | 00:35:19 | |
| Objective in our review. | 00:35:22 | |
| And those requirements that we instill into our code. | 00:35:24 | |
| Is that look kind of the rest of the build out of the city cash? | 00:35:27 | |
| Is there any? | 00:35:31 | |
| Parcels of land that you anticipate that will need a development agreement. | 00:35:32 | |
| That do not have one right now. | 00:35:36 | |
| Yeah, I mean, because we're pretty. | 00:35:38 | |
| Pretty built out and Pete could speak to this potentially on the east side E Geneva. The only thing I can even think of maybe | 00:35:40 | |
| would be the snow property but. | 00:35:44 | |
| Is that I don't I don't we're working with them on a concept plan right now and they've. | 00:35:49 | |
| That's within the to enter into development agreement. Yeah, there's gonna do it. But then. | 00:35:53 | |
| Yeah, it's already, yeah, right. They're wanting complex office industrial which is permitted. So the question I'm having to | 00:35:58 | |
| asking is, is council just. | 00:36:01 | |
| Trying to fix a problem that. | 00:36:04 | |
| That ship sailed. | 00:36:05 | |
| Yeah, umm. | 00:36:07 | |
| Yeah, I mean most, most of our properties in Vineyard, the Forge, Utah City. | 00:36:08 | |
| The yard all of that has a development agreements already in place for signed locked, loaded, correct. And so it's we're kind of | 00:36:12 | |
| past the point of. | 00:36:16 | |
| Now saying we're going to require you to update your development agreement, we frankly cannot do that if they're building what is | 00:36:19 | |
| permitted and they're not coming back to the city. | 00:36:24 | |
| Asking for an additional allowances. | 00:36:28 | |
| Yeah. So with that being said, that there very well could be potentials in the future. The Forge is a good example. They came back | 00:36:30 | |
| a month ago wanting. | 00:36:33 | |
| To make some modifications to their their development agreement and that opens it up for us to say. | 00:36:36 | |
| OK, You're wanting to make some changes. Then we're going to add in some additional requirements and we're more than happy as | 00:36:41 | |
| staff to work on that and work with the council to make sure that we're protecting the city. | 00:36:45 | |
| But but yeah, I. | 00:36:49 | |
| I don't know if there's really any any new developments that would require brand new to go through it because at the end of the | 00:36:51 | |
| day like. | 00:36:54 | |
| The holdaway fields is locked and loaded. We're working through that right? | 00:36:57 | |
| Up north it's basically done. | 00:37:01 | |
| Permitted use everywhere, at least what I've seen. | 00:37:03 | |
| So, umm. | 00:37:06 | |
| Yeah. OK. So the cash, didn't you tell me that the the east side of? | 00:37:07 | |
| The northeast side. | 00:37:13 | |
| Of the. | 00:37:14 | |
| The RDF there was was not under a development agreement. | 00:37:15 | |
| I I don't know the the current. | 00:37:19 | |
| Well, the you're not. I mean, I talked about, yeah, Martin Snow is not, but also the rest of it as well. | 00:37:21 | |
| So there is a sign one but it. | 00:37:28 | |
| But what I was talking to you is about the zoning there, how right now is just kind of a blanket zone of regional commercial and | 00:37:30 | |
| if they wanted to build to the standards of the RC. | 00:37:33 | |
| They absolutely can do that with no problems, but if they did come back saying we want to rezone to. | 00:37:37 | |
| Create whatever it may be, then that's a point that that we could either do a development agreement or a special purpose zoning | 00:37:43 | |
| district and we'd work directly with the the applicant and with the the community to make sure that we are, you know, creating an | 00:37:47 | |
| environment that that we want to see in the city. | 00:37:51 | |
| OK. Thank you. Any other questions for cash? | 00:37:57 | |
| Or staff regarding this? | 00:38:00 | |
| OK, hearing none, let's. | 00:38:02 | |
| Move the discussion along. What? | 00:38:04 | |
| Yeah, go ahead, Go ahead, Ezra. | 00:38:06 | |
| That's not a cool question. | 00:38:09 | |
| I know central use our water Conservancy district did like a. | 00:38:12 | |
| A water plan for us where they kind of projected out what? | 00:38:15 | |
| What the needs would be on the system? | 00:38:19 | |
| Is that? | 00:38:21 | |
| And maybe this is probably the best bird to see is that. | 00:38:23 | |
| Meet some of these requirements to. | 00:38:26 | |
| Health plans instead of providing essentially all of our water for. | 00:38:29 | |
| Yeah. So they do have a plan as more of a takedown schedule plan, which can you push the microphone closer. | 00:38:33 | |
| Can you hear me? Yeah. Thank you very much. | 00:38:42 | |
| Thanks. So they, yeah, they provide us a plan like a takedown schedule. | 00:38:44 | |
| Plan in terms of along with prices for our finances, we also have in our. | 00:38:47 | |
| Drinking water Master plan. | 00:38:55 | |
| A kind of the projected. | 00:38:56 | |
| Water requirements needs which would meet the requirements and. | 00:38:59 | |
| To talk kind, to elaborate a little bit more on the utility studies. | 00:39:03 | |
| I mean in our different. | 00:39:06 | |
| Utility plans and so forth we do outline. | 00:39:08 | |
| The requirements that for capacity and so forth that a developer. | 00:39:11 | |
| With meat and we put the, we put the burden on the developers in terms of. | 00:39:16 | |
| Requesting those verification like. | 00:39:21 | |
| Those types of capacity letters. | 00:39:23 | |
| So if it's, if someone's coming in. | 00:39:24 | |
| So for example the car wash. | 00:39:27 | |
| As an example. | 00:39:30 | |
| We requested to the developer to provide us the capacity letters so they would be so they would be the ones who. | 00:39:31 | |
| Would pay for the study. | 00:39:39 | |
| And and reviews and we were just review it to ensure that we would agree with it or not. | 00:39:41 | |
| In terms of that, so that puts a burden on the developers. | 00:39:46 | |
| To kind of. | 00:39:50 | |
| Justify that, yes, what they're proposing. | 00:39:51 | |
| Does meet the existing capacities? And if it doesn't? | 00:39:54 | |
| They would propose to us options of what they would need to do in order to. | 00:39:57 | |
| Abides you know, in order to buy to it. | 00:40:01 | |
| So it's more, it's less for us, it's less prescriptive and more subjective. | 00:40:04 | |
| On that and it also. | 00:40:09 | |
