land use ordinance, text amendment to Vineyards Subdivision code. 00:01:41
OK, this one's pretty easy. So it's it's known to the subdivision code. 00:01:50
Our signature boxes on our plat, our subdivision plots, a lot of them had spaces for people to sign that aren't required by state 00:01:56
or county code for them to sign. And so we're doing is amending the the subdivision code where we talked about preliminary plots 00:02:04
and final plots to make sure that we're in line with the with the state and county requirements. 00:02:12
And so basically what the county, what the state requirement is, is to have the city planner, the city engineer and the city 00:02:20
manager representing the will of the legislative body sign the the plots moving forward. So only three. 00:02:29
Three people essentially and just add a little bit to that you can. 00:02:39
You're still gonna review it. And so you'll still have that distraction. What the city planner would do is ensure that whatever 00:02:44
gets approved is carried over into the Mylar that like the the document sheet that actually gets physically signed. So the process 00:02:51
would be the same, but it would save the, you know, because there have been times and you've been really good about it. But like, 00:02:57
you know, where we can't get someone who's supposed to be on it that the sign you're waiting. That's not easy. 00:03:04
No one here but it, but we figured we just meet the requirements of state code. That's all we have to do. 00:03:12

So I, I don't, I mean, because I mean really the Planning Commission is the board that does the bulk of, of reviews for 00:05:16

The City Council typically takes your guys''s, you know, recommendation because you're the, the planning experts. And so they, 00:05:26
they tend to not add a lot of like review analysis. And so we felt like the city planner and the engineer would be able to ensure 00:05:34
that anything that's brought up during the Planning Commission review is, is in there. 00:05:42
But yeah, I mean that that's our recommendation and if you, if you guys feel like keeping. 00:05:50
You know, the Planning Commission chair or the mayor on those or the, the, you know, any other individuals we can do that with, 00:05:57
you know, that we just feel like this will streamline the process that of course, and I, I don't feel strongly one way or another. 00:06:04
I like to keep things minimal. I just want to ask those questions for the release, open it up and talk about it. 00:06:11
As far as the mayor goes, I mean, having a city manager represents those who are elected seems to me to be a little bit. 00:06:18
Counter counter legislative, that is not having an elected official. 00:06:29

Because they're a little bit, they're held a little more responsible to the public when you're an elected official than if you're 00:06:40
hired employee. So I just wanted to throw that out. 00:06:44

You know, I'm not seeing the door City engineer, Sir, just to kind of follow up on your question in regards to the city manager 00:07:02
signing the sign, the thoughts on behalf of the City Council, the City Council has a designate has provided him that authority. 00:07:10
Delegate, delegate the authority to allow him to act on on their behalf. Again, the same measure is doing this and to represent 00:07:20
the world of Council. So obviously the Council is going to be the one that approves the does the final approval of the plot and 00:07:26
the same managers just a fixing the signature. 00:07:32
Representing that there and they have done their approval to say manager serves at the will of the council. So for any for at any 00:07:38
time at the same address, I guess does not do represent the world of the council. Then the State Council can move forward with 00:07:46
whatever actions they would want to do that to include removing that authority to sign class as well. 00:07:55
And in that case, in regards to the Planning Commission. 00:08:04
Reviewing class, the answer is yes. And then this this city planner will be signing the plot to in essence do the same thing, kind 00:08:10
of show that the you know, the plot has been reviewed and accepted by the Planning Commission and the same Azure will be signing 00:08:19
their signature to represent that the city council's review that approved the plan as is the city engineer. 00:08:28
Is merely assigned to sign the flat to kind of acknowledge that the plot shows the information. 00:08:38
My technically correct information, I'll say it like that on that you also have it, you know, you also have the other people's 00:08:47
signatures as well, like the Lancer bear who's assigning signing it to test a test that the information being placed on there is, 00:08:55
you know, technically correct as well. So other, other municipalities outside the state or outside the state of Utah, excuse me. 00:09:04
You know, they they typically all they have, they might have the most body, whether it be in the mirror or the city manager and 00:09:12
maybe the city attorney. That's pretty much it. Again, it's. 00:09:17
It's really just aligning ourselves up to the to the state's requirements and kind of making it, I'll say like what Morgan has and 00:09:23
I'm sure other plans have stayed before, you know, making it easier for us to work with our business partners, the developers and 00:09:30

It's not in the zoning code, but this, this will align our subdivision code with the municipal code because there's a section of 00:09:48
the municipal code that that allows the city manager to design plants in, in behalf of the of the City Council. And so there, 00:09:54
there's already language, but it's not in the subdivision code, it's the municipal code. And so we're, we're bringing that over to 00:10:00

And I think we've only looked at this like twice the last five years. We're supposed to look at it on an annual basis. So I'm not 00:22:40

do a quick read through. It's 8 pages, so it's not a huge assignment, but just see if there's anything that sticks out to you. If 00:22:54
we need to make some amendments, any changes. The bylaws align with the Planning Commission code and the zoning code. 00:23:01
But they cover things like your powers and duties, the membership. So like we have 5 regular members. 00:23:09
And it allows one to three alternate members and it provides a breakdown. Tim was instrumental and and put putting out a lot of 00:23:16
this information together. Thoughts about compensation. I think that's very that's very general, just kind of what the City 00:23:23

And has failed to notify the Commission chair in advance to obtain approval for said absences. Such absences may be considered non 00:28:52
performance of duty and can place the members subject to being removed and replaced upon recommendation of the chair to the mayor. 00:28:59

