OK. 00:00:08
Left. 00:00:09
OK. We're rolling. All right. Thank you so much for staying with us. 00:00:16
It is still December. 00:00:30
And. 00:00:32
11:00, and we're going to go ahead and get the Vineyard City Council session started. 00:00:34
We'll go ahead and move into our consent agenda. 00:00:41
I just need a motion. 00:00:44
Mayor, I move to be approved. Concise as noted 2.12. 00:00:46
All right, I First buy ties. Second. Second. By Christie. All in favor, Aye. Any opposed? 00:00:50
All right, we have an appointment for Planning Commission, Nathan Steele. 00:00:57
Everybody had a chance to meet him. He's really excited about the position. This will be for a actual seat on the Planning 00:01:03
Commission. He couldn't be with us tonight, but he's really excited to start. So I was just like a motion to approve that 00:01:08
appointment. 00:01:12
OK. 00:01:18
All right. First by Christie, second by Tice. All in favor? Aye. Excellent. 00:01:20
We'll go ahead and move to our discussion items. Our first item, 4.1, we will be moving. So I need a motion to move the canvas. 00:01:25
Oh, go ahead. Sorry Pam, I remember you wanted to. 00:01:30
It's been too many hours since you told me. 00:01:38
Yeah, so. 00:01:41
Let's take a hot minute, right? OK, just fill, fill everybody in. It's just what happened today. There was a tie vote in one of 00:01:43
the elimination rounds for the election. 00:01:48
For the first seat in the election, and due to there being a tie vote in one of the county rounds for the first council seat, the 00:01:54
following code comes into effect. 00:01:59
State code 2846036 States have reached ballot counting phase after the. 00:02:04
I do the right three things. After the first phase, if two or more candidates Ty is having received the fewest valid rankings 00:02:11
counted at that point in the ballot count, the election officer shall eliminate one of those candidates from consideration by lot. 00:02:18
This was done earlier today with Utah County President. 00:02:25
And with that happening, because the the votes are so close together, it also triggers. 00:02:30
A recount of the election. 00:02:37
So, and I won't read the whole code, there's more code 28628 four six O 310 states. How that's to work? 00:02:39
And so I am requesting. 00:02:49
The city, well myself and the county is requesting that. 00:02:51
You guys make a motion to extend. 00:02:57
The 2020 General municipal election canvas to the December 13th, 2023 City Council meeting. All right, thank you so much, Brown. I 00:03:00
just need a motion. 00:03:05
So. 00:03:11
First by Marty, second by ties, Do I need to do a roll call? 00:03:12
All in favor. 00:03:17
Nobody's opposed. 00:03:20
All right. We'll go ahead and go to 4.2, discussion and action, zoning, text, amendment, medical and commercial uses. I do not 00:03:21
think we need a recap. Does anybody? 00:03:26
Preview kind of what? 00:03:32
Commission came up with. 00:03:35
Maybe we'll go through that. It was a conditional use on the airport and Verity port. That's what it was and that is all. Does 00:03:37
anybody have any questions about that? Would you like to make it permanent, permitted or would you like to keep it conditional? 00:03:43
I just need a motion. You could also do a carve out for hospitals to have those be a permitted use. That's typically an ancillary 00:03:51
use to a hospital that they have so many regulations anyway and you can make the others a conditional use and that would catch if 00:03:57
there's a private company that wants to put one on top of a building, you know that that that might be more of a conditional use. 00:04:04
I really like that. So restate that OK. 00:04:10
I permanently use for. 00:04:19
Teleport and yeah and verticals on medical facilities and conditional use in all instances. 00:04:21
OK. Does everybody agree to that? 00:04:29
This is for the downtown and all areas. 00:04:32
That's excellent. 00:04:35
There's going to be a lot of FAA regulations since we don't have time to discuss it. Conditional use is just going to put some 00:04:39
stipulations that probably just put the FAA regulations, everybody in agreement with that. All right, I need a motion, OK, I'm 00:04:44
going to adopt ORRIS 2023-3 medical and commercial zoning uses. 00:04:50
With the. 00:04:56
Stated parameters. 00:04:58
With the state of the amendment. Thank you, Christy. Can I get a second, second, any discussion? 00:05:02
OK, this is probably A roll call price. 00:05:07
Amber, hi. Yay. Marty, Christine. OK, that carried. Thank you. Discussion and action Homesteads Pod one live work development 00:05:11
agreement resolution 202350. We'll go over them there were. 00:05:18
A few that came into. 00:05:24