| Burden as well as the financial. | 00:40:11 | |
| Burden onto the developer who's requesting it. | 00:40:13 | |
| The only thing we don't do on that is we there's one particular one for fire suppression. | 00:40:16 | |
| Since we since we have all the models. | 00:40:21 | |
| Which and then with that. | 00:40:23 | |
| We charge the developer. | 00:40:25 | |
| Every time we would have to run it. | 00:40:26 | |
| Awesome. | 00:40:29 | |
| Any other questions regarding this? | 00:40:30 | |
| Item 3.1 or discussion there. I think that where I think that. | 00:40:33 | |
| And I don't want to. | 00:40:38 | |
| My recommendation to council is let's get some more information sounds like. | 00:40:40 | |
| UP3 or the C3C3? What? What's that gal's name? | 00:40:44 | |
| Sarah. Sarah, Yeah. | 00:40:48 | |
| She's well. | 00:40:49 | |
| What do you say? | 00:40:52 | |
| Say again, Ezra. | 00:40:54 | |
| You're saying that you're getting mouse. | 00:40:56 | |
| You see 3. | 00:41:01 | |
| Her name is Sarah. | 00:41:03 | |
| It's that other. | 00:41:07 | |
| Coalition of state counties The coalition of large cities and counties. It's an association that's about. | 00:41:09 | |
| Constitutional rights of cities. It's a great organization. | 00:41:14 | |
| Her name is Sarah. Sarah. | 00:41:18 | |
| So my my recommendation on that is. | 00:41:21 | |
| It's an association. It's. | 00:41:24 | |
| Kind of like Utah League of Cities and Towns. | 00:41:27 | |
| Just with a little more. | 00:41:29 | |
| It was really wisely accepted last night. There was it was really widely attended. I was surprised how many cities were in across | 00:41:31 | |
| Utah County. | 00:41:34 | |
| It's a recorded. | 00:41:38 | |
| You can watch it. | 00:41:39 | |
| I thought the advice was really good. | 00:41:45 | |
| Review from the. | 00:41:50 | |
| On. | 00:41:52 | |
| On this. | 00:41:53 | |
| Is he joining late? | 00:41:53 | |
| We just said that so. | 00:41:56 | |
| No SO. | 00:41:59 | |
| So Jesse and Sarah are sinking on. | 00:42:01 | |
| Thursday, we said. | 00:42:03 | |
| To get on the same page of the constitutionality and and different insights that he that she could help us. | 00:42:05 | |
| Advise and make some revisions to the. | 00:42:11 | |
| Yeah, to it. | 00:42:16 | |
| So just gathering all advice. | 00:42:20 | |
| Different viewpoints. | 00:42:23 | |
| Could you say that again, Ezra? | 00:42:27 | |
| What's he saying? | 00:42:29 | |
| He's asking for a legal analysis. | 00:42:30 | |
| To be presented to the Council prior to putting this on the agenda. | 00:42:33 | |
| Yeah, yeah. | 00:42:36 | |
| I think that that's definitely that points in order. | 00:42:36 | |
| I think that's that would be helpful. | 00:42:39 | |
| I think the. | 00:42:42 | |
| I think thank you Cash for putting this together. Kind of shows the staff. | 00:42:43 | |
| Framework. Framework of what this would cost. | 00:42:47 | |
| To administer as currently written, I think a legal framework too with the. | 00:42:50 | |
| Analysis. | 00:42:54 | |
| That hey. | 00:42:56 | |
| Are we are? | 00:42:57 | |
| It's council trying to legislate something that. | 00:42:59 | |
| On a ship that's left the port. | 00:43:01 | |
| So that would be helpful as well, I think. I think this is a learning session for staff and. | 00:43:03 | |
| I agree with that that. | 00:43:08 | |
| We're saying now because and I'm a little bit frustrated because. | 00:43:11 | |
| This bill passed a couple of months ago, right? And so there's a lot of cities that definitely say, hey, there are, there does | 00:43:16 | |
| need to be adjustments made. | 00:43:20 | |
| But you know, I know. | 00:43:24 | |
| We probably could have done a better resolution and a better time to put things together to be able to go through, but there are | 00:43:27 | |
| things that need to be changed and passed before that time, right? | 00:43:31 | |
| Now there's a lot of mistakes in the resolution, but what happens if we wouldn't have caught this ourselves? | 00:43:36 | |
| Would staff have been bringing these issues beforehand and found them? | 00:43:41 | |
| There's, I think, a misconception here too. | 00:43:46 | |
| We only have the. | 00:43:49 | |
| I'm just saying one of them, one of the corrects, the only, the only one that was. | 00:43:52 | |
| Immediately urgent to my understanding, based on my reading and research and then talking to to Mr. Riddle about it. | 00:43:56 | |
| Was that? | 00:44:02 | |
| The 2026-23. | 00:44:03 | |
| That resolution is the one regarding the complete application investing. | 00:44:06 | |
| And the thing that made that one urgent was because it was the SB-284 said that if you don't have that definition of what makes a | 00:44:10 | |
| land use application complete. | 00:44:15 | |
| Prior to May 6th, you can't. | 00:44:20 | |
| Amendments adjust it. | 00:44:23 | |
| So that was the only one that had an immediate urgency. | 00:44:24 | |
| To it. | 00:44:28 | |
| And it's not that it's doing anything, I think. | 00:44:29 | |
| Drastic and maybe tell us where, where staff, where you see the importance there? | 00:44:32 | |
| Or or if it's a moot point. | 00:44:36 | |
| But it was largely that. | 00:44:39 | |
| We would. | 00:44:41 | |
| Be defining as a city. | 00:44:42 | |
| Do you require utility traffic studies, the physical plans, all of those things that just had to be specified? | 00:44:44 | |
| And I don't know if our existing code, if you felt like that, did that adequately. | 00:44:51 | |
| Presently or not, Yeah, I mean, I, I agree with that and that our existing code, I don't think through any site plan review that | 00:44:56 | |
| I've done we've had any issues. | 00:44:59 | |
| With using our complete application checklist and and essentially what we do is we have a fairly basic checklist for a permitted | 00:45:03 | |
| use right where it's interesting we're already allowing this type of use, we don't need to see. | 00:45:09 | |
| All these extra studies to show that it's needed and then when it's a conditional use is then when we have a more robust checklist | 00:45:15 | |
| that says, you know, we do for, for example, for a drive through restaurant, we do require a traffic impact analysis. We want to | 00:45:20 | |
| make sure that. | 00:45:24 | |
| That if an in and out burger came here that they're not going to be their Dr. throughs not going to be spilling out on a Mill Road | 00:45:29 | |