That project is it's double the size of of our downtown and has the same level of density and intensity of uses and like. 00:40:11
Really closely, not another following our plan, but like their plan matches really closely with like the The Walking distances, 00:40:20
the different centers, the transit incorporation trails and green space space throughout. So there I mean their idea was that 00:40:28
everyone within every resident or business within 500 feet can can reach an open space trail. 00:40:36

land use ordinance, text amendment to Vineyards Subdivision code. 00:01:41
OK, this one's pretty easy. So it's it's known to the subdivision code. 00:01:50
Our signature boxes on our plat, our subdivision plots, a lot of them had spaces for people to sign that aren't required by state 00:01:56
or county code for them to sign. And so we're doing is amending the the subdivision code where we talked about preliminary plots 00:02:04
and final plots to make sure that we're in line with the with the state and county requirements. 00:02:12
And so basically what the county, what the state requirement is, is to have the city planner, the city engineer and the city 00:02:20
manager representing the will of the legislative body sign the the plots moving forward. So only three. 00:02:29
Three people essentially and just add a little bit to that you can. 00:02:39
You're still gonna review it. And so you'll still have that distraction. What the city planner would do is ensure that whatever 00:02:44
gets approved is carried over into the Mylar that like the the document sheet that actually gets physically signed. So the process 00:02:51
would be the same, but it would save the, you know, because there have been times and you've been really good about it. But like, 00:02:57
you know, where we can't get someone who's supposed to be on it that the sign you're waiting. That's not easy. 00:03:04
No one here but it, but we figured we just meet the requirements of state code. That's all we have to do. 00:03:12
So, all right, so those changes in those two sections and that's it. OK. Do we need to open this up for a public hearing? Yes, 00:03:18

So I, I don't, I mean, because I mean really the Planning Commission is the board that does the bulk of, of reviews for 00:05:16
subdivisions. 00:05:20
The City Council typically takes your guys''s, you know, recommendation because you're the, the planning experts. And so they, 00:05:26
they tend to not add a lot of like review analysis. And so we felt like the city planner and the engineer would be able to ensure 00:05:34
that anything that's brought up during the Planning Commission review is, is in there. 00:05:42
But yeah, I mean that that's our recommendation and if you, if you guys feel like keeping. 00:05:50
You know, the Planning Commission chair or the mayor on those or the, the, you know, any other individuals we can do that with, 00:05:57
you know, that we just feel like this will streamline the process that of course, and I, I don't feel strongly one way or another. 00:06:04
I like to keep things minimal. I just want to ask those questions for the release, open it up and talk about it. 00:06:11
As far as the mayor goes, I mean, having a city manager represents those who are elected seems to me to be a little bit. 00:06:18
Counter counter legislative, that is not having an elected official. 00:06:29
On that approval, if you will. 00:06:35
Because they're a little bit, they're held a little more responsible to the public when you're an elected official than if you're 00:06:40
hired employee. So I just wanted to throw that out. 00:06:44
Yeah. So will we as a as a Planning Commission, will we see all the flats before they need to be signed? 00:06:51
You know, I'm not seeing the door City engineer, Sir, just to kind of follow up on your question in regards to the city manager 00:07:02
signing the sign, the thoughts on behalf of the City Council, the City Council has a designate has provided him that authority. 00:07:10
Delegate, delegate the authority to allow him to act on on their behalf. Again, the same measure is doing this and to represent 00:07:20
the world of Council. So obviously the Council is going to be the one that approves the does the final approval of the plot and 00:07:26
the same managers just a fixing the signature. 00:07:32
Representing that there and they have done their approval to say manager serves at the will of the council. So for any for at any 00:07:38
time at the same address, I guess does not do represent the world of the council. Then the State Council can move forward with 00:07:46
whatever actions they would want to do that to include removing that authority to sign class as well. 00:07:55
And in that case, in regards to the Planning Commission. 00:08:04
Reviewing class, the answer is yes. And then this this city planner will be signing the plot to in essence do the same thing, kind 00:08:10
of show that the you know, the plot has been reviewed and accepted by the Planning Commission and the same Azure will be signing 00:08:19
their signature to represent that the city council's review that approved the plan as is the city engineer. 00:08:28
Is merely assigned to sign the flat to kind of acknowledge that the plot shows the information. 00:08:38
My technically correct information, I'll say it like that on that you also have it, you know, you also have the other people's 00:08:47
signatures as well, like the Lancer bear who's assigning signing it to test a test that the information being placed on there is, 00:08:55
you know, technically correct as well. So other, other municipalities outside the state or outside the state of Utah, excuse me. 00:09:04
You know, they they typically all they have, they might have the most body, whether it be in the mirror or the city manager and 00:09:12
maybe the city attorney. That's pretty much it. Again, it's. 00:09:17
It's really just aligning ourselves up to the to the state's requirements and kind of making it, I'll say like what Morgan has and 00:09:23
I'm sure other plans have stayed before, you know, making it easier for us to work with our business partners, the developers and 00:09:30

It's not in the zoning code, but this, this will align our subdivision code with the municipal code because there's a section of 00:09:48
the municipal code that that allows the city manager to design plants in, in behalf of the of the City Council. And so there, 00:09:54
there's already language, but it's not in the subdivision code, it's the municipal code. And so we're, we're bringing that over to 00:10:00