Uh, changes from the. 00:05:27
Planning Commission. 00:05:29
I have them. 00:05:36
Yeah, there were two proposed amendments to the Homestead Development Agreement by the Planning Commission. The 1st is in Section 00:05:39
2 to add a sentence that says site plans for the project shall be informed. 00:05:45
By analysis performed by a qualified transportation engineer. 00:05:51
Of the parking locations, orientation, and site circulation relative to pedestrian and bicycle movement on adjacent St. sidewalks 00:05:55
and trails. 00:05:59
And the other amendment was in Section 8. 00:06:03
To add a restriction to the live work units that businesses within the live work unit shall have no more than two non resident 00:06:07
employees working at the business concurrently. All right, I did have a question about that and the first one was for the 00:06:13
visibility standards, the site circulation and the orientation of the parking, is that right? Yes. OK. The second one about the 00:06:19
two employees, my question is? 00:06:24
I understand the idea that they do not want to have additional cars, but say they have the need for the operation to have three 00:06:31
employees that are off site and the person bikes there and so it's not an impediment to the driving. Is there any way that we can 00:06:38
not create issues for businesses that are trying to live and work in the same area? We will change working with parking. 00:06:45
As approved by by like the HOA. Because if they're if they're going to be managing the parking outside, if they notice that 00:06:52
there's not a parking issue, then you know what, why not allow them to get approval instead of making them come with the city? I 00:06:57
just. 00:07:01
Like a bit much just to add an employee. 00:07:06
That that should be something because Mike's team is going to be on. 00:07:09
OK. Does everybody feel comfortable with that? Any pushback on that? No. OK, partially on the middle of the road, OK. Were there 00:07:14
any other provisions or changes to the parking? There was a lot of discussion about it that came forward. 00:07:21
No, that was. 00:07:29
OK. Any questions on the parking? 00:07:31
Will you repeat the provisions again? I'm so sorry. That's OK. It's really late. Go ahead. 00:07:34
The first is in Section 2 that relates to the parking. We add a sentence that says. 00:07:40
Site plans for the project shall be informed by analysis performed by a qualified transportation engineer of the parking 00:07:45
locations, orientation and site circulation. 00:07:51
Relative to the pedestrian, bicycle movement on adjacent streets, sidewalks, and trails. 00:07:56
In plain English, would I take that to mean as before they get the site plan approved, they have to have? 00:08:02
Transportation Engineer review it. 00:08:08
And make sure the locate the types of vehicles in the orientation the vehicles is safe for pedestrians, bicyclists and the like. 00:08:11
And we felt like that not only took care of the safety issue but also the parking issue and then we qualify the parking issue with 00:08:17
the employment thing that we just fixed. And then the second one is Section 8 and we add a restriction on the live work units. 00:08:24
That business with businesses within the Live Work Unit shall have no more than two non resident employees. 00:08:31
Parking at the business concurrently unless otherwise authorized by the HOA. 00:08:38
Does that work? Yeah. So they would just make the standards too. And it's all good evidence, you know. All right. Any other 00:08:43
questions or further discussion or can I get a motion? 00:08:47
OK, I need a motion. 00:08:55
2023 Dash 50 Homestead Part One Living Work Development Agreement as amended. 00:08:58
Again, first by ties, second by Chrissy. Any discussion. All right, tight. 00:09:05
Yay, Marty. Christy. 00:09:11
Yeah, All right. Looks like we're moving right into 4.4 discussed an action E Geneva Lander nation and development agreement. Now 00:09:14
we have to divide these two. Would we like to do that in the beginning, I think the proposal from the developer was to. 00:09:20
Move this to the next agenda and then you can approve the two agreements seeing what's in. 00:09:27
OK, let's go ahead and move it to the next agenda. 00:09:32
Great, I just need a motion. 00:09:36
I moved to move. 00:09:40
No, I'm not ready. I moved. 00:09:45
202351 to the next meeting and that is 4 point. 00:09:51
Right. OK. To the next meeting. Great. Can I get a second all in favor? 00:09:56
Aye, all right. Give us some. No, I need a motion to adjourn and a second second. 00:10:01
Like if I, Marty, all in favor, OK, give us a minute and we'll change our minutes to our meeting to the RDA. 00:10:06
All right. 00:10:16