| and causing traffic problems, right. And so we, we already have those checklists in our code and I feel that they have been | 00:45:35 | |
| adequate for for our needs. I don't know of any site plan that we've gone through where we've requested and. | 00:45:42 | |
| You know, actually. | 00:45:48 | |
| If we've ever requested an item from an applicant, they've. | 00:45:50 | |
| Never fought back on us, even if it is outside of this checklist, we've said hey. | 00:45:53 | |
| We're concerned about this issue. | 00:45:56 | |
| Would you be able to do this traffic study or something for us? And they've been more than happy to accommodate us with that | 00:45:58 | |
| because they want to make sure that their project is successful as well. And they also want to make sure that when it comes to | 00:46:03 | |
| either a Planning Commission or City Council approval that they're not going to have to. | 00:46:08 | |
| Get over that hurdle. At that point they'd rather do it at the staff level. | 00:46:13 | |
| So, but yeah, correct there was nothing really in the SB-284 that. | 00:46:17 | |
| That as we've reviewed it, that there were any red flags saying. | 00:46:21 | |
| Oh, shoot, we're running behind. We need to make sure we get our ordinances up to date. We've. | 00:46:24 | |
| Generally, every year we we work with our our city manager or our administrative director and our city attorney to make sure that | 00:46:28 | |
| that we are. | 00:46:32 | |
| Updating your code right and. | 00:46:36 | |
| And the only thing that comes to my mind that the. | 00:46:37 | |
| That we need to update would be the. | 00:46:40 | |
| The legislative body cannot be the appeal authority. | 00:46:42 | |
| And the update to posting our complete application on our website. Those are the 2. | 00:46:45 | |
| Only two things, and we have until October 1st for that one. | 00:46:50 | |
| But we have as a city that we need to update. But this, this happens every year. | 00:46:53 | |
| We make sure that we're following state code and we, you know, attend trainings through the Utah League or whatever. | 00:46:57 | |
| To make sure that that we are updating. | 00:47:02 | |
| What we need to. | 00:47:05 | |
| And and I don't know if. | 00:47:06 | |
| Any example? | 00:47:07 | |
| Of our city, yeah. That we've. | 00:47:08 | |
| Failed to do that. | 00:47:10 | |
| So my I guess thought and recommendation would be that we. | 00:47:11 | |
| Let's make sure. Let's take a good look at. | 00:47:16 | |
| The 2026-23. | 00:47:19 | |
| Make sure that that is. | 00:47:22 | |
| Because that's what has to be defined before May 6. Is just what makes a complete. | 00:47:24 | |
| Application. | 00:47:28 | |
| We've fixed the legal concerns that we've addressed in there, Which? | 00:47:30 | |
| Previously, what we shared last week was. | 00:47:33 | |
| Correcting. | 00:47:36 | |
| Some language removing. | 00:47:37 | |
| Or defining the transit adjacent term. | 00:47:40 | |
| And. | 00:47:43 | |
| Making sure that this was in step with. | 00:47:45 | |
| Developing an ordinance. | 00:47:48 | |
| That was going to be adopted. | 00:47:49 | |
| And I think for the other ones. | 00:47:51 | |
| Because those ones aren't urgent. | 00:47:55 | |
| Pump the brakes a little bit. Make sure that we. | 00:47:56 | |
| Do this very, you know. | 00:47:59 | |
| Methodically incurred like to. | 00:48:01 | |
| I'd like to try to table the rest of them, but the 23 I would like to pursue the, especially Section 3. | 00:48:02 | |
| The things that are indicated there, I like to make sure that our zoning code covers. | 00:48:08 | |
| Those significant well enough for us, let's do an analysis of that. | 00:48:13 | |
| And and and see where we need to modify our zoning code or if we indeed need to implement something like as. | 00:48:17 | |
| Like a developer agreement. | 00:48:23 | |
| Requirement like is it here OK, I think that's a good. | 00:48:25 | |
| A good process and it also alleviates a lot of the burden on the staff, yes. | 00:48:27 | |
| And I would also just point out this is. | 00:48:31 | |
| Go ahead. Say again, Ezra. | 00:48:35 | |
| It looks like it looks like Jesse's on. | 00:48:38 | |
| He was mentioning that. | 00:48:40 | |
| All this would do. | 00:48:42 | |
| Is in fact any applications we receive between when. | 00:48:43 | |
| If we adopted that resolution. | 00:48:48 | |
| Yeah. | 00:48:51 | |
| Because we can change our code anytime and have. | 00:48:53 | |
| These requirements as part of the code updates. | 00:48:56 | |
| And so like, even like I don't. | 00:49:00 | |
| I don't anticipate us getting any applications. | 00:49:02 | |
| In that window. | 00:49:04 | |
| Or Jesse, could you maybe explain that comment again, because. | 00:49:06 | |
| Yeah. | 00:49:09 | |
| I don't, I think there's a misconception there, Ezra the. | 00:49:11 | |
| The comment. | 00:49:14 | |
| Previously was that if we rushed this through it would only protect us for that day, but this is. | 00:49:15 | |
| Would be the the. | 00:49:20 | |
| Policy then, I think. | 00:49:21 | |
| That. | 00:49:23 | |
| Is enacted moving forward, so this is post May 6th. | 00:49:24 | |
| Application. | 00:49:28 | |
| And Ezra I I would. | 00:49:34 | |
| I think I mentioned right at the last of my. | 00:49:36 | |
| Comments from last week. | 00:49:39 | |
| By the way, this is Jesse. | 00:49:41 | |
| That I didn't see anything urgent in this. | 00:49:44 | |
| Number one and #2. | 00:49:46 | |
| I didn't know that our. | 00:49:49 | |
| Code was inadequate, and I think that's confirmed it is it is adequate. | 00:49:51 | |
| And if the development office sees something, that is a glaring oversight. | 00:49:56 | |
| I think we should focus down like we would normally do. | 00:50:02 | |
| And say, let's change these two issues and let's do that as quickly as possible. | 00:50:05 | |
| So we we backed in this and I said last week, I think the caboose is pulling the engine here. | 00:50:10 | |
| Let's identify if we have a problem in our code. | 00:50:16 | |
| And let's focus on that problem. | 00:50:19 | |
| Let's do a revision or an addition or subtraction. | 00:50:21 | |
| And then was passed it as soon as possible. | 00:50:25 | |
| I agree with you, Ezra, that. | 00:50:28 | |
| Who's going to complete a? | 00:50:32 | |
| Have submitted complete application. | 00:50:34 | |
| By the six, if in fact our. | 00:50:37 | |
| Our statute goes into effect the bid. | 00:50:40 | |
| Yeah. And so I've never felt the urgency in any of this. | 00:50:44 | |
| Resolution for urgent and as we look through we. | 00:50:51 | |
| I guess the. | 00:50:56 | |
| These these have been discredited. | 00:50:56 | |
| Quite a bit because of the way it was. | 00:50:59 | |
| Approach to to us, and I think we have to be careful. | 00:51:01 | |
| That we let third parties not dictate what we do as a City Council. | 00:51:05 | |
| Thank you for that. | 00:51:10 | |
| OK, so. | 00:51:12 | |
| Any obviously there's no motion to be taken here, but the direction I think that we do it's let's just get gather more | 00:51:15 | |
| information. | 00:51:18 | |
| Council gathers more information and circles back. | 00:51:23 | |
| Tip for Ken. | 00:51:26 | |
| Great. Umm. | 00:51:27 | |
| Now we're OK. Are you? | 00:51:31 | |
| I'd like to ask that we next time we have a working session that we can. | 00:51:34 | |
| Perhaps a? | 00:51:38 | |
| Consider this for a. | 00:51:39 | |
| Working session A month or so from now, we've had a chance to look at these things. Let's work that's. | 00:51:40 | |
| But we have that one, right, that needs to be. But all the others, yeah, 20 table. The rest of it 23 we want to keep looking at. | 00:51:44 | |
| And bring it back into a working session in a month or so. | 00:51:51 | |
| Yeah. | 00:51:54 | |
| Thank you. | 00:51:55 | |
| All righty, let's jump on to 3.2. | 00:51:57 | |
| Watching our time here. Resolution of RDA. | 00:51:59 | |
| Hiring up to three advisors for RDA board I'm. | 00:52:02 | |
| I don't have a sponsor on this, but I believe it was David. | 00:52:05 | |
| Dave Luray, you want to lead out on this this discussion as well. | 00:52:08 | |
| Sure. | 00:52:11 | |
| Thank you, Sir. | 00:52:11 | |
| Turn the time to you, we proposed. In this resolution, we propose approving. | 00:52:12 | |
| Or three positions. | 00:52:18 | |
| Called RDA Advisors right now that there's lack of a better term. | 00:52:21 | |
| We want to basically hire these folks to be able to help with the. | 00:52:26 | |
| There's a. | 00:52:30 | |
| Agreed upon procedures audit which is just. | 00:52:30 | |
| Being kicked off now. | 00:52:33 | |
| With the RDA, we want to be able to have them in place so they can begin helping with that and doing. | 00:52:35 | |
| And you know. | 00:52:40 | |
| The auditor is is lives in Salt Lake and he's a Salt Lake County. | 00:52:42 | |
| County auditor, right. | 00:52:47 | |
| Like how the other Yeah, it was. | 00:52:48 | |
| Holly County, Yeah. Anyway, his private practice, he's he's doing this audit for us. It's the same Chris Harding, the same one did | 00:52:49 | |
| it before. | 00:52:52 | |
| And he's going to come down and continue that work to. | 00:52:56 | |
| With a different time, a little water time frame, a little different scope and help us put together. | 00:52:59 | |
| Some policies and procedures that will help us avoid the problems that we've. | 00:53:05 | |
| That were found in that previous audit. | 00:53:10 | |
| And so we. | 00:53:12 | |
| The idea is we would have these folks on board to. | 00:53:14 | |
| To advise and help him in that process. | 00:53:18 | |
| Also, it's also possible that they may be able to help the city with other. | 00:53:21 | |
| Changes need to be made in code or do other research. | 00:53:26 | |
| We want to also build a story that helps us understand. | 00:53:30 | |
| You know the RDA. | 00:53:34 | |
| From the perception till now and how we've got from a, you know, a 35 year. | 00:53:36 | |
| RDA that with 25 year increments. | 00:53:42 | |
| That capped at 300 million to where we are now with. | 00:53:45 | |
| Close some say $1,000,000 value with with no real no real end insight. | 00:53:49 | |
| We want to make sure that our city is getting the value for the sacred dollars that are being of theirs, that are being taken from | 00:53:54 | |
| from them. | 00:53:58 | |
| As is this tax increment financing does take from our. | 00:54:02 | |
| From our residents that the money that would be going for their schools to pay for their children's schooling to pay for. | 00:54:06 | |
| Water improvements to pay for the county issues, paper city things and and it's and we want to make sure those are being spent | 00:54:14 | |
| well. | 00:54:17 | |
| We have a primary concern is that this area is in the RDA and I'm not talking about a one. | 00:54:20 | |
| Empty. We have all sorts of contractors that are working in this larger Rd. area area. We'll make sure that indeed the. | 00:54:26 | |
| The citizens are getting the value they expect and the land is being cleaned up so that people can come in. | 00:54:33 | |
| And that I understand. We want to help with business incentives. | 00:54:38 | |
| We do. | 00:54:42 | |
| But at the same time, we want to make sure that we prioritize cleanup so that. | 00:54:43 | |
| That indeed that. | 00:54:47 | |
| The money doesn't run out before the cleanup is done and then that can be done in a timely fashion and so forth. | 00:54:48 | |
| Those are some issues that we're concerned about. | 00:54:53 | |
| And we feel like these these people coming on would be able to help us. | 00:54:55 | |
| Look into. | 00:55:00 | |
| Where we've been, where we need to go and help us know what we need we need to do to get there. | 00:55:01 | |
| Thank you, David. The Chair opens it up for discussion on this to the Council. Go ahead. So I would like to give some context as | 00:55:06 | |
| to the reasons behind this too. | 00:55:10 | |
| You're talking about. | 00:55:15 | |
| A wealth of knowledge that is not. | 00:55:17 | |
| Currently on the RDA board and that many people have gone so. | 00:55:19 | |
| And the documentation. | 00:55:24 | |
| That exists within the RDA is extremely fragmented or nonexistent on large multi $1,000,000 decisions. | 00:55:26 | |
| Yet some of the people that made those decisions. | 00:55:34 | |
| Including. | 00:55:37 | |
| Alpine School District and all of their. | 00:55:39 | |
| Forming umm. | 00:55:41 | |
| Founding documents. | 00:55:43 | |
| It's vacant. | 00:55:44 | |
| There's no record. | 00:55:46 | |
| And so this is going to be a very large. | 00:55:48 | |
| On the advisor of some of many of these people are still alive. | 00:55:51 | |
| They have emails, they've got documents of gathering what we know or what they know. | 00:55:54 | |
| Advising on those records. | 00:56:01 | |
| I wish the late Dawn Overson was alive. | 00:56:04 | |
| But even going and gathering all of his records and all of the problems and issues that. | 00:56:06 | |
| You know, when we went and met with him, it was. | 00:56:12 | |
| Pretty alarming, but can we go and get all of those? | 00:56:14 | |
| To find it so those advisors are. | 00:56:17 | |
| Gathering it's a very going to be a very large lift. | 00:56:19 | |
| The. | 00:56:22 | |
| Auditor. | 00:56:23 | |
| Is very specific in scope of what they're what what they're doing and so. | 00:56:25 | |
| The auditor. | 00:56:29 | |
| Does not have the time or resources. | 00:56:31 | |
| From Salt Lake to. | 00:56:33 | |
| Know all the inner workings of. | 00:56:35 | |
| And you're just not talking about Alpine school districts. You're talking about the county and you're talking about the state and | 00:56:37 | |
| you've had multiple. | 00:56:40 | |
| Changes in in legislation and bills ran. | 00:56:43 | |
| That when you look back at the record and the of. | 00:56:47 | |
| Public meeting in minutes. | 00:56:50 | |
| Things happened. | 00:56:52 | |
| And they didn't happen in the meeting. | 00:56:54 | |
| And so. | 00:56:56 | |
| You have a document that occurred, but how did it occurred and how did that vote happen? | 00:56:57 | |
| And so there it's a lot of forensic gathering. | 00:57:02 | |
| And so these. | 00:57:05 | |
| You can't just. | 00:57:06 | |
| Go forward if. | 00:57:07 | |
| You don't know how that. | 00:57:09 | |
| Even came to about SO. | 00:57:11 | |
| We've just got a. | 00:57:15 | |
| We've just got to gather that information. So that's what we hope that those. | 00:57:17 | |
| Individuals will be doing. | 00:57:21 | |
| Like I said, I'm hoping that these advisors would work with the current RDA. | 00:57:23 | |
| Director. | 00:57:27 | |
| Also with our legal counsel. | 00:57:29 | |
| Jesse correct and it together they would maybe throw a 5 members not really above. | 00:57:30 | |
| Official body, but they would be able to. | 00:57:35 | |
| You know, provide recommendations to the to the RDA board. | 00:57:37 | |
| And how to move forward in certain areas. | 00:57:42 | |
| One of them. | 00:57:43 | |
| We, I mean, this is where the discussion was, is we talked about maybe someone from the school district as being one of the third. | 00:57:44 | |
| Or even an environmentalist. | 00:57:50 | |
| Our environmental specific and then a construction level of gathering that. | 00:57:52 | |
| So. | 00:57:58 | |
| And somebody help us but flexible on that but. | 00:58:00 | |
| To be honest with you. | 00:58:04 | |
| As the auditor gets into it. | 00:58:06 | |
| I know they just held a kickoff meeting yesterday. | 00:58:08 | |
| They talked about. | 00:58:11 | |
| Gathering it was. | 00:58:14 | |
| I heard about the meeting from Jesse and maybe you could describe it, but just. | 00:58:15 | |
| From when one contract went to another contract to another contract. | 00:58:19 | |
| There's a lot of gaps of how did it go from here to there and that's where. | 00:58:22 | |
| These individuals, we can instruct them to. | 00:58:27 | |
| Go and get meat on the bones of. How did that adjust and change from that point? | 00:58:30 | |
| So that we can govern into the future. Like we don't want to really litigate, but we also want to understand. | 00:58:34 | |
| Did this occur? We'd like to understand the legal basis for like legal basis of. | 00:58:40 | |
| And how this all happened? Yeah. | 00:58:44 | |
| Because you're you're you're basing yourself off of. | 00:58:46 | |
| Limited. | 00:58:51 | |
| Documentation. | 00:58:52 | |
| Thank you. We've had a lot of hearsay information and we'd like to get it confirmed. | 00:58:53 | |
| Thank you for that. | 00:58:57 | |
| In respect of everybody's time, Parker, Ezra, do you have anything you'd like to add to this? | 00:58:58 | |
| Discussion. | 00:59:03 | |
| So I'm just curious about. | 00:59:06 | |
| The structure of it. | 00:59:09 | |
| And why this? | 00:59:11 | |
| Once this settled structure, why this is? | 00:59:12 | |
| Kind of being a proposed structure. | 00:59:15 | |
| It sounds like we're trying to bring in. | 00:59:17 | |
| People image and one of them. I don't know if you have specific people in mind already. | 00:59:19 | |
| But it sounds like you guys are asking for a forensic audit. | 00:59:24 | |
| And instead of hiring a firm that specializes in that, you're proposing to. | 00:59:28 | |
| Individuals to. | 00:59:34 | |
| To do that. | 00:59:35 | |
| And I'm just wondering why. | 00:59:37 | |
| This this structure is. | 00:59:39 | |
| Why, why do you guys sell them this structure versus hey, if we, if we need to go through and usually do a forensic audit and they | 00:59:41 | |
| kind of buy? | 00:59:44 | |
| When there's a gap between like two different documents getting signed. | 00:59:48 | |
| Why not hire a? | 00:59:52 | |
| Firm that has the resources and the tools to be able to. | 00:59:53 | |
| To identify things like that rather than. | 00:59:57 | |
| What is currently proposed has kind of been. | 00:59:59 | |
| A little bit of an amorphous structure where it's just saying, OK, we're directing HR staff to. | 01:00:02 | |
| Kind of picturing people. | 01:00:08 | |
| You don't really have clear responsibilities for what those three people are doing. | 01:00:10 | |
| Like it's the goal to get a forensic audit or are there other? | 01:00:15 | |
| And what's the goal here? | 01:00:18 | |
| Thank you. | 01:00:19 | |
| David Larae, would or would you like to respond to that question? | 01:00:21 | |
| The we don't think we need a forensic audit per se, but we don't anticipate any legal action whatsoever to come from this. | 01:00:25 | |
| But we do want to understand the legal basis for things and and. | 01:00:32 | |
| We've already talked to the. | 01:00:36 | |
| To our auditor this coming in and and he's. | 01:00:38 | |
| With he's willing to guide and direct some of these folks and how do it, but he can't. | 01:00:41 | |
| He doesn't have the the. | 01:00:47 | |
| The means, if you will, to be able to do the the full scope of things we'd like to see done. | 01:00:49 | |
| He's willing to work with them and he's willing. He's willing to accept help from them as well in terms of getting him, getting | 01:00:55 | |
| documents and so forth that he may not be. | 01:00:59 | |
| He can't be down here in the day and they can be, you know, they can do some things for him and so forth. | 01:01:03 | |
| It would that would be. | 01:01:07 | |
| One of their one of their jobs essentially is to help is to assist the. | 01:01:10 | |
| The auditor and getting the information he needs to do the audit. | 01:01:14 | |
| And he would also, we also expect that there be some knowledge transfer in the process that we would. | 01:01:18 | |
| Be able to. | 01:01:24 | |
| You know, gather information that we don't have essentially and and. | 01:01:26 | |
| And be able to. | 01:01:29 | |
| Tell a story about this that makes sense, that we can understand where we are, we have a legal basis for things, and we can. | 01:01:30 | |
| And we know how to move forward with it. | 01:01:36 | |
| Thank you. | 01:01:38 | |
| I think they're follow up questions on that comment, Ezra. | 01:01:39 | |
| So we're. | 01:01:44 | |
| Staff for the auditor. | 01:01:47 | |
| At the city rather than just giving the auditor. | 01:01:49 | |
| Additional resources to recommend. | 01:01:52 | |
| Additional people for Newark went to have. | 01:01:54 | |
| At the bandwidth he's doing. | 01:01:57 | |
| Yeah, the auditor is going to be. | 01:01:58 | |
| Yeah, the auditor is going to be here for 90 days and he's going to come in and do the audit and then leave. | 01:02:00 | |
| These individuals will be able to get an institutional knowledge going back. | 01:02:05 | |
| Over 2 decades or since 2008 of when it started. | 01:02:09 | |
| Going through the transition. | 01:02:13 | |
| When you start at the beginning of the RDA, you see. | 01:02:15 | |
| Affordable housing and going to the legislature to go get hundreds of millions of dollars to clean up. | 01:02:18 | |
| Do environmental cleanup. | 01:02:23 | |
| We have no affordable housing in our downtown. | 01:02:26 | |
| Right. But yet if you go back and look at the original documents, it's saying this is the goal and you see year after year changes | 01:02:29 | |
| to different goals. And so it'll help us understand, OK. | 01:02:34 | |
| Into the future. | 01:02:40 | |
| What are what can we do? Because it's changed every 5 to 10 years of what they're trying to accomplish, right And so. | 01:02:43 | |
| Also. | 01:02:50 | |
| In working with these advisors. | 01:02:51 | |
| I don't this is not a forensic audit. This is. | 01:02:53 | |
| What? Where have we failed? | 01:02:55 | |
| Did we fulfill with the contracts all the different various contracts because we're going to need to go through all the different. | 01:02:57 | |
| Contractual reviews. | 01:03:02 | |
| Are they fulfilling with those contracts? What's the wiggle room of those and how do you advise us to adjust? | 01:03:04 | |
| The future and the direction of the RDA moving forward so. | 01:03:09 | |
| We are not assuming. | 01:03:13 | |
| Any. | 01:03:15 | |
| You know, a forensic audit of fraud. | 01:03:17 | |
| If they find something, obviously. | 01:03:19 | |
| We wanted to bring to our attention, but it's more of. | 01:03:22 | |
| There are a lot of gaps in the different contracts. | 01:03:25 | |
| That exist. | 01:03:28 | |
| And so. | 01:03:29 | |
| And we've gone through those with Jesse. | 01:03:31 | |
| And with. | 01:03:33 | |
| The auditor, but also. | 01:03:35 | |
| There's contracts that we have no idea should exist and now we've found. | 01:03:37 | |
| Why isn't that? | 01:03:42 | |
| Procedure process in place and nobody knows why it wasn't ever put in place so. | 01:03:43 | |
| Advisors of. | 01:03:49 | |
| It's going to be a lot of a legal side, a lot of. | 01:03:51 | |
| Technical side, construction and also finance side so. | 01:03:54 | |
| Yeah, this is not a forensic audit. | 01:03:58 | |
| Thank you, Parker. | 01:04:01 | |
| Like we're looking. | 01:04:02 | |
| Our staff from the RDA. | 01:04:05 | |
| That would specialize in. | 01:04:07 | |
| Gathering institutional. Institutional. | 01:04:09 | |
| Again. | 01:04:11 | |
| Probably just not hire. | 01:04:13 | |
| Part time staff to. | 01:04:14 | |
| To do this if it's going to be a long term thing or we're. | 01:04:16 | |
| Looking at legal or looking at finance? | 01:04:19 | |
| Like it seems like. | 01:04:21 | |
| We would just. | 01:04:23 | |
| Want to invest in having staff specific for the RDA rather than? | 01:04:24 | |
| Once we post here, that's largely what this is. That's what we're doing. | 01:04:28 | |
| This was also the recommendation, to my understanding, from Mr. Harding and. | 01:04:33 | |
| Even last week we had. | 01:04:39 | |
| Mr. Josh Daniels was in here too, and his. | 01:04:42 | |
| Comment was that there was. | 01:04:45 | |
| I think this was misrepresented maybe a little bit. | 01:04:47 | |
| In the previous discussion here. | 01:04:50 | |
| But there was. | 01:04:52 | |
| Some position. | 01:04:54 | |
| Outline For this, he said he needs financial. | 01:04:55 | |
| Help. Umm. | 01:04:58 | |
| It would be beneficial to have a financial director for the RDA or a financial analyst for the RDA, I think was his term. He also | 01:04:59 | |
| asked for legal support. | 01:05:03 | |
| In that position and. | 01:05:08 | |
| I don't know if we. | 01:05:10 | |
| We talked about Mr. Riddle taking that on or not. | 01:05:12 | |
| But there was, I think, some scopes that Mister Daniels had expressed. | 01:05:15 | |
| There was areas that needed. | 01:05:19 | |
| Additional support that would make RDA administration easier. | 01:05:21 | |
| Thank you. | 01:05:26 | |
| Create job descriptions. | 01:05:28 | |
| And open up the. | 01:05:30 | |
| Locations for the. | 01:05:32 | |
| Jobs just like we do with any other. | 01:05:33 | |
| Staffing position. | 01:05:34 | |
| I don't like this structure, that's how I understand it. | 01:05:36 | |
| That's what we're doing. | 01:05:40 | |
| These three people and then begin. | 01:05:42 | |
| And they can't work. | 01:05:45 | |
| Like why don't we just do job descriptions identify exactly the? | 01:05:48 | |
| Type of people were looking for. | 01:05:52 | |
| And the functions we want them to fill. | 01:05:53 | |
| And the responsibilities of the job. | 01:05:55 | |
| Parker, do you have a? | 01:05:59 | |
| Sure. I think, Ezra, what you're saying is correct and I just think that there's a little bit of a miscommunication. | 01:06:01 | |
| Here in that. | 01:06:07 | |
| There's probably some splitting hairs. | 01:06:08 | |
| I know you can't maybe see us or we can't see you because the boards in front of us, but the. | 01:06:11 | |
| Councils kind of looking at each other like that's exactly what the intent is here. It's maybe just not stated in as eloquent of | 01:06:16 | |
| a. | 01:06:19 | |
| Position. | 01:06:22 | |
| But the intent is that we are posting. | 01:06:23 | |
| And going through a traditional hiring process. | 01:06:26 | |
| And that these are not. | 01:06:30 | |
| Appointed positions, the I don't think that the the mayor is going to do anything administrative with this. This is going to go | 01:06:31 | |
| through. | 01:06:34 | |
| The traditional hiring all you guys. | 01:06:38 | |
| Yeah, yeah. | 01:06:40 | |
| I would echo that as what you described as. | 01:06:43 | |
| Contractors and the resolution. So if we're if we're actually looking to just do a normal hiring process, I think. | 01:06:56 | |
| That would make a lot of sense rather than. | 01:07:01 | |
| OK. | 01:07:03 | |
| That's on the agenda. | 01:07:05 | |
| Well, we don't want to. I, I don't mind adjusting it to saying they could be an employee or a contractor. You know, Josh Daniels | 01:07:06 | |
| is the RDA director, but he's a contractor. So the flexibility of a lot of people like to get paid. | 01:07:12 | |
| As a contractor instead of. | 01:07:19 | |
| As an employee, but I have no. | 01:07:21 | |
| Qualms opening it up? | 01:07:22 | |
| And I think, I think one of our one of our issues is, is we're not entirely sure exactly what is needed yet. We know something is | 01:07:25 | |
| needed that we were definite about that we know some of the things that are needed. We we suspect there are more things that we | 01:07:29 | |
| don't know about. | 01:07:33 | |
| And we're. | 01:07:38 | |
| We are hoping though through the course of this. | 01:07:39 | |
| This audit and so forth and with these advisors that we would learn more about it so that. | 01:07:42 | |
| At the, you know, at the turn of the fiscal year, we might be able to make some changes that are more in line with what you were | 01:07:46 | |
| talking about. | 01:07:49 | |
| But but I don't. I won't want to. Don't want to rein them in so much that they can't help us figure out what we need to do next. | 01:07:52 | |
| Yeah, I. | 01:08:00 | |
| And not only that, but in meeting with. | 01:08:01 | |
| Yeah, we're. | 01:08:04 | |
| We're kind of in the same boat with any staff where. | 01:08:06 | |
| You know, if we identify like. | 01:08:09 | |
| That that's kind of basically what I. | 01:08:10 | |
| Is just saying we're gonna hire. | 01:08:13 | |
| People when we haven't. | 01:08:14 | |
| Even kind of started this process, it sounds like we've got some clear frameworks. | 01:08:16 | |
| We need somebody on the finance side and we need somebody on the legal side. | 01:08:20 | |
| And so be nice to just post. | 01:08:24 | |
| Job descriptions that that. | 01:08:25 | |
| Sharon also share that these are the credentials we're looking for. | 01:08:27 | |
| Or at least an RFA, especially if we're looking at this long term. | 01:08:31 | |
| It'd be great to. | 01:08:35 | |
| And be great to establish exactly what we. | 01:08:36 | |
| Are hoping for as far as like what areas we want to consider and cover. | 01:08:39 | |
| Rather than just kind of just open-ended. | 01:08:43 | |
| No salaries like. | 01:08:46 | |
| So. | 01:08:48 | |
| AUD. | 01:08:52 | |
| Right. Yeah. | 01:08:53 | |
| We would need or what? | 01:08:55 | |
| People fill these roles that we're looking for is my. | 01:08:58 | |
| Right. | 01:09:01 | |
| So as as as right? | 01:09:02 | |
| I, I don't, I think we're all on the same page. What we're doing here is, is that. | 01:09:04 | |
| Chris Harding is going to be going have a lot of meetings and him going in from Salt Lake. | 01:09:09 | |
| And. | 01:09:14 | |
| Investigating and gathering all this knowledge and not having these people. | 01:09:15 | |
| Sitting in every single meeting and gathering every single document and training them. | 01:09:19 | |
| At the end of his. | 01:09:23 | |
| Audit, he will have the procedures, he will be looking at what currently is in place. | 01:09:24 | |
| And what is changed so that he can draft the procedures of? | 01:09:30 | |
| How it should be moving and working forward? | 01:09:34 | |
| So having those staff members in the meeting now, I agree with you at the end of the audit. | 01:09:37 | |
| What those procedures are? | 01:09:42 | |
| Those positions might change and be flexible on an ongoing basis to be able to fulfill with those. | 01:09:45 | |
| But we're at the beginning of a process. | 01:09:51 | |
| And it takes. | 01:09:54 | |
| A lot of staff hours to go and gather just all of the information these are. | 01:09:56 | |
| We're talking about the largest RDA in the state of Utah. | 01:10:02 | |
| And you're talking about? | 01:10:06 | |
| Generational changes of different people from you being the RDA perk director. | 01:10:07 | |
| To. | 01:10:13 | |
| Jake Mcharg. | 01:10:15 | |
| To even the beginnings of it and. | 01:10:17 | |
| And so. | 01:10:19 | |
| Jesse is going to be. | 01:10:20 | |
| Heavily involved. | 01:10:21 | |
| So is Chris Harding, and we just need these individuals to be. | 01:10:22 | |
| Bird dogging, for lack of a better word. | 01:10:26 | |
| Gathering institutional knowledge from different generations. | 01:10:29 | |
| So thank you. Any other comments on this we're bumping up on the end of our. | 01:10:32 | |
| And I think for 111 more thing. | 01:10:37 | |
| And I believe and I believe as we interview and put this out on the street. | 01:10:41 | |
| I mean, in interviewing for the city manager position, we had three really good applicants. You don't know. | 01:10:45 | |
| When people come in and so opening it up to a very wide. | 01:10:51 | |
| Range of people, yeah, we do feel like there are some people that could be really good that we want to apply, but you won't know | 01:10:55 | |
| until you get into the application process. So whether they be employees or contractors, you want that flexibility and I agree | 01:10:59 | |
| with that so. | 01:11:04 | |
| I would argue too, just based on kind of this conversation that we're having now, is that if, if. | 01:11:09 | |
| We are maybe looking at subcontractors versus staff specifically for the role. | 01:11:13 | |
| Recognizing too that this is a. | 01:11:19 | |
| Objective based activity right now. | 01:11:21 | |
| And the goal is to. | 01:11:24 | |
| Get us across the finish line with better practices at the end, and then recognize that these people are advisory to the. | 01:11:25 | |
| How do we actually structure it moving forward? What staff do we need to have in place permanently? | 01:11:32 | |
| And that these jobs. | 01:11:36 | |
| I think labeling them as a subcontractor also maybe indicates that they are not a permanent position. | 01:11:39 | |
| It's a temporary thing as we work through this process to. | 01:11:44 | |
| Better position ourselves. | 01:11:48 | |
| Yeah. OK. Thank you for that. | 01:11:49 | |
| We're going to jump now to committee reports, 4.1 DK that we needed to go through that. I have the report there. Yeah, go ahead. | 01:11:53 | |
| Jake it was awesome. We had. | 01:12:00 | |
| I think every religion that wanted to come came and met with us. The first meeting was much larger than the second. | 01:12:03 | |
| And subsequent meetings. I had so many follow up meetings individually to get to know. | 01:12:10 | |
| The different stakes of. | 01:12:16 | |
| The LDS Church. | 01:12:19 | |
| But also the. | 01:12:20 | |
| Mosaic Church, Church of Christ. I mean, there were, there were so many. | 01:12:22 | |
| And I have a report that's good, but I feel like we can improve upon as a city. | 01:12:26 | |
| And it's a new word that I'm going to use. It's going to be volunteerable. | 01:12:31 | |
| Which is. | 01:12:37 | |
| Most of these organizations work on an annual basis in in putting together their events and how and what they could do. | 01:12:39 | |
| But then #2. | 01:12:48 | |
| They're not good at. | 01:12:49 | |
| Creating the idea they need the they're good at having staff and people to give a. | 01:12:51 | |
| A better they were like. | 01:12:58 | |
| Almost all of them said. | 01:12:59 | |
| What's the date? | 01:13:01 | |
| How many people do you need and what do we need to bring? And we'll be there. | 01:13:02 | |
| And uh. | 01:13:06 | |
| And in the past, it seems like our city has been like, hey, come and help us or come lift. | 01:13:07 | |
| And they've allowed the organization to kind of. | 01:13:11 | |
| Go through and do that so the rules that we. | 01:13:14 | |
| Kind of put together was. | 01:13:17 | |
| And we wanted to put kind of a policy. | 01:13:19 | |
| And we we named them so for the library. | 01:13:21 | |
| For Vineyard Cares. | 01:13:24 | |
| For the Rec Center for events arch. | 01:13:27 | |
| And for? | 01:13:30 | |
| Public works. | 01:13:31 | |
| If. | 01:13:33 | |
| At an annual basis in in November and December. | 01:13:33 | |
| We could. | 01:13:37 | |
| Charge them that we would like volunteers and to identify. | 01:13:39 | |
| Different service and event opportunities. | 01:13:44 | |
| And the thing that they would need is how many people. | 01:13:47 | |
| How many hours? | 01:13:50 | |
| What would they need to bring? | 01:13:52 | |
| And staff and if we could make that. | 01:13:54 | |
| Public and so going to. | 01:13:56 | |
| And I've spoken with almost all of them except for the library of. I don't know if you want to speak David Pierce, but let's just. | 01:13:58 | |
| Where we got excited, but. | 01:14:05 | |
| But if we could put that together moving forward and then #2. | 01:14:08 | |
| Put that list in a common location. | 01:14:12 | |
| And and that we could we now have a list of who those are. | 01:14:14 | |
| Inviting them to volunteer, they were like we will fulfill. | 01:14:18 | |
| We will fulfill everything. | 01:14:22 | |
| And we got some feedback saying. | 01:14:25 | |
| You don't have enough service events. | 01:14:27 | |
| Identified because we would use all of them. | 01:14:31 | |
| If they were identified were just not communicating well. So me and David. | 01:14:34 | |
| DK are going to get on the same page and really kind of become. | 01:14:40 | |
| You know, volunteerable, if that makes sense. | 01:14:44 | |
| And that way, when we speak, we need 40 people for this day, this time to do this. | 01:14:47 | |
| They would take the assignment. | 01:14:52 | |
| If that makes sense. Awesome. | 01:14:53 | |
| Great report, I love it. | 01:14:55 | |
| All righty guys. Thank you so much. That is all we have on the agenda today. Closed session. | 01:14:57 | |
| To discuss I'm I'm you gotta go. Yep, I gotta, I gotta. | 01:15:01 | |
| I have a hard I'm. | 01:15:04 | |
| Run late, so if you. | 01:15:05 | |
| Do I have to be here for a closed session? I'm unavailable to stay for a closed session. | 01:15:08 | |
| Can we do a public? | 01:15:12 | |
| Could we just say real quick? | 01:15:14 | |
| That we put out the applications, They're great. Yes, please. Yeah, there's three of them we're supposed to whittle it down to. | 01:15:15 | |
| Two, do we want an agreement on 2? | 01:15:21 | |
| We have only we have a couple more. Let's do I think we have the scoring we've gone through and do that. So this isn't regards to | 01:15:24 | |
| the city manager position, the city manager position. So we I will say this, I was very pleased with the quality of the apple. | 01:15:28 | |
| Holy cow. | 01:15:33 | |
| Yeah, amazing. | 01:15:37 | |
| All of them acceptable. | 01:15:39 | |
| So right. | 01:15:40 | |
| OK. | 01:15:42 | |
| But the idea would be next Tuesday in the City Council doing a closed door session and group interviews on the finalists. Yep, I | 01:15:43 | |
| like it. | 01:15:47 | |
| We can, we can plan on that and we can I'll make sure that we have the time for that. So, OK, thank you guys. | 01:15:50 | |
| Hit the gavel. | 01:15:56 | |
| That's what do we want to? | 01:16:00 | |
| I would just do all three. I I would recommend a council that we do all three. | 01:16:01 | |
| Are you good with that, Ezra? | 01:16:06 | |
| Sure. OK, awesome. | 01:16:08 | |
| Thank you. | 01:16:10 | |
| All righty guys, appreciate it. | 01:16:12 | |
| Sorry. | 01:16:19 | |
| What I'm saying is let's just. | 01:16:28 |

| UM Vineyard City Council meeting, Mayor Zach Stratton presiding. | 00:11:49 | |
| Let's go ahead with a. | 00:11:54 | |
| Opening prayer and a pledge. | 00:11:57 | |
| Who? Whose turn is it? | 00:11:59 | |
| I nominate David for being the last one in, the last the last one in. | 00:12:02 | |
| Thank you, David. | 00:12:07 | |
| Prayer, then pledge. | 00:12:08 | |
| Our kind Father in heaven, we're very thankful for the blessings I was given to us, grateful for the chance to be able to sit here | 00:12:18 | |
| and. | 00:12:21 | |
| And to work together to. | 00:12:24 | |
| Find ways to move our city forward. We're grateful for all the input we receive and it has to help. Please continue to bless those | 00:12:26 | |
| around us to. | 00:12:29 | |
